Description/Analysis
Issue Detail: The property owner retained the historic consulting services of Historic Environment Consultants to prepare and submit property-specific background research and a historic resource evaluation form (Attachment 3) for 1301 45 th Street, also known as the Hale-Marks House. After review of the background research, staff presented a Statement of Nomination to the Preservation Director who concluded at a public hearing on January 19, 2023, that the property appears eligible for listing in the Sacramento register pursuant to the criteria provided in Sacramento City Code section 17.604.210.A.1. iii. On February 15, 2022, the Preservation Commission held a hearing and passed a motion recommending the City Council adopt an ordinance listing the Hale-Marks House (1301 45th Street) in the Sacramento Register. Staff has prepared a draft Ordinance (Attachment 2) which justifies listing the property on the Sacramento Register.

Policy Considerations: The City Council has found “that significant aspects of the City’s rich and diverse historic resources deserve recognition and preservation to foster an understanding of our heritage, and to promote the public health and safety and the economic and general welfare of the

people of the city. The preservation and continued use of historic resources are effective tools to sustain and revitalize neighborhoods and business districts within the city, enhance the city’s economic, cultural and aesthetic standing, its identity, its livability, marketability and urban character” (Sacramento City Code section 17.604.100.A.). To this end, the city code directs the Preservation Director, to “make preliminary determinations relative to properties’ eligibility for listing on the Sacramento register” and to “initiate proceedings to nominate resources for listing on the Sacramento register” (Pursuant to City Code sections 17.604.100.C.2 and 17.604.220).

The nomination of 1301 45th Street for listing as a landmark on the Sacramento Register is consistent with Sacramento 2035 General Plan goal HCR 2.1, which provides for the identification and preservation of historical and cultural resources. General Plan policy HCR 2.1.1 states, “The City shall identify historic and cultural resources, including individual properties, districts, and sites, to ensure adequate protection.”
Economic Impacts: Not applicable.

Environmental Considerations:

California Environmental Quality Act (CEQA): The listing of 1301 45 th Street as a historic landmark on the Sacramento register is exempt from review under the California Environmental Quality Act pursuant to CEQA Guidelines section 15308. Section 15308 exempts from CEQA review acts that are undertaken to assure the maintenance, restoration, enhancement, or protection of the environment where the regulatory process involves procedures for protection of the environment. Listing the property as a historic landmark would ensure that future development on the site would undergo preservation review, as part of the city’s site plan and design review process, prior to the granting of any entitlements, thereby protecting the historic resource, which would be considered part of the environment.

Sustainability: Not applicable.

Commission/Committee Action: On January 19, 2023, the City of Sacramento’s Preservation Director, in conformance with Section 17.604.220 of the City Code, held a public hearing, reviewed the historic analysis prepared by staff (Attachment 2) and concurred with a draft statement of nomination and directed staff to prepare a draft Ordinance (Attachment 1) for review and consideration by the Preservation Commission. On February 15, 2023, the Preservation Commission held a hearing and passed a motion recommending the City Council adopt an ordinance listing 1301 45th Street in the Sacramento Register.

Rationale for Recommendation: Listing of 1301 45 th Street (Figure 1) as a landmark on the Sacramento Register is consistent with the Historic Preservation Chapter (17.604) of the City Code and the goals of the 2035 General Plan. Listing the nominated resource on the Sacramento register

will help ensure its preservation and encourage rehabilitation consistent with the U.S. Secretary of the Interior’s Standards for the Treatment of Historic Properties. The Hale-Marks House at 1301 45 th Street (Figure 1) is a fine example of French eclectic and English Tudor Revival styles with distinct historic architectural elements intact. Significant features and characteristics of this architectural style that are present on 1301 45th Street include its concrete block construction with an applied stone-like exterior with interspersed stamped quatrefoils, clay tile roof, a prominent arched window in the front- facing gable with beveled divided lites and a Juliette balcony, half timbering, cone turret, round gutters and downspouts, round dormers, pinnacles on gable ends, ornate bay window, metal sash windows, and decorative brick chimney stacks. Adopted by the Sacramento City Council
[Date Adopted]
AN ORDINANCE LISTING 1301 45TH STREET AS A LANDMARK ON THE SACRAMENTO REGISTER

OF HISTORIC AND CULTURAL RESOURCES

BACKGROUND
A. The city council has found “that significant aspects of the city’s rich and diverse historic resources deserve recognition and preservation to foster an understanding of our heritage, and to promote the public health and safety and the economic and general welfare of the people of the city. The preservation and continued use of historic resources are effective tools to sustain and revitalize neighborhoods and business districts within the city, enhance the city’s economic, cultural and aesthetic standing, its identity and its livability, marketability and urban character.” (Sacramento City Code section 17.604.100.A.)
B. To this end, the city code provides a mechanism for listing landmarks, historic districts, and contributing resources on the Sacramento Register of Historic and Cultural Resources (“Sacramento register”).

C. On January 19, 2023, the Preservation Director reviewed a statement of nomination and determined that the property located at 1301 45th Street is eligible for listing on the Sacramento Register of Historic and Cultural Resources a landmark. On February 15, 2023, the Preservation Commission concurred with the findings of the Preservation Director and recommended the City Council list the property at 1301 45th Street as a landmark in the Sacramento register.

*P3a. Description:

The property contains a large two and a half story Period Revival residence reflecting a tower subtype of French Eclectic and English Tudor/medieval design. Roof forms and a half-timbered gabled entry on the north reflect Tudor stylistic features while the principal body of the building, its image, and the relative scale suggest a varietal subtype of French Eclectic design. The style reflects a combination of Northwest French Norman farmhouse design identified as ‘eclectic,’ and a similar medieval English subtype [McAlester].

The building is constructed of concrete block with a special surface treatment to provide a weathered stone-like image. Some slightly differently colored ‘stone’ materials suggest a quoin pattern around some wall corners. The steeply pitched roof is covered with clay tile. Three chimneys with a brick design project from the roof on the north and south.

*P3a. Description:

The roughly L-shaped structure parallels 45th Street with a steeply pitched gable roof intersected by an east/west gabled wing along the northern end of the building. The primary elevation faces west with the strong focal point of a large gabled wing containing a dominant multi-paned arched window behind a shallow projecting balcony. The main body of the house is a taller central section with shorter gabled wings projecting to the north and south at either end.

The wood entry door occurs on ground level near the west wing, and a multi-paned angled bay window projects from the southern end of the elevation. Multipaned metal sash windows, one of which intersects the second-floor eave of the northern wing, provide interior light on both floors around the building perimeter.

The building does not appear to have experienced modifications other than the addition of the bay window (see page 8) and a solarium to the back (east) elevation (see page 6).

The north end of the house displays a variety of both French eclectic style and Tudor images including a round tower and a half-timbered entry gable. This elevation contains a projecting gabled wing facing north, a round two- story tower with a conical ‘witch’s hat ‘roof, windows and a street door. A windowed gable projects from the second story above the first floor and its window (see page 5).

An additional building entry with a wood and glass door beneath a half-timbered gable occurs at street level. The remainder of the north elevation is occupied by three garage doors. Two segmented half-round “eyebrow’ windows project from the garage roof facing north. An additional one-story free-standing garage structure stands at right angles to the north elevation and contains two storage spaces.

The south elevation contains a shorter projecting one-story wing with additional windows of the same design as the rest of the house. The east elevation is the back of the building and contains an incorporated solarium feature, a two- story gabled wing, a large gabled dormer with windows, a wing with three smaller dormers, and a swimming pool.

Windows and doors replicate those on other elevations of the house. Roof and wall materials match those of the building’s principal facades.

The size, scope, design and detail of this architectural landmark is most noteworthy. The variety of its detail and design provide it with a stunning image and interesting veracity that has earned it a nickname of ‘the Castle.’ Landscaping is controlled, with lawn, low hedges and shrubs, two tall façade trees along 45th Street and some mature trees and foliage along the southern elevation.

*B10. Significance: (continued)

The building permit for this house was
taken out in November 1925 for $34,000 by
Dr. Nathan and Harriet Hale. It was an
enormous amount of money considering the
times. At the same time mansions were
being built in Curtis Park for $10,000 to
$14,000 [Boghosian/Cox]. Dr. Hale was a
distinguished physician in Sacramento. He
was one of the founders of Sutter Hospital
and in 1929-30 he was chief of staff. The
Hales probably lived in the house in the
latter part of 1926. However, they separated
on October 3, and on February 5, 1927,
Harriet Hale was granted a divorce [Bee
2/5/1927, p. 1].

As part of the settlement, Dr. Hale
deeded his interest in the house to his wife.

She immediately sold it to Louis and
Josephine Marks for $42,000.

In 1925 Marks had sold a business property near 16th & K Streets for $36,500 [Bee 11/29/1925 p. 12]. In addition, he was the proprietor of the Rialto Theatre at 423 K Street since 1915 [Bee, 4/27/1935, p. 12]. Marks had other substantial real estate investments. In 1934 he traded some Sacramento real estate for a 5 -acre piece of property known as Wildwood, which was located on Winding Way one mile east of Del Paso Park [Bee 10/20/1934, p. 7]. That property may well be a portion of what is now American River College. In March 1927, the Marks took out a permit to add a solarium on the back of the house and a bay window on the first floor, south end.

As a further demonstration of his wealth, during the Great Depression, when many were suffering financial setbacks, Marks and his wife took a trip around the world in 1932 [Bee, 8/30/1932, p. 15] and an extended auto trip to the east coast in 1933 [Bee 6/2/1933, p. 21].

The social pages of the times had several articles concerning the Marks either attending or hosting social gatherings that were attended by a “Who’s Who” of Sacramento society. For a brief time they lived at 2666 Montgomery Way, which is now being nominated as a National Register Historic District.

Louis Marks died in 1948 and by 1949 the house had been sold to attorney Archibald M. Mull, Jr. and his wife Dorothee [Death Index, Directories]. Mull was president of the State Bar in 1949 and was president of the National Conference of Bar Presidents in 1954. He was also Earl Warren’s campaign manager when he ran for President of the United States. Mull was well known as an effective fund raiser for many projects and social organizations. He died of heart attack in 1978 [Bee 3/13/1978, p. 12, 13]. Dorothee lived in the house for a few more years and, by the early 1980s, the occupant of the house were Ross and Lynn Relles [Directories]. In more recent years the occupants have been Mark and Shari Lasher. Mark is an executive with Lasher Auto [Nuwber].

This house i s significant due to association with several important figures in Sacramento History and the community. While Hale's residence was short-lived, he did build the house and he was a very important physician in Sacramento at the time. Marks was a wealthy capitalist that had property and businesses of all types in Sacramento. He and his wife were part of a social set that included many of the well -to-do residents of Sacramento. Even during the Great Depression, they had plenty of money to spend. Archibald Mull was a highly prominent attorney that was well known statewide as the president of the California Bar Association and nationally as the president the National Conference of Bar Presidents.

He had many other accomplishments and recognitions.

The large building is an unusual and imposing residence, and an notable Period Revival statement of its era in its East Sacramento neighborhood. Its size, scale and style are both interesting and commanding. It is almost a textbook representative of a combination of French Norman and Tudor designs, with the added whimsy of its tower derivations. It lacks modifications to its primary image and appears to be an excellent example of its stylistic derivation. The property is also associated with a successful and important figures in the Sacramento community.

The property appears to meet criteria for listing as a Landmark in the Sacramento Register of Historical and Cultural Resources under City Code17.604.210.(A)1.a.ii, association with the lives of significant historic persons, and iii, “embodies the distinctive characteristics of a type, period, or method of construction, and the California Register of Historical Resources, Public Resources Code 4852a(1)b(3).
