2-March 20, 2023 Measure U Committee Request to Establish Subcommittees 3-City Council Resolution 2018-0393 Establishing the Measure U Committee Additional Description/Analysis
Issue Detail: The attached Memorandum (Attachment 2) from the Measure U Community Advisory Committee (Measure U Committee) is presented to the Personnel and Public Employees Committee (P&PE) for review and consideration to forward to the City Council.
The Memorandum requests that the City Council establish three subcommittees of the Measure U Committee:
1. Participatory Budgeting Implementation Subcommittee
2. Budget and Policy Development Subcommittee
3. Community Communications Subcommittee
File ID: 2023-00408 4/18/2023 Discussion Item 4.
City Council Resolution 2018-0393 (R2018-0393) outlines the scope of the Measure U Committee’s responsibilities (Attachment 3). Each proposed subcommittee may align its work R2018-0393 in the following manner:
Proposed Subcommittee Alignment with Measure U Committee’s Scope Participatory Budgeting
Implementation
R2018-0393 states that a power and duty of the Committee is to “Work with City staff on community engagement with respect to the Transactions and Use Tax.” In allocating $1 million Measure U Funds toward the Participatory Budgeting Pilot Program, Council authorized the Measure U Committee to lead a
community engagement process in which residents voted on how those funds should be spent. The Measure U Committee has expressed interest in monitoring the implementation of the winning projects.
Budget and Policy
Development
R2018-0393 states, “To ensure that the expenditures of City resources reflect Council and community priorities, the committee shall review, report, and make non-binding recommendations on revenue and expenditures of certain funds from the Transactions and Use Tax.” To this end, the Measure U Committee has
historically developed recommendations regarding Measure U expenditures prior to Council’s adoption of the annual budget based on its interpretation of Council and community priorities.
Community
Communications
R2018-0393 states that a power and duty of the Committee is to “Work with City staff on community engagement with respect to the Transactions and Use Tax.” The Measure U Committee has expressed interest in advising the City’s outreach and education efforts to raise public awareness about how Measure U funds are being spent, including development of a “Paid for by Measure U” logo and a fact sheet that summarizes how Measure U funds are currently allocated.
This request was originally approved by the Measure U Committee on September 19, 2022. The City Council subsequently adopted the Council Rules of Procedure on November 29, 2022 which outlines the process for city advisory bodies to report to the P&PE. On March 20, 2023, the Measure U Committee passed a motion forwarding the Memorandum to P&PE for consideration but without the proposed meeting schedule.
Subcommittee Meeting Schedule Procedure
File ID: 2023-00408 4/18/2023 Discussion Item 4.
If Council considers establishing one or more of the proposed subcommittees, staff recommends doing so without a regular meeting schedule and instead adopt the following procedure for scheduling special meetings on an as-needed basis:
1. The Measure U Committee Chair shall appoint members to each subcommittee.
2. Upon an identified meeting purpose, the Measure U Committee Char shall determine the availability of subcommittee members to meet and establish a quorum at a specified date and time.
3. The Measure U Committee Chair shall send a written request to staff requesting the special meeting at the proposed date and time.
4. Staff shall coordinate with the respective Charter Officers (City Manager, City Clerk, and City Attorney) to determine if sufficient staff and facility resources are available to hold the meeting.
5. If sufficient resources are available at the proposed date and time, the special meeting shall be held.
6. If insufficient resources are available, staff shall attempt to propose an alternative meeting date and time in which resources are available and request that the Measure U Committee Chair determine the availability of subcommittee members to meet at that date and time. If the Chair determines a quorum is possible, then the special meeting shall be held.
7. Under no circumstances shall a meeting be held in which any Charter Officer deems insufficient resources are available to support such a meeting.
Policy Considerations: Sacramento City Code Chapter 2.40.160 states:
A city board or commission may establish a subcommittee upon approval by the city council.
Before consideration by the city council, the city board or commission must make its request to establish a subcommittee to the Personnel and Public Employees Committee.
City Council Resolution 2018-0393 adopted October 2, 2018 outlines the purpose and the powers and duties of the Measure U Committee specifically, to ensure that the expenditures of City resources reflect Council and community priorities, the committee shall review, report, and make non- binding recommendations on revenue and expenditures of certain funds from the Transactions and Use Tax (Sacramento City Code chapter 3.27.).

U Committee re-considered the request and passed a motion forwarding the Memorandum to P&PE for consideration but without a proposed meeting schedule.

Cc:
City of Sacramento Mayor and City Council
Date: March 20, 2023
Subject: Request to Establish 3 Subcommittees
Historical Purpose: The Measure U Community Advisory Committee has established Ad Hoc Committees for the purpose of preparing and enabling the Committee to conduct its business eff

Historical Composition: Per the Brown Act, Ad Hoc Committees previously contained fewer than a voting majority of members. October 2, 2018
Establishing the Measure U Community Advisory Committee and Defining the Scope of the Responsibility of the Committee; and Rescinding Resolution 2012-0344, which Established the 2012 Measure U Citizens Oversight Committee
BACKGROUND
A. On July 31, 2018 the City Council (Council) approved an ordinance proposing the City of Sacramento Transaction and Use Tax Ordinance of 2018. Proposed city code section 3.27.150 calls for either the creation of a new citizen’s oversight committee to review and report on the revenue and expenditure of funds from the tax adopted by the Council or a continuation of the previously established committee.
B. The City of Sacramento has a higher income inequality than the national average, and larger disparities across race and ethnicity by neighborhood, which negatively affects economic growth and the City’s ability to enhance the quality of life for residents. To address these issues and inequalities in the City, the City must focus its economic and community development investments and planning for long-term and short-term delivery of services to make vibrant, livable neighborhoods that are safe and enable our residents and future generations to have greater economic opportunity and mobility and businesses to thrive.
C. To ensure that the expenditures of City resources reflect Council and community priorities, the Measure U Community Advisory Committee will review, report, and make non-binding recommendations on expenditures of certain funds from the tax.
BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. The City Council hereby establishes the Measure U Community Advisory Committee as described in Exhibit A to this resolution.
Section 2. Resolution 2012-0344 is hereby rescinded.
Section 3. This resolution takes effect only upon voter approval of Measure U on the November 6, 2018 ballot.
