Additional Description/Analysis
Issue Detail: the City has approved the Woodlake Campus development for the proposed hotel as referenced by approved City Planning application DR20-052. As part of these approvals, new drainage easements have been recorded to access and maintain the existing storm drain located at 500 Leisure Lane. A portion of the original 25-foot-wide drainage easement is no longer needed and unless the City vacates it, construction cannot move forward as it would include construction over the existing easement. This request is to vacate (abandon) a portion of the 25-foot wide public drainage easement requires City Council approval.

New easements for drainage have been dedicated and accepted by the City and recorded by documents 20230329 OR 0751 and 20230329 OR 0752 with the Sacramento County Recorder’s Office for the existing on-site storm drain. Both new drainage easement dedications provide the required protection and access to maintain the existing storm drain required for the proposed

required protection and access to maintain the existing storm drain required for the proposed development within the Woodlake Campus. The portion of drainage easement requested for vacation is shown and dedicated on the parcel map of “Sacramento Self Storage”, filed on March 17, 2020 in book 240 of parcel maps, at page 3, Sacramento County records and is not needed or required for public use.

Policy Considerations: The action recommended in this report is consistent with the Sacramento 2035 General Plan and in compliance with the California Streets and Highways Code, Sections 8330-8336, particularly Section 8333(c) in that the easement proposed to be vacated has been superseded by relocation, is an excess easement, and there are no other public facilities located within the easement.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The Community Development Department, Environmental Planning Services Division has reviewed this vacation/abandonment of the public highway easements and determined that this is exempt from the provisions of the California Environmental Quality Act (CEQA) Section 15305, as a Minor Alteration in Land Use Limitation. The project consists of a minor alteration in land use limitations with an average slope of less than 20%, which does not result in any changes in land use or density.

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: As part of the Woodlake Campus development (DR20-052), new drainage easements have been recorded to access and maintain the existing storm drain located at 500 Leisure Lane. A portion of the original 25-foot-wide drainage easement is no longer needed and encumbers the property. The portion of the subject easement requested for vacation partially overlaps the new drainage easements; however, vacation of the subject easement does not affect the new drainage easements dedicated and accepted by the City and recorded by documents 20230329 OR 0751 and 20230329 OR 0752. The boundaries of the new drainage easements shown on Exhibit B of the attached resolution will remain upon recordation of this vacation. There are no conditions associated with this vacation request.

Approval of this vacation request is consistent with the 2035 General Plan land use designation and the permissible densities and intensities of use for the project site. City staff support the vacation request.

Financial Considerations: The estimated cost to complete this vacation is approximately $5,000.

The applicant is responsible for all fees required to process this application at no cost to the City.
