Additional Description/Analysis
Issue Detail: The Department of Utilities (DOU) has established a program to assist City water service customers in disadvantaged area communities with leak detection and repair or replacement of indoor and outdoor leaky fixtures.
City Agreement PRC001248 was effective September 1, 2020, with Toby D. Kunz Plumbing to provide Residential Plumbing services in support of the Leak Free Sacramento Program.
Supplemental No. 4 will increase the not-to-exceed amount of the contract and extend services to August 31, 2023, to allow the City time to conduct a solicitation process and establish a new contract.
Policy Considerations: This supplemental agreement exceeds the City Manager’s approval authority and requires approval by City Council.
File ID: 2023-00071 5/16/2023 Consent Item 6.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): The activity described in this report consisting of approval of an agreement for ongoing residential plumbing services has been determined to not be a project pursuant to the California Environmental Quality Act (CEQA).
CEQA Guidelines Section 15378(b). The activity is a continuing administrative and maintenance activity [CEQA Guidelines section 15378 (b)] and is not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].
Sustainability: The proposed project is consistent with the City’s Sustainability Master Plan goal by enabling DOU to protect sources of water and provide a safe and reliable water supply for the Sacramento region.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: On April 16, 2020, DOU issued Request for Proposals (RFP) P20141381022 for Residential Plumber (Leak Free Sacramento Program). The project received three Proposals that were received and opened on April 30, 2023. The DOU selection panel evaluated the Proposals and determined Toby D. Kunz Plumbing to be the top-ranked firm to provide services.
Supplemental Agreement Nos. 1, 2, & 3 were approved to extend the time of performance and increase the not-to-exceed amount for a total of $199,900. Supplemental No. 4 is to increase the not- to-exceed amount to allow the funding needed to continue services through the end of fiscal year 2023 while staff conducts the solicitation process for a new agreement.
Staff is requesting approval of Supplemental Agreement No. 4 to City Agreement PRC001248 with Toby D. Kunz Plumbing in an amount not-to-exceed $100,000, bringing the agreement’s total not-to- exceed amount to $349,900.
Financial Considerations: Supplemental No. 4 will increase the contract amount by $100,000, for a revised total not-to-exceed amount of $349,900. There is sufficient funding in Project Number I14120417 (Leak Free Sacramento) to fund services through June 30, 2023. Funding for this agreement in future fiscal years will be subject to the availability of sufficient funds in the adopted fiscal year.
There are no impacts to the General Fund for this Agreement.
File ID: 2023-00071 5/16/2023 Consent Item 6.
Local Business Enterprise (LBE): Toby D. Kunz Plumbing is not an LBE. The minimum LBE participation requirement was waived by the Director of Utilities as staff has determined the waiver is in the City’s best interest as a result of lack of local qualified vendor interest.
