1-Description/Analysis
Additional Description/Analysis
Issue Detail: The Sump 87 Diversion & Silver Eagle Road Rehabilitation Project (X14160501) was advertised on March 7, 2023, and four bids were received on April 5, 2023, with the lowest prospective bidder, Mountain Cascade Inc., at $3,699,585. However, an inconsistency in a quantity included in addendum #1 by the City on March 30, 2023, and inaccuracies in submitted bids created ambiguity in the process. Department of Utilities engineers recommend rejecting all bids and rebidding the Sump 87 Diversion & Silver Eagle Road Rehabilitation Project to address these defects and proceed expeditiously with the project.

Rejecting all the bids will allow City staff to refine the project design and materials to re-advertise the project in a more competitive bid environment and allow bidders a fair bidding process.

Policy Considerations: The action requested herein is consistent with City API 4002, Section 8.5(b), which requires that rejection of bids for contracts of $250,000 or more must be approved by the City

Council.

Economic Impacts: None.

Environmental Considerations: This project has been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15301(b) and 15302(c).

The project consists of the operation, repair, and minor alteration of existing public or private facilities used to provide public utility services involving negligible expansion of use [15301(b)]; and the replacement of existing utility systems and facilities involving negligible or no expansion of capacity [15302(c)].

Sustainability: The proposed project is consistent with the 2035 General Plan New Developing Areas 3.1.2 as it improves infrastructure ultimate capacity needs. The Sewer Basin 85 area benefiting from this project’s sewer capacity improvement has been identified by the Planning Department as a primary redevelopment and densification area. Prompted by this designation along with the maintenance issues, a wastewater master plan for Basin 85 was completed in June 2010 by West Yost Associates. Furthermore, this project supports the planned development/redevelop/densification of the area.

Commission/Committee Action: None.

Rationale for Recommendation: Rationale for Recommendation: The inconsistency in a quantity included in Addendum #1 to the bid documents by the City, and the inaccuracies in submitted bids created enough ambiguity in the bid process to warrant rejecting all bids and rebidding the Sump 87 Diversion & Silver Eagle Road Rehabilitation Project.
