Issue Detail: The City was granted federal funds to rehabilitate the corridor and improve the pedestrian and bicycle connectivity along Bell Avenue.

The Bell Avenue Complete Streets Rehabilitation Project has completed a majority of the planned

pavement rehabilitation, streetlighting, pedestrian, and bicycle improvements. The construction phase of the project is nearly complete but has required additional inspection, management, and testing by the consultant management team due to weather delays on the project, and additional pavement work and traffic design changes during construction. The required supplemental agreement for the construction management team will also require an additional fund transfer. City staff recommends the approval of the transfer of $30,000 (Road Maintenance and Rehabilitation, Fund 2036) and approval of Supplemental Agreement No. 1 with UNICO Engineering, Inc. to provide additional construction management services to complete the construction of this project.

Policy Considerations: City Council action is required to approve change orders or supplemental agreements to contracts with a cumulative total that exceed the City Manager’s authority per City Code 3.60.210.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The City of Sacramento Environmental Planning Services has reviewed the proposed project and determined that it is exempt from the provisions of CEQA under the Categorical Exemption for the operation, repair or minor alteration of existing public facilities involving negligible or no expansion of use and for new construction or conversion of small facilities, including street improvements, set forth in CEQA Guidelines Sections 15301(c) and 15303(d)(e) respectively.

National Environment Policy Act (NEPA): The California Department of Transportation (Caltrans) is the lead agency for NEPA, as assigned by the Federal Highway Administration for these federal grant funds. Caltrans senior environmental planning staff reviewed the project and determined a finding of categorical exclusion under 23 CFR 771 activity (c) (3 and 15).

Sustainability: This project advances active modes of transportation by designing a pedestrian- and bicycle-friendly corridor that provides improved accessibility to a wide range of users. A vibrant, multi-modal transportation system reduces vehicle miles traveled, helping the City to achieve reductions of greenhouse gas emissions. Transportation accounts for 57% of community-wide greenhouse gas emissions, the largest single sector in the community. This project implements strategies in the City’s Climate Action Plan to reduce vehicle trips and greenhouse gas emissions.

Commission/Committee Action: None.

Rationale for Recommendation: Supplemental Agreement No. 1 is needed to provide additional consultant support required for an extended construction phase due to weather delays and additional

traffic design changes during construction. The requested funding transfer will provide the funding needed to execute this supplemental agreement and complete construction.

Financial Considerations: The estimated total cost to complete the Bell Avenue Complete Streets Rehabilitation Project (T15145600) is approximately $6.84 million. With the transfer of $30,000 (Road Maintenance and Rehabilitation, Fund 2036) from the 2020 Transportation Corridor Program (R15200000), there will be sufficient funding to execute Supplemental Agreement No 1 to City Agreement No. 2022-0745 with UNICO Engineering, Inc. for a not to exceed amount of $96,973, for total contract not-to-exceed amount to $418,658, and to cover all other remaining project related costs.

There is sufficient funding within the 2020 Transportation Corridor Program (R15200000) to support the transfer of $30,000 to the Bell Avenue Complete Streets Rehabilitation Project (T15145600).

Local Business Enterprise (LBE): The contract with UNICO Engineering, Inc. is a federally funded contract and as a result Disadvantaged Business Enterprise (DBE) project participation requirements apply. LBE rules are held in abeyance. The contract award will comply with all federal DBE participation requirements. UNICO Engineering Services, Inc. has pledged 80.56% DBE project participation, meeting the 12.00% DBE goal set for this contract.
