Additional Description/Analysis
Issue Detail: The City has an existing agreement with Fehr and Peers as an on-call consultant for evaluating the transportation planning and engineering components of development applications and City transportation projects. These studies inform the required transportation mitigations and requirements. The City contracts out all traffic studies; however, these costs are recovered from private applicants or are budgeted as part of capital improvement projects.

Due to the number of private development applications and complexity of work, Fehr and Peers is nearing the original not-to-exceed amount of $800,000 contained in City Agreement No. 2019-0673.

Supplemental Agreement No. 2 will allow the continued utilization of Fehr and Peers to evaluate the impact of development applications and transportation projects and to develop mitigation measures per environmental requirements. City staff is recommending execution of Supplemental Agreement

No. 2 with Fehr and Peers in the amount of $300,000 to support these efforts for the next six months or so until the City can establish a new set of on-call agreements.

Policy Considerations: Outsourcing traffic impact studies helps streamline the review of development applications and provide traffic studies for City projects. In addition, the recommendation in this report is in accordance with policies from the Sacramento 2035 General Plan including:

M 1.1.1 Right-of-Ways - The City shall preserve and manage rights-of-way consistent with: the circulation diagram, the City Street Design Standards, the goal to provide Complete Streets as described in Goal M 4.2, and the modal priorities for each street segment and intersection established in Policy M4.4.1: Roadway Network Development, Street Typology System.

M 1.1.2 Transportation System - The City shall manage the travel system to ensure safe operating conditions.

M 1.1.4 Facilities and Infrastructure - The City shall effectively operate and maintain transportation facilities and infrastructure to preserve the quality of the system.

M 1.2.1 Multimodal Choices - The City shall develop an integrated, multimodal transportation system that improves the attractiveness of walking, bicycling, and riding transit over time to increase travel choices and aid in achieving a more balanced transportation system and reducing air pollution and greenhouse gas emissions.

M 1.3.1 Grid Network - To promote efficient travel for all modes, the City shall require all new residential, commercial, or mixed-use development that proposes or is required to construct or extend streets to develop a transportation network that is well-connected, both internally and to off-site networks preferably with a grid or modified gridform. The City shall require private developments to provide internal complete streets (see Goal M.4.2) that connect to the existing roadway system.

M 2.1.7 Safe Pedestrian Crossings - The City shall improve pedestrian safety at appropriate intersections and mid- block locations by providing safe pedestrian crossings.

M 4.2.6 Identify and Fill Gaps in Complete Streets - The City shall identify streets that can be made “complete” either through a reduction in the number or width of travel lanes or through two-way conversions, with consideration for emergency vehicle operations. The City shall consider including new bikeways, sidewalks, on-street parking, and exclusive transit lanes on these streets by re- arranging and/or re-allocating how the available space within the public right of way issued.

M 4.3.2 Traffic Calming Measures - Consistent with the Roadway Network and Street Typology policies in this General Plan and Goal M 4.3, the City shall use traffic calming measures to reduce vehicle speeds and volumes while also encouraging walking and bicycling.

M 4.4.3 One-way to Two-way Street Conversions - The City shall consider one-way streets for potential conversion into two-way to make them more transit, bicycle, and pedestrian friendly.

M 5.1.5 Motorists, Bicyclists, and Pedestrian Conflicts - The City shall develop safe and convenient bikeways, streets, roadways, and intersections that reduce conflicts between bicyclists and motor vehicles on streets, between bicyclists and pedestrians on multi-use trails and sidewalks, and between all users at intersections.

M 5.1.8 Connections between New Development and Bikeways - The City shall ensure that new commercial and residential development projects construct bikeway facilities identified in the Bicycle Plan that have a direct nexus with the project.

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): Under the CEQA Guidelines, administration of a Services Agreement does not constitute a project and is therefore exempt from review.

Sustainability: Conducting traffic studies provides information that can be used to assess air quality and greenhouse gas emission analysis and helps the City to identify how transportation infrastructure can be improved with streets that also encourages walking and cycling and minimizing impacts to the environment and neighborhoods.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Fehr and Peers is one of three traffic consultants that was selected for a Service Agreement following a Request for Qualifications (RFQ) and evaluation of their qualifications and experience contained in their submitted Statement of Qualifications. The two remaining traffic consultants have adequate contract authority to perform remaining work effort requests. City Agreement No. 2019-0673 was facilitated with Fehr and Peers on June 21, 2019, with an original not-to-exceed amount of $800,000. Since that date, the total amount of the task orders for

this on-call contract are approaching the original not-to-exceed amount. City staff anticipates releasing a new pre-selected RFQ for consultant services in June/July of this year to establish a new MSA list. This process takes several months. Increasing the not-to-exceed amount of the MSA with Fehr and Peers under the existing City Agreement will ensure continued timely and accurate traffic impact analysis of development applications and transportation projects until establishment of the new list.

Financial Considerations: All costs for consultant services will be funded from the individual project applicants for their development proposals or as included in budgets for City projects. The cumulative cost for services with the supplemental agreement for this contract will not exceed $1,100,000.

This is an on-call contract and the consultant may or may not be called by the City to perform any services described in this agreement. No compensation is guaranteed; it is available if needed and if funding is available.

Approval of Supplement No. 2 to the Services Agreement will not result in any additional expense to the City that is not provided through developer fees or budgeted in capital improvement projects.

Sufficient funding is available in the Fiscal Year 2022/23 Department of Public Works Operating Budget and in the 2022-2023 Capital Improvement Program for services through June 30, 2023.

Funding in the next fiscal year is subject to funding availability in the adopted budgets for the applicable fiscal years.

Local Business Enterprise (LBE): Not applicable.
