Location: Citywide
Recommendation: Pass a Motion authorizing the City Manager or the City Manager's designee to execute Supplemental Agreement No. 2 to City Agreement PRC001676 with California Patrol Operations, Inc. to provide armed security services, for an amount not-to-exceed $1.5 million, bringing the agreement’s total not-to-exceed amount to $2.75 million and modify the scope of services to provide DOU with the flexibility to determine the number of patrols per night based on budget and operational needs.

Additional Description/Analysis
Issue Detail: The Department of Utilities (DOU) operates and maintains water, wastewater, and drainage facilities throughout the City of Sacramento. To effectively manage and deter metal theft, vandalism, and other illegal activities at these remote locations, DOU has an ongoing need for armed security services to patrol our facilities.

In addition to these services, DOU also has an ongoing need for standing guard assignments, posting notification of encampments to allow staff to perform maintenance on City flood control systems under the Critical Infrastructure Cleanup procedure, as well as response to building alarms.

The initial award for these services was split between Blue Knight Security Group and California

Patrol Operations. At the end of the first year of service, staff determined it was in the City’s best interest to move forward with only one contractor. The contract with Blue Knight Security was not renewed. This supplemental agreement modifies the scope of services and increases the current contract with California Patrol Operations to fund the remaining period of performance.

Policy Considerations: This supplemental agreement exceeds the City Manager’s approval authority and requires Council approval.

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a two-thirds vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-day review on June 2, 2023, in compliance with the City Code.

Economic Impacts: None
Environmental Considerations: The Community Development Department, Environmental Services Manager has determined that the proposed activity is not a “project” pursuant to Section 15378(b)(2) of the CEQA Guidelines. The proposed armed security services agreement consists of ongoing administrative activities that are not a “project” and are not subject to CEQA (CEQA Guidelines Section 15060(c)(3)).

Sustainability: Armed security patrol for the DOU area facilities supports the goals of the City’s Sustainability Master Plan by enabling DOU to protect sources of water and provide flood protection.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: On August 31, 2021, DOU issued Request for Qualifications (RFQ) Q21141222005 for Armed Security Services. The project was publicly advertised, and fourteen Submittals were received and opened on September 10, 2021. The DOU selection panel evaluated the Proposals and determined California Patrol Operations, Inc., and Blue Knight Security & Patrol to be the top-ranked firms to provide services.

Supplemental Agreement No. 1 was approved to extend the time of performance with no increase to the not-to-exceed amount. Supplemental No. 2 will modify the scope of services and provide additional funding for the remaining time of performance. Additional funding is needed because the Blue Knight contract was not renewed. The service will be provided by this contractor and the level of patrol service in the first 15 months of the contract outpaced the planned budget for the contract.

However, DOU has worked with the contractor to adjust the level of service moving forward and built in flexibility in the scope of services adjust services as needed.

Staff is requesting approval of Supplemental Agreement No. 2 to City Agreement PRC001676 with

California Patrol Operations in an amount not-to-exceed $1.5 million bringing the agreements total not-to-exceed amount to $2.75 million.

Financial Considerations: Supplemental Agreement No. 2 will increase the contract amount by $1.5 million, for a revised total not-to-exceed amount of $2.75 million.

Sufficient funding is available in the DOU FY 2022/23 Security and Emergency Preparedness budget to fund the agreement through June 30, 2023. Funding in fiscal years shall be subject to funding availability.

There are no General Funds allocated or planned for this project.

Local Business Enterprise (LBE): California Patrol Operations, Inc. is an LBE.
