Additional Description/Analysis
Issue Detail: Staff requests that the City Council suspend competitive bidding, in the City’s best interest, to implement an alternative process for the procurement of Large Diameter Pipe Cleaning and Inspection Services. Cleaning and inspection of large diameter wastewater and storm drainage pipes requires a variety of experience and inspection technologies and equipment. Use of the alternative process described in this report will allow the City to select a group of the most qualified contractors to assist Department of Utilities’ staff in maintaining and inspecting wastewater and storm drainage pipe infrastructure in an efficient, cost-effective, and timely manner.
File ID: 2023-00671 6/13/2023 Consent Item 26.
Policy Considerations: City staff is proposing the use of an alternative competitive procedural process for the services required, utilizing a Request for Qualifications (RFQ) process to select a group of the most qualified contractors to perform the work and distribute the work through Master Services Agreements with the selected contractors. To authorize use of such a process, the City Council must suspend the City’s normal competitive bidding requirement that would otherwise require a separate bidding and award process for each portion of the work required to implement and complete the work.
City Code Section 3.56.230(C) allows the City Council to suspend competitive bidding for the purchase of services and supplies upon a two-thirds vote, if the City Council determines that it is in the best interests of the City to do so. City staff believes that it is in the City’s best interests to suspend competitive bidding and use the proposed alternative process because:
· The City’s standard competitive bidding process requires bidding and contract award to a single contractor based on price alone, provided the contractor meets the minimum qualifications specified to perform the work, and the City has no leeway to distinguish between bidders that meet minimal qualifications and more qualified bidders that exceed the minimum qualifications, nor to select contractors based on their specific experience and equipment for each task or project.
· Using the proposed alternative process rather than bidding and awarding contracts based on price alone will allow the City to evaluate and retain a group of the most qualified contractors for performance of the work based on a combination of price and other qualification considerations, including cleaning experience, inspection experience, ability to provide specific equipment or technologies and experience using them, past performance with the City, schedule availability, and other relevant factors.
· Using the proposed process will create a stable, reliable pool of contractors and will expedite the performance of work, as staff is able to assign task order awards based on need and factors related to the individual task or project scope rather than having to provide a separate bidding and award process for each portion of the work required. · Using the proposed process will be cost-effective and provide the best value to the City because it will promote cost and schedule efficiencies and enable the City to coordinate work between cleaning services and inspection services, which can be provided by separate companies or the same company, in a more efficient way. · Using this process will provide a significant ongoing incentive for the selected contractors to maintain high levels of service and responsiveness in order to continue performing work during the term of the contract, as a contractor whose performance under one task order is unsatisfactory would not be considered for successive task orders.

Economic Impacts: None.
Environmental Considerations: This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” as defined by California Environmental Quality Act (CEQA) Guidelines Sections 15378(b)(2) and 15378 (b)(4) and are not subject to the provisions of CEQA [CEQA Guidelines Section 15060(c)(3)].
Sustainability: Not applicable.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: Cleaning and condition assessment of wastewater and storm drainage system pipes is necessary to ensure continuation of services to customers, protect public health and safety, protect the environment, and meet federal, state, and local regulations. DOU has an ongoing need to clean, inspect, and assess the condition of large diameter pipes (36” or larger), force mains, and levee pipes. The use of Master Services Agreements will assist the Department of Utilities in cleaning and inspecting these pipes. Contractors shall be used when the City does not have the proper equipment or staffing to do the work; when specialized work is required; or when City needs assistance in completing its own scheduled workload in a timely manner.
The number of experienced contractors that provide large-diameter pipe cleaning and/or inspection services is extremely limited. Establishing Master Services Agreements gives DOU the flexibility to use Contractors with the appropriate technology for the scope of each task or project, to use Contractors that have the best availability and/or price, as well as the ability to use multiple Contractors at one time to reduce work backlog and maintain schedules.
Financial Considerations: The recommendations in this report do not result in any financial impact to the City. Upon approval of this recommendation, staff will proceed with the RFQ process and return to City Council with recommendations for approval of the qualified contractors and establishment of Master Services Agreements with qualified Contractors.
The project has no impact on the City’s General Fund.
Local Business Enterprise (LBE): The requirement for LBE participation has been waived by the Director of Utilities as there are a limited number of contractors that provide these services, with few to no local contractors.
Background: Wastewater utility industry standards and best management practices for preventative maintenance of utility pipe systems includes periodic cleaning and inspection. The Department of Utilities (DOU) does not have the equipment nor the staff necessary to properly clean and inspect
File ID: 2023-00671 6/13/2023 Consent Item 26.
large-diameter pipe mains. DOU currently has a backlog of large diameter pipes that need cleaning, inspection, or both cleaning and inspection.
Between 2010 and 2020, DOU utilized Contractors with a variety of inspection technologies to clean and evaluate the condition of its large diameter combined wastewater pipes. At the end of the assessments, about 3.5 miles of 36 to 114-inch diameter pipe remained uninspected for various reasons, including high water flows, large amounts of accumulated wastewater debris, and occasional obstructions in the pipe. As a result, staff will use this on-call master services list to provide services to clean and inspect these uninspected combined wastewater pipe segments. In addition, DOU has other large diameter pipes within the separated wastewater and storm drainage systems that need to be inspected, including aging gravity and force mains. Pipes penetrating levees or located near levee toes, many of which are large diameter pipes, are scheduled to be inspected every 5 years to reduce risk of pipe failure and impact on the levees. To reduce or eliminate backlog and to meet scheduled preventative maintenance requirements, the Department of Utilities (DOU) will have an ongoing need for large diameter wastewater and storm drainage pipe cleaning and inspection services.
Proposed Master Services Agreements with the qualified contractors will be brought to City Council for approval. Upon approval of the Master Services Agreements, Task Orders will be issued to assign specific tasks or projects throughout the term of the contract. · Task Orders for individual tasks or larger projects will be developed based on need and may include, but are not limited to, cleaning and/or inspection of large diameter pipe, both gravity and force mains, and pipes in or near levees within both the wastewater and storm drainage systems. Task work for emergency pipe cleaning and inspection, regardless of pipe size, may also be issued at the City’s discretion. It is anticipated that the City will utilize these services on tasks or projects where the budgets are estimated between $15,000 to $500,000. · Task order award will be based on a combination of qualification considerations including cleaning experience, inspection experience, ability to provide specific equipment or technologies and experience using them, past performance with the City schedule availability, and other relevant factors. For each individual task order assignment, staff will assign the work in one of two ways:
o Request a quote for the work from each Master Services Contractor that provides the required areas of expertise and award from quotes received. If selection variables like price and expertise are consistently equal or equitable across multiple Contractor’s quotes, the City intends to rotate the assignment of subsequent task orders, wherever possible, so that no one Contractor is assigned all work. OR o Assign the task order directly to a chosen Master Services Contractor if specific expertise or equipment is required that only one Contractor can provide.

A. INTRODUCTION
1. Purpose
The City of Sacramento, Department of Utilities (hereinafter “City”) is requesting the submittal of Statements of Q ualification (SOQ) from Contractors for the purpose of establishing Master Services Agreements with qualified on -call Contractors to provide cleaning and inspection of large diameter pipes for the separated wastewater, combined wastewater, and/or storm drainage collection systems using a variety of cleaning and inspection technologies . System pipes will include large diameter wastewater and storm drainage pipes (36-inches in diameter and larger), including both gravity and force mains, and small and large diameter pipes in or near a levee. Task work for other pipe cleaning and inspection , regardless of pipe size, may be issued at the City’s discretion.
Using the selection process discussed herein, the City anticipates entering into Master Services Agreements with multiple Contractors deemed to be the most qualified under this RFQ. Entering into a Master Services Agreement with the City does not guarantee that any task and/or project assignment will be made . The assignment process is discussed further in the scope of services below.
Interested contractors are invited to submit their qualification statements in ac cordance with the requirements of this Request for Qualifications (RFQ). Contractors may submit information in the SOQ for one or both of the areas of expertise. Contractors must have knowledge and experience in at least one area of expertise to be considered for qualification.
Qualification statements (SOQs) shall be considered complete only if all the items listed in Section B of this RFQ are included in the submittal. Firms that do not submit a proposal by the closing date and time will n ot be considered . The term “Contractor(s)” is used interchangeably to mean any person or persons, firm, partnership, corporation, company, or combination thereof, that proposes to perform work for the City or enters into an agreement with the City.
2. Background
City Collection Systems
The City maintains wastewater collection systems for about 65 percent of the geographical area of the City, which includes a combined wastewater system in the older, central areas of the City and a separated sewer system in the remaining areas. The balance of the City residents and businesses is served by the Sacramento Area Sewer District (SASD). The City maintains a service area for both wastewater and combined wastewater systems of about 40,480 acres with about 827 miles of 4 - to 120 -inch diameter collector, trunk interceptor and force main pipe; 19,670 manholes; 42 individual pump stations; and two off-line storage/primary treatment facilities.
The City’s storm drainage collection system comprises of 54,800 acres and approximately 854 miles of 8 -inch to 114 -inch diameter of collector, trunk interceptor and force main pipe; manholes and individual pump stations; 21000 manholes; 107 individual pump stations.
Past & Recent Pipe Cleaning & Inspection Efforts
Between 2010 and 2017, the City utilized a variety of inspection technologies to evaluate the condition of its large diameter combined wastewater pipes. At the end of the assessments, almost four miles of 36 - to 114-inch diameter gravity pipe and about one mile of 60 - to 84 -inch diameter force main w ere not inspected due to the amount of accumulated wastewater debris and occasional obstructions.
In 2020, the City cleaned and inspected approximately one mile of the remaining 36- to 72-inch diameter gravity pipe.
Large Diameter Pipe Cleaning & Inspection Needs
Through this request for qualificati ons, the City is seeking qualification statements to conduct cleaning and debris off -haul to a City owned waste collection site and perform condition assessments (inspect ions) of both wastewater and storm dra in system pipe.
The work will be divided into various task orders to offer the City the flexibility to tailor the work in smaller segments based on varying criteria such as budget, pipe diameter size, geographic location, priority, etc. until all pipe segm ents are inspected, or funding is exhausted.
The overall task order work could entail the cleaning and inspecting of the remaining 3- miles of separated and combination sewer pipes described above, some of which falls into the force main, or levee penetration categories noted below , as well as gravity and force main pipes located in or near levees and select large diameter drainage pipes. The debris removed will be delivered to the City’s waste collection site identified in task orders.
The wastewater pipes to be cleaned and inspected consist mostly of cast -in-place and reinforced concrete pipe constructed between 20 to 115 years ago. About 2,100 -feet of the 60- and 72-inch diameter pipe consists of fiberglass reinforced pipe constructed about 10 to 18 years ago. The work also includes about 250 -feet of cured-in-place lined pipe and about 225-feet of steel pipe. None of the pipe is known to have been cleaned since original construction.
The wastewater pipe segments vary in length from as little as 50-feet to about 1,000-feet between manholes or access points. Pipe segments will mostly be gravity type with some
force main pipe segments. Manhole will mostly be 36-inch diameter (typical) frames and covers. It’s likely that some of the manhole frames and covers are 24-inches in diameter, while others may be as large as 48-inches in diameter.
Force Mains
The f orce main pipe segment is estimated to be 1,100-feet in length between sealed access points and only convey s flow during wet weather periods. The access points range from manholes with bolted -down covers that can be removed manually, to an access port in a surge tower, to concrete vaults with la rge rectangular shaped concrete lids that require cranes to remove. Standing water may be located in low points or sags along the alignments.
Levee Penetrations
Levee penetration pipes can either directly penetrate through the profile of a levee or exist parallel to the levee at the toe of the levee slope. Pipes to be inspected total approximately 12,859 linear feet with 2,896 linear feet ranging from 36” to 120” in diameter and 9,963 linear feet ranging from 2” to 24” in diameter. Levee penetrations are mostly gravity with some force main pipe segments. Pipe segments, including some force mains, that penetrate levees are currently scheduled to be inspected every 5 years. Access and processes may require alternative methodology and equipment due to fluctuating river water levels a nd daily tides. For example, o ne 78 -inch diameter force main segment outfalls to the Sacramento River where the outfall is submerged by daily tides and involves man entry to inspect.
3. Scope of Services

MASTER SERVICES AGREEMENT FOR
LARGE DIAMETER PIPE
CLEANING AND INSPECTION SERVICES
SCOPE OF SERVICES
Based on the evaluation of responses to RFQ #Q2314131100X, Contractor has qualified to provide services in the following areas of expertise (section below will be revised for each Master Services Agreement based on expertise qualifications met by each Contractor):
Area of Expertise #1: Cleaning wastewater or storm drainage system pipe, including the removal of debris from the wastewater or storm drainage pipes and off hauling the debris to a specified City owned waste collection facility. Contractors will not be responsible for transporting debris from the City owned waste collection fac ility to the landfill.
Area of Expertise #2: Evaluating the condition of wastewater or storm drainage system pipes, using a variety of inspection technologies, and documenting the condition found.
Entering into this Master Service Agreement with the City does not guarantee that any task and/or project assignment will be made using task orders.
Having Master Services Agreements does not preclude the City from publicly advertising any task or project for bids, nor does being a Master Services Contractor preclude those Contractors from submitting bids/quotes for any publicly advertised task or project.
1. Task Order Award
City will divide work into various task orders on an as needed basis. Using various task orders offers the City the flexibility to tailor the work in smaller segments based on varying criteria such as budget, pipe diameter size, location, workload need, or priority until all pipe segments are completed or funding is exhausted.
Each task order may include cleaning, debris off -haul to a City owned waste collection site, inspection and condition assessment, or any combination thereof, as determined by the scope of each task order. In addition to the requirements listed herein, Contractor shall follow all requirements listed within an individual task order. If any requirements, terms, or conditions outlined in a task order differ from those in the Master Servic es Agreement, the requirements, terms, and conditions documented in th e task order shall prevail.
1. The City reserves the right to consider more than just price when making assignments; to assign any task order to any one MSA Contractor or to multiple MSA Contractors; or to perform some of the work using City crews if staff believes to do so is in the best interest of the City and/or the project.
Task Order award will be based on a combination of qualification considerations, including cleaning experience, inspection experience, ability to provide specific ATTACHMENT 1 TO EXHIBIT A
2 equipment or technologies and experience using t hem, past performance with the City, schedule availability, and other relevant factors .
2. For each individual task order assignment, staff will assign the work in one of two ways:
a. Request a quote for the work from each Master Services Contractor that provides the required areas of expertise and award from quotes received. If selection variables like price and expertise are consistently equal or equitable across multiple Contractor's quotes, the City intends to rotate the assignment of subsequent task orders, wherever possible, so that no one Contractor is assigned all work.
OR
b. Assign the task order directly to a chosen Master Services Contractor if specific
expertise or equipment is required that only one Contractor can provide.
3. If a quote is requeste d for a task order assignment, the quote request will be sent via email concurrently to all Master Services Contractors qualified for the areas of expertise required by the task order, and will provide information such as plans, sketches, an notated photos, descriptive text and/or comparable information that is considered sufficient to describe the task order assignment, including how measurement and payment will be handled. Contractor(s) shall be responsible for examining project areas, existing system maps, pipe main data, drawings, and all other available documents to sufficiently determine its ability to perform the work herein.
4. Task order quote responses from Contractors that are interested in performing the work, unless otherwise indicated, will be due at the date and time indicated (typically within five (5) to ten (10) working days from when the task order information was first emailed) and submitted in the man ner indicated in the task order.
5. The submission of a quote to the City shall conclude that the Contractor has investigated and is satisfied as to the condition s to be encountered, the character, quantity, and scope of work to be performed, and is prepared to meet the requirements of
the Task Order.
6. Upon completion of the analysis of task order quote responses, the City shall notify all responsive Master Services Agreement Contractors of selection by email.
7. Selected Contractor shall coordinate its operation s with the City. After assignment of task order and prior to commencement of work, the City will schedule a kick-off meeting at a date, time, and location arranged with the Contractor to review and discu ss the schedule and sequence of the Contractors operation. No work shall be performed unless the City has received the schedule and the City has provided authorization to proceed.
8. Work performed thereunder shall comply with the requirements of Chapter 3.60 of the Sacramento City Code. No bid security will be req uired to accompan y an y quote request, but each assignment shall have an allotted duration for completion time, with provisions to apply liquidated damages of $200 per day in the event work is not completed on time. Every quote shall include the current California Department of Industrial Relation s (DIR) registration number of the Contractor and an y participating Subcontractor. The City reserves the right to reject quotes or to waive an y error or omission in an y quote received.
9. Payment and performance bonds are not required with completion of the Agreement.
When a Contractor is selected for a task order assignment, an y required payment or performance bond for the task order shall be submitted within five days of the award ATTACHMENT 1 TO EXHIBIT A
