Additional Description/Analysis
Issue Detail: On September 14, 2021, City Council adopted the Mayor’s proposed ARPA Framework and Funding Priorities and directed the City Manager, City Attorney, City Auditor, City Treasurer, and City Clerk to implement City Council direction consistent with the adopted ARPA Framework. The ARPA Framework prioritizes $20 million for supporting City employees and addressing organizational needs.

On October 19, 2021, City Council adopted Resolution No. 2021-0313, which authorized the City

Manager or City Manager’s designee to accept $112.2 million of ARPA funding; establish the ARPA Reinvestment Fund (Fund 1003); and allocate $112.2 of ARPA funds to provide government services and budget the resulting available resources in the ARPA Reinvestment Fund to assist with the recovery and reopening resulting from the impacts of COVID-19.

On October 13, 2021, the City published Request for Proposals (RFP) number P22021011003 to competitively select a consultant team to aid the City’s compliance with federal requirements and assist with the administration of its ARPA funds. Following a review process and evaluation of proposals submitted, the City identified Crowe LLP (Crowe) as the highest scoring proposer.

On April 19, 2022, City Council adopted Resolution No. 2022-0102 to authorize entering into Professional Services Agreement with Crowe LLP. To date, Crowe has provided the City ongoing compliance monitoring of the City’s ARPA programs and projects, as well as training and technical assistance to City staff and ARPA grantees. In December 2022, the City released its ARPA Community Investment Dashboard, which was developed in coordination with Crowe to provide fiscal and project status information on the City’s community ARPA investments and may be accessed at:
https://www.cityofsacramento.org/ARP.

The proposed supplemental agreement will enable Crowe to utilize its expertise and experience to continue supporting tracking, monitoring, reporting and overall administration of ARPA funds. In addition, Crowe will continue to support updates to the ARPA Community Investment Dashboard and expand the City’s public communications through the development of ARPA performance and racial equity dashboards and associated project-level reports for the City's four external-facing priorities: 1) Small Business and Commercial Corridor Revitalization, 2) Homelessness and Housing, 3) Youth, Workforce Training, and Gang Prevention, and 4) Arts and the Creative Economy.

Policy Considerations: The use of ARPA Reinvestment funds to provide additional capacity to the City’s administration of ARPA programs is consistent with Council direction provided by Resolution No. 2021-0313 and consistent with City Council’s adopted ARPA Framework and Funding Priorities.

On April 19, 2022, City Council adopted Resolution No. 2022-0102 to authorize the City Manager to execute a Professional Services Agreement (PRC001810) with Crowe LLP in an amount not to exceed $530,490. This supplemental agreement extends the term of PRC001810 and provides additional resources to help expand the City’s public communications. On May 2, 2023, Council approved Resolution No. 2023-0104 authorizing the City Manager to reallocate unexpended funding (including accrued interest) between ARPA projects in the ARPA Reinvestment Fund (Fund 1003) in alignment with the ARPA Framework and Funding Priorities approved by the City Council. The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements, and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-review on June 8, 2023, in compliance with the City Code.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” as defined by the CEQA Guidelines Sections 15378(b)(2) and 15378(b)(4) and are not subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).

Sustainability: None.

Commission/Committee Action: At its April 11, 2023 meeting, the Racial Equity Committee received an update from Crowe LLP on its progress-to-date in assisting City staff and grantees, as well as a presentation on the ARPA Community Investment Dashboard.

Rationale for Recommendation: This supplemental agreement will provide additional resources to ensure that Crowe can continue to provide support services to project managers and technical assistance to the City with the implementation of ARPA programs, data collection and reporting requirements through the closeout of these programs and projects. In addition, the Racial Equity Committee expressed support for Crowe’s continued development of new dashboards that communicate the performance and racial equity outcomes of ARPA funded projects.

Financial Considerations: Sufficient funding is available in the ARPA Grant Liaison Consulting Project (I02612060) to execute Supplemental Agreement No. 2 to City Agreement PRC001810 in the amount of $507,205.

Local Business Enterprise (LBE): None.
