Contract Supplement: Chemicals and Fertilizers for Parks and Open Spaces File ID: 2023-00750
Location: Citywide
Recommendation: Pass a Motion authorizing the City Manager, or the City Manager’s designee to execute a contract supplement with Rentokil North America, Inc., dba Target Specialty Products to increase the not-to-exceed amount to $750,000, provided that sufficient funds are available in the budget adopted for the applicable fiscal year.

Contact: Gary O’Neill, Contracts and Compliance Specialist, 916-808-7432, [email protected]; Dayana Reyes Zanaska, Procurement Manager, 916-808-5524, [email protected], Finance Department.

Description/Analysis
Issue Detail: The City has an ongoing requirement for the purchase of chemicals, such as herbicides and fertilizers, for multiple City departments. The City issued B19061511006 on November 5, 2018, with a closing date of November 14, 2018. Two bids were received; one was deemed non- responsive. Contract No. 2018-1758 was awarded to Target Specialty Products for $500,000. The contract expires on December 31, 2024. Inflation has driven up the cost of the chemicals in recent years. The amount spent will soon exceed the not-to-exceed amount of the contract.

Policy Considerations: The recommendation is consistent with Sacramento City Code Contracts for Goods and Supplies requirements (SCC section 3.56), and Procurement Policy No. AP-4101.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” as defined by the CEQA Guidelines Sections 15378(b)(2) and 15378(b)(4) and are not subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).

Sustainability: The recommendations in this report are in accordance with the Sustainability Purchasing Policy (AP 4003).

Commission/Committee Action: None
Rationale for Recommendation: Executing a contract supplement increasing the not-to-exceed amount of the contract will allow City departments to continue to make purchases through the expiration of the contract.

Financial Considerations: Funding for these purchases will be provided by the operating budgets or capital improvement project budgets of the using departments. Sufficient funding for purchases made through June 30, 2023, is available in the FY2022/23 budget. Funding for subsequent years is subject to Council approval.

Local Business Enterprise (LBE): The contractor is not an LBE.
