Description/Analysis
Issue Detail: Staff recommends Council approve Supplemental Agreement No. 1 with LWA for the CSS monitoring services and regulatory support for FY2023/24, which will include reporting activities through January 2025.
The City of Sacramento (City) owns and operates the CSS, which serves the older portion of Downtown Sacramento. The CSS is regulated under a National Pollutant Discharge Elimination System (NPDES) permit (CSS Permit) (Permit No. CA0079111, Order No. R5-2020-0039) issued by the Central Valley Regional Water Quality Control Board. The goals of the CSS Permit are to protect the water quality of the Sacramento River from CSS discharges, to reduce Combined Sewer Overflows into the Sacramento River, and to reduce flooding and outflows within the area of the City served by the CSS. The CSS Permit specifies required maintenance and operational requirements, effluent limits, sampling requirements, record keeping and regulatory reporting.

To meet the requirements of the CSS Permit, services provided by the proposed supplemental agreement include sample collection, laboratory analysis, regulatory reporting, evaluation and optimization of CSS performance, and provision of regulatory expertise. Services also include support of the sanitary sewer system for evaluating sanitary sewer overflows or other sanitary sewer field support, including sampling collection and analysis.
Policy Considerations: The proposed supplemental agreement exceeds the City Manager’s approval authority, requiring Council approval. City Council approval is required for supplements to professional service agreements of $250,000 or more that exceed certain thresholds per City Code
3.64.040.
Economic Impacts: None.
Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and does not constitute a “project” as defined by California Environmental Quality Act (CEQA) [CEQA Guidelines Sections 15378(b)(2 and 5)] and is not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].
Sustainability: The proposed project is consistent with the 2035 General Plan as it supports rehabilitation of the CSS, to provide adequate wastewater collection, treatment, and disposal in the City and to maintain the systems and facilities to promote and sustain a positive economic climate.
Implementation of the NPDES permit requirements ensures that the CSS is operated and maintained in a way that protects the designated uses of the Sacramento River. Additionally, local watersheds and water bodies, including creeks, and the Sacramento and American Rivers and shorelines are protected through compliance with the NPDES permit (2035 General Plan Goal ER1.1).
Commission/Committee Action: Not applicable.
Rationale for Recommendation: On April 2022, a Request for Qualifications (RFQ) was advertised and issued on PlanetBids for CSS regulatory compliance support. The RFQ (Q #22141311007) included monitoring and combined sewer system regulatory support services to be performed over a period of up to three years, including FY2022/23, FY2023/24 and FY2024/25. LWA was selected to provide the requested services based on their knowledge, expertise, and experience.
The original agreement was approved by City Council on August 30, 2022, for FY2022/23, with the option to renew the contract for two additional one-year terms. This request is to authorize the extension of the contract and provide funding for FY2023/24. Approval of this supplemental agreement for the second-year term is recommended to continue professional services needed to comply with the requirements in the NPDES CSS Permit.
Financial Considerations: The initial term of the contract for FY2022/23 was a not-to-exceed

amount of $538,610. The proposed Supplemental Agreement No. 1, in the amount of $565,148, would increase the agreement’s not-to-exceed amount to $1,103,758.
As shown in the table below, there are sufficient funds available in MYOP I14120600 (CSS Regulatory Compliance Support) and MYOP I14620100 (Sanitary Sewer Management Plan Engineering/Regulatory Support) to approve the supplemental agreement for FY2023/24. The funding for MYOP I14120600 is split 50% from the Wastewater Fund (6006) and 50% from the Storm Drainage Fund (6011). Charges for FY2023/24 will be as follows:

Local Business Enterprise (LBE): LWA is not an LBE, but has partnered with an LBE, Stantec Consulting Services, Inc. (Stantec), for this contract to exceed the minimum LBE participation requirement. Stantec will provide monitoring support and analysis of CSS performance services.
