Description/Analysis
Issue Detail: The Del Rio Trail Project (“Project’) is in the City of Sacramento along a five ‐
mile
abandoned railway corridor to the west of Freeport Boulevard from approximately Sutterville Road to the north and Pocket Road to the south. The Project will result in a multi-use bike trail and will include constructing two modifying bridges, providing intersection improvements at nine intersections, and planting over 700 trees.
Phase 2 of the Del Rio Trail public art includes two “Gathering Space” public art installations. Artists for these projects were selected through a national call to artists and selected for the commissions from over 120 applicants during a diverse and rigorous selection panel review conducted between December 2022 and January 2023 and presented to the Sacramento Arts, Culture, and Creative

Economy (SACCE) Commission on February 13, 2023.
The two selected Gathering Space artists (Janet Zweig LLC and Social Space LLC) presented proposals to individual stakeholder groups and City staff on July 18, 2023. They also publicly presented their conceptual proposals for comments and questions to all project stakeholders on July 27, 2023. The City now wishes to contract with both artists to further develop their designs, fabricate, and install the proposed artwork.
Included with this staff report are the following:
· Janet Zweig LLC, Purchase of Artwork contract with proposal · Social Space LLC, Purchase of Artwork contract with proposal Policy Considerations: Section 3.04.020 of the Sacramento City Code requires City Council approval for agreements greater than $250,000 for the purchase, design, and fabrication of artwork.
Economic Impacts: Public art will be a significant feature of the Del Rio Trail that will help make it a destination, attracting tourists and others who will spend resources at businesses around the trail.
Environmental Considerations:
California Environmental Quality Act (CEQA): While the selection of artists and the creative placemaking recommended in this report are administrative activities which have no significant impact to the environment, the City approved an Environmental Impact Report for the Del Rio Trail Project in compliance with CEQA on March 26, 2019.
National Environmental Policy Act (NEPA): The California Department of Transportation is the lead agency for NEPA on the Del Rio Trail Project. They approved a Categorical Exclusion in compliance with NEPA on October 25, 2019.
Sustainability: Not applicable.
Commission/Committee Action: On August 14, 2023, at the regularly scheduled SACCE Commission meeting, the SACCE Commission passed a motion forwarding the agreements to Council for review and approval.
Rationale for Recommendation: The Del Rio Trial Panel for Phase 2 met on January 25, 2023 and recommended two artists for the Gathering Space projects. The two selected Gathering Space artists developed proposals based on stakeholder conversations, artist visits and research of the site locations, and their own creative exploration of the Del Rio Bike Trail project and surroundings.
During their presentations in July 2023, multiple stakeholders responded favorably to the artists’ proposals and found connections and interest in the artists’ vision for the Gathering Space projects.

The Office of Arts and Culture (OAC) finds both artists’ proposals to be responsive to the locations for the artwork and will provide new areas of beauty and wonder along the Del Rio Trail. OAC is recommending City Council approve the Purchase of Artwork agreements with the two selected Phase 2 Gathering Space artists.
Financial Considerations: Sufficient funding is available (Other Capital Grants, Fund 3704) in the Del Rio Trail Project (K15165100) to execute the two purchase of artwork agreements in the amount of $710,000. This project will be funded entirely through a Caltrans Clean California grant. There are no General Funds planned or allocated to this project.
Local Business Enterprise (LBE): Not applicable.
