The Two Rivers Trail, when completed, will provide a link for a regional bike trail network between the Jedediah Smith Trail on the north side of the Parkway, the Sacramento River Parkway, the Sacramento Northern Bikeway Trail, the future Ueda Parkway trails, and the 20th Street bike connection to the Central City.

The City received $3,333,000 from the 2017 State Active Transportation Program for construction of the Two Rivers Trail Project Phase II. On December 8, 2022, the California Transportation Commission (CTC) approved the allocation of $3,333,000 for construction of the Project. This action will award professional services agreement for construction management and public outreach during the project with Salaber Associates and authorize Westervelt Ecological Services, LLC to purchase required mitigation credits.

The City has completed environmental review and design for the Project. As part of the environmental permitting process under the Endangered Species Act (ESA), the City was required to purchase 212 Valley Longhorn Elderberry Beetle (VELB) mitigation credits from United States Fish and Wildlife Service (USFWS)-approved mitigation banks. Due to limited availability of mitigation credits for purchase, the City recently reopened the consultation with USFWS to request modification of the terms of the credit purchase. A revised Biological Opinion (BO) was received from USFWS on August 1, 2023. The terms of revised BO reduced the required City purchase to 147.46 credits. The City purchased 66.18 available mitigation credits on March 28, 2023. The City must purchase 81.28 additional credits to be in compliance with the revised BO.

The removal of one City-owned tree is needed to accommodate the construction of an Americans with Disabilities Act (ADA) compliant ramp in Glenn Hall Park accessing the Two Rivers Trail.

Policy Considerations: The Project is consistent with the City General Plan goals and key policies of promoting safety and enhancing livability, sustainability, and economic vitality. The project promotes the development of a connected network (General Plan ERC 2.1.2), connections to other trails (General Plan ERC 2.4.3), providing multi-modal choices (General Plan M 1.2.1), and providing a continuous bikeway network (General Plan M 5.1.3). The project is consistent with the Mobility Element to create a well-connected transportation network through integration of recreation and community facilities with other public spaces. The project is a near-term goal for the bikeway implementation plan.

Sacramento City Code Section 12.56.040 requires City Council approval for the removal of City trees for capital improvement projects.

Economic Impacts: None
Environmental Considerations:

California Environmental Quality Act (CEQA): The City approved an Environmental

California Environmental Quality Act (CEQA): The City approved an Environmental Impact Report for the Two Rivers Trail Phase II Project on February 4, 2020.

National Environment Policy Act (NEPA): Caltrans is the lead agency for NEPA on this project and approved a Categorical Exclusion in compliance with NEPA on August 29, 2022.

Sustainability: The Project advances active modes of transportation by designing a Class I multi- use trail that provides improved accessibility to a wide range of users. A vibrant, multi-modal transportation system reduces vehicle miles traveled, helping the City to achieve reductions of greenhouse gas emissions. Transportation accounts for 57% of community-wide greenhouse gas emissions, the largest single sector in the community. This project implements strategies in the City’s Climate Action Plan to reduce vehicle trips and greenhouse gas emissions.

Commission/Committee Action: The Project was presented at the Active Transportation Commission on January 17, 2019, and April 21, 2022. Recommendations, including concerns about overall paved width of the trail and the trail connection at Glenn Hall Park were taken under advisement in the final design.

Rationale for Recommendation: The Project will achieve the following objectives:
· Provide a vital link between the Jedediah Smith Trail on the north side of the Parkway, the Sacramento River Parkway, the Sacramento Northern Bikeway Trail, the future Ueda Parkway trails, and the 20th Street bike connection to the Central City; · Provide alternative transportation access for commuters and residents in the eastern part of the City, Sacramento State University, Central City, North Sacramento, East Sacramento, and Richards Boulevard area;
· Provide opportunities for educating trail users through interpretive signage, establishing a connection to the river, and the Parkway;
· Provide an acceptable project to all authoritative agencies; · Complete the project in a manner that minimizes environmental impacts, given the proposed project’s location within the environmentally sensitive Parkway; and · Design trail access points to comply with state and federal accessibility requirements.

The removal of one City-owned tree is needed to accommodate the construction of an Americans with Disabilities Act (ADA) compliant ramp in Glenn Hall Park accessing the Two Rivers Trail. Please note that an additional eight trees within the bounds of the American River Parkway will also be removed. However, since the Parkway is managed by Sacramento County Parks, the City tree ordinance does not apply to these trees.

A Request for Proposals (RFP) for construction management services was advertised on October 18, 2022. Three firms responded to the RFP and a selection panel comprised of staff from the Department of Public Works and Department of Utilities reviewed the proposals and shortlisted three

Department of Public Works and Department of Utilities reviewed the proposals and shortlisted three consultant teams to interview. From the shortlist, Salaber Associates Inc. was selected as the top ranked team. Staff recommends that a Professional Services Agreement be executed with Salaber Associates Inc. for an amount not to exceed $448,186. This agreement will include construction management, inspection, materials testing, and public outreach services.

Westervelt Ecological Services, LLC has been authorized by USFWS to begin accepting reservations for mitigation credits. Due to the large demand for these reservations, staff recommends entering into an agreement with Westervelt Ecological Services, LLC to reserve the remaining VELB mitigation credits needed to meet the permitting requirements for construction.

Financial Considerations: The total estimated costs of the Project including completing the environmental mitigation, construction, and construction support is approximately $7.1 million. With the approval of $3,333,000 (Other Capital Grants, Fund 3704) and the transfer of $810,000 (Transportation Development Impact Fee, Fund 3215) from the available fund balance, there is sufficient funding to execute the agreement for reservation of conservation credits with Westervelt Ecological Services, LLC, for an amount not-to-exceed $365,760; execute the Professional Services Agreement for construction management, inspection, materials testing, and public outreach services with Salaber Associates, Inc. for an amount not-to-exceed $448,186; and complete all remaining tasks for the construction of the Project. City staff will be returning to City Council for approval of the award of the construction contract in the next few months.

Local Business Enterprise (LBE): The consultant, Salaber Associates, Inc. is a LBE.

SUBJECT: RECOMMENDATION FOR CITY TREE REMOVAL- TWO RIVERS TRAIL

PROJECT PHASE II
____________________________________________________________________________

The Department of Youth, Parks, and Community Enrichment intends to remove one (1) City tree with a diameter of 8 inches at Glen Hall Park. The tree requires removal to accommodate the construction of an ADA accessible ramp from Glen Hall Park to the Two Rivers Trail. The tree proposed for removal is one Sawtooth Oak (Quercus acutissima), City asset TREE-84999.

The tree will be replaced with one (1) 15-gallon sized tree planted on-site to the satisfaction of the Parks Maintenance Manager. The project shall also contribute a total of $2,275.00 to the Tree Planting and Replacement Fund.

I have reviewed the project and find the following:

1. The tree proposed for removal (TREE-84999) meets the definition of a City tree by virtue of being located within the boundaries of an existing City park.

2. The tree proposed for removal is clearly identified on all current plans and documents that will be reviewed by the City Council.

3. The proposed tree removal work requires council approval to be in compliance with City Ordinance No. 2016-0026; regarding SCC 12.56.040.

4. The tree proposed for removal will be replaced with one (1) 15-gallon sized tree as well as $2,275.00 paid to the Tree Planting and Replacement Fund.

5. The proposed tree removal is required to accommodate the construction of an ADA accessible ramp from Glen Hall Park to the Two Rivers Trail.

6. Public notice of the tree removal will be given in accordance with SCC 12.56.040.

Based on these findings, I agree with the staff justification to remove and replace the proposed tree. Staff may proceed to place a Council Report on the City Council Agenda, containing the recommendation of the City Arborist, acting as designee of the Director of Public Works, to approve the removal of one (1) tree in Glen Hall Park as part of the Two Rivers Trail Project Phase II, in accordance with City Ordinance 2016-0026 regarding SCC 12.56.040.

SUBJECT: JUSTIFICATION FOR CITY TREE REMOVAL – TWO RIVERS

TRAIL PROJECT

Purpose of Memorandum

The purpose of this memorandum is to provide justification to the Director of Public Works or his Designee for the removal of one (1) City trees as part of the Two Rivers Trail Project. This tree is located within Glenn Hall Park. Additional trees long the riparian zone adjacent to the American River between H St and Sutter’s Landing will also be removed. These trees are managed by the County of Sacramento and the State of California. Their removal is addressed in the project Environmental Impact Report and does not require approval by the City Council. Subsequent approval of this justification shall be documented in a request to City Council for authorization to remove the one (1) City trees in compliance with Section 12.56.040 of the City tree ordinance, Ordinance No. 2016-0026, adopted on August 4, 2016.

Background

The Two Rivers Trail Phase II project will provide a 2.4-mile long multi-use path between Sutter's Landing Park and H Street, by Sacramento State. The trail will provide residents of River Park and East Sacramento a safe, convenient, and protected path into downtown Sacramento. The overall vision is to eventually have the trail connect to the Sacramento River Parkway and create a continuous trail system along both sides of the Sacramento and American Rivers. In addition, the project will environmentally clear the next phase of the trail between Sutter's Landing Park and the Sacramento Northern Bike Trail. Pursuant to City Code Chapter 12.56 City Council approval is needed to remove the trees for construction of the Project.

Replacement Plan

Sacramento City Code 12.56.040 requires City Council approval and public notice of the removal of City trees for public projects. The City strives to replant trees at a rate of one inch for every inch removed. This project proposes to remove a total of eight (8) inches of City trees and proposes to pay in-lieu fees to the City’s Tree Planting and Replacement fund. In addition, Public Works will work with the Parks department to determine a location within Glenn Hall Park where a replacement tree can be planted.

Justification

The removal of City trees in Glenn Hall park is required to accommodate the construction of an ADA accessible ramp from Glenn Hall Park to the Two Rivers Trail.

Please approve the removal of the subject trees as proposed.
