Issue Detail: The Department of Youth, Parks, & Community Enrichment (YPCE) is seeking approval for a sole brand equipment purchase with Water Odyssey by Fountain People (Water Odyssey) for the Mama Marks Park Splash Pad Project.
The Mama Marks Park Splash Pad Project consists of the replacement of the existing wading pool with a new splash pad. The existing wading pool has not been operational for a few years due to equipment failure.
The Mama Marks Park Splash Pad Project is funded through a Sacramento Housing and

Redevelopment Agency (SHRA) Individual Project Agreement (IPA). The sole brand purchase of this splash pad equipment is in the City’s best interest based on the need to standardize equipment across City parks and based on past performance, ease of maintenance and availability of replacements. This purchase by the City will also expedite the lead time and reduce 15% contractor mark-ups on equipment costs to keep the project on schedule and budget.
The construction contract for the installation of splash pad and equipment will be publicly bid in the fall of 2023. This splash pad project is anticipated to start construction by the end of 2023 and will be opened to the public prior to the opening of pool season 2024.
Mama Marks Park is a 4.22-acre community park located at 1140 Roanoke Avenue in Council District
2. Policy Considerations: Section 3.60.170 (D) of the City Code allows the City Council to authorize exception to competitive bidding when, by a two-thirds vote, the City Council finds that it is in the best interest of the City to suspend competitive bidding. Section 2.2(a)(2) of the City’s administrative policies related to the procurement of supplies (AP 4001) provides that the suspension of competitive bidding can be recommended for various reasons, including utilization of a sole source/sole brand procurement method.

use. City staff selected this vendor for the Mama Marks Park splash pad based on past performance, ease of maintenance and availability of replacements parts. Staff recommend purchasing the equipment in advance of bidding the construction project to expedite the lead times and reduce the additional equipment mark-up of a third-party contractor. City purchasing the equipment directly will allow the project to stay on budget and schedule.
Financial Considerations: There is sufficient funding available in the Mama Marks Park (L19196200) to award the $266,752.92 equipment purchase to Water Odyssey.
Mama Marks Park is an existing park; the annual maintenance and utilities costs are covered in YPCE’s operating budget for maintenance, water, and utility costs for the budget adopted in the applicable fiscal year.
