Additional Description/Analysis
Issue Detail: The City’s Capitol Garage, located at 1126 11th Street, contains nearly one thousand parking spaces and serves parking needs for destinations in the Central City, including the California State Capitol and the Golden 1 Center. As an older facility, this project is needed to improve the safety of the existing stairwells and bring them into current code compliance. To maintain parking operations during the project, construction was planned in a phased approach which resulted in closing a single stairwell at a time. While allowing the garage to remain open, this strategy presented some ongoing logistical challenges and delays.

Design and construction coordination challenges, plus challenges of unforeseen conditions, have lengthened the project delivery schedule, creating significant additional project management and general conditions expenditures not originally anticipated in the project budget. A total of 254

calendar days have been added to the original project delivery schedule.

Change Order No. 1 was necessary to address added scope to comply with the Building Code and to address additional scope due to unforeseen conditions. Change Order No. 2 is necessary to address added phasing, which allowed continued operations during construction, and additional scope due to unforeseen conditions.

Policy Considerations: The recommendation in this report is in accordance with City Code Section

3.60.210, A.2, that requires City Council approval of any change orders that cumulatively exceed 10% of the original contract amount.

Economic Impacts: None
Environmental Considerations:

California Environmental Quality Act (CEQA): The action is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines, Section 15301.

The action involves the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, or mechanical equipment, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The exemption covers interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances; and similar facilities; restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety, unless it is determined that the damage was substantial and resulted from an environmental hazard such as earthquake, landslide, or flood. The project qualifies for a Categorical Exemption under Article 19 of CEQA Guidelines Section 15301, existing facilities. No environmental review is necessary.

Sustainability: Under the General Plan, Climate Action Plan Policies and Programs, this qualifies under LU 2.6.5 Existing Structure Reuse. “City shall encourage the retention of existing structures… to retain the structures’ embodied energy, increase energy efficiency, make it more energy efficient, and limit the generation of waste. (RDR)”.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: The City awarded the Capitol Parking Garage Stair Improvements construction contract to JPB Designs, Inc. for an amount not to exceed $716,000, under Bid No.

B21014541003.

Executing Change Order No. 2 and resetting the City Manager’s authority to approve change orders will allow completion of the Capitol Parking Garage Stair Improvement project which is critical to maintaining safety standards in Capitol Garage.
