1-Description/Analysis
2-City of Sacramento Goods Agreement with Musson Theatrical, Inc.

Description/Analysis
Issue Detail: On June 13, 2023, Invitation for Bid (IFB) B23171121007 was released via the City’s bid portal (Planet Bids) to solicit bids. This IFB was for the purchase of lighting fixtures and accessories to replace the existing, obsolete lighting fixtures over the stage in the Main Hall at the Sacramento Memorial Auditorium. This request was for fixtures manufactured by ETC/High End Systems to stay consistent with the control and dimming system already installed.

Following the IFB process, staff recommends awarding a Goods Agreement to Musson Theatrical, Inc. in an amount of $493,827.08.

Policy Considerations: The recommendations in this report are consistent with the provisions of Sacramento City Code Chapter 3.56: Purchasing of Supplies and Services. Per City Code section

3.56.090, all contracts for supplies or non-professional services involving an expenditure of $250,000 or more shall be awarded by the city council.

Economic Impacts: None.

Environmental Considerations: Under the California Environmental Quality Act (CEQA), continuing administrative activities, such as what is recommended in this report, does not constitute a “project”. [CEQA Guidelines section 15378(b)(2).]
Sustainability: None.

Commission/Committee Action: None.

Rationale for Recommendation: There were five bids submitted prior to the deadline of the IFB of 2pm on July 12, 2023. All bids were considered responsive, Musson Theatrical, Inc. was the lowest responsive and responsible bidder as summarized below:

Financial Considerations: Staff recommends awarding a Goods Agreement to Musson Theatrical, Inc. in an amount not to exceed $493,828. There is sufficient funding available in the Memorial Auditorium Improvement Program (M17101000) to execute this agreement.

Local Business Enterprise (LBE): Musson Theatrical, Inc. is a LBE. However, the LBE preference did not apply to this bid process because the contract to be awarded was over $250,000.
