Description/Analysis
Issue Detail: As a result of past waste disposal practices, the City of Sacramento (City) is obligated to manage closed landfills where City generated waste was disposed. In addition to the main Sutter’s Landing/28th Street Landfill, the City also has responsibility for three other adjacent sites. The first two are the Cannon and Scollan Landfill sites. These sites were privately owned and acquired by the City in 2016 and 2017, respectively. They are former landfill sites where the City, through lease agreements, deposited waste in the 1950s.

As required by the Sacramento County Environmental Management Department (EMD), the Recycling and Solid Waste Division (RSW) completed an Investigative Work Plan of these sites, and is proceeding with plans to properly cap the Cannon and Scollan Landfill sites, as defined by California Code of Regulations Title 27.

The entire two sites, bounded by 23rd Street, 25th Street, A Street, and the Union Pacific Railroad line at B Street, and adjacent right of ways, comprise approximately seven acres. The City will close the two parcels as one site and ultimately intends to manage the Cannon and Scollan sites as part of the 28th Street Landfill.

The third site is the Dellar Encroachment, a narrow strip of land adjacent to the west border of the Dellar Landfill, extending from the north border of the Cannon Landfill to the American River levee.

This site is approximately 1.5 acres in size. RSW is including this site with the project to close the Cannon and Scollan Landfill sites.

The final design of the Cannon and Scollan Landfill site and the Dellar Encroachment projects will be developed by RSW and is estimated to cost approximately $2.5 million. The projects are currently funded with Solid Waste Funds (Fund 6007).

Staff investigated the availability of grant funding to assist with cost recovery for this cleanup.

CalRecycle manages the Legacy Disposal Site Abatement Partial Grant Program for cleanup of solid waste disposal sites where cleanup is needed to protect public health and safety and/or the environment. This grant would be eligible to partially fund the closure of the three sites. The Cannon and Scollan Landfill and Dellar Encroachment sites represent competitive project sites for application for the grant program.

The timeline for the CalRecycle Legacy Disposal Site Abatement Partial Grant Program is listed below:
· September 20, 2023 - Applications due
· October 25, 2023 - Application secondary due date (for executed resolutions) · December 2023 - Grants awarded
· June 30, 2026 - Grant term ends (deadline for final report and payment request) Policy Considerations: The recommendations in this report are consistent with the City’s General Plan goals of hazardous material contamination management, infrastructure finance, and impacts to environmentally sensitive lands.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): No environmental review is necessary because the recommendations in this report involve the administrative activity of applying for grant funding and are not considered to be a project in accordance with Section 15378(b)(2) of the California Environmental Quality Act Guidelines. Any cleanup and closure activities associated with this grant, if received, would undergo appropriate environmental review.

Sustainability: Properly closing the Cannon and Scollan Landfill and Dellar Encroachment sites contributes to sustainability goals for land and water protection, in compliance with California Code of Regulations Title 27.

Commission/Committee Action: None.

Rationale for Recommendation: CalRecycle requires the governing body of the applicant to provide a signed resolution authorizing the grant application. If awarded, the grant funds will help

offset the costs of properly closing the Cannon and Scollan Landfill sites as well as the Dellar Encroachment area.

Financial Considerations: This report recommends applying for grant funding in an amount not to exceed $750,000 from the FY2023/24 CalRecycle Legacy Disposal Site Abatement Partial Grant Program. Matching funds are required for this grant and are available in these projects for the following amounts:

Cannon Scollan Trust Project (Y13000200) $2,280,000
Dellar Landfill Closure Project (Y14000700) $220,000
If the grant funds are awarded revenue and expenditure budgets will be established in the FY2023/24 Legacy Disposal Project (G15003100, Solid Waste Grant Fund, Fund 6207) to offset the Solid Waste funds (Fund 6007).

Local Business Enterprise (LBE): Not applicable.
