1-Description/Analysis
2-Contract with Dignity Health Medical Foundation DBA Mercy Medical Group, a Service of Dignity Health Medical Foundation
Description/Analysis
Issue Detail: As the City’s current contract for Non-industrial Medical Services for City Employees and Job Applicants was set to expire in June 2023, on May 3, 2023, the City issued a Request for Proposals (RFP) P23081361007 for Non-industrial Medical Services for City Employees and Job Applicants to identify qualified firms to provide the highest quality service, with the best overall value for the City, at the most reasonable cost. Seven proposals were received in response to the RFP.
Each proposal was reviewed by a four-person review panel, which included City staff with knowledge and understanding of the needs related to the City’s non-industrial medical services.
Proposal ratings were based on the evaluation criteria listed in the RFP:
Cost Proposal 20
Services Proposed 20
Qualifications of Firm 20
Experience of Personnel 20
Interview (If necessary) 20
Local Business Enterprise (LBE) 5

On June 27, 2023, Council approved professional services agreements with the following firms for non-industrial medical services (which include a wide range of services needed): Occu-Med; MyNP.com Nursing Corporation; Mobile-Med Work Health Solutions, Inc.; Sacramento Mobile Drug & Alcohol Testing; Safe Hearing America, Inc.; and RAD Testing & Mobile Collection Dignity Health Medical Foundation DBA Mercy Medical Group, a Service of Dignity Health Medical Foundation (Dignity) was also among the top-scoring firms recommended for Award. Dignity was at that time, and still is, contracted with the City to provide these services through October 31, 2023.
Non-industrial medical services include a range of services, including pre-employment physicals and drug screenings, Federal Department of Transportation (DOT) drug/alcohol testing for existing employees, and audiometric testing. Some firms submitted proposals for very specific services they specialize in providing, such as on-site audiometric and drug and alcohol testing. All firms demonstrated they have qualified medical staff and facilities, as needed, to complete comprehensive pre-employment and reoccurring medical exams for City candidates and employees. The City has worked with many of the firms that submitted proposals and all are in good standing.
In recent years it has become increasingly difficult to find providers who are adequately staffed with medical professionals who provide non-industrial medical services. To provide the wide range of services needed and to ensure the City has reliable and alternative options to clear applicants through the pre-employment screening process and meet DOT and Cal/OSHA requirements staff recommends approval of Professional Services Agreement with Dignity.
Policy Considerations: Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements, and all agreements greater than $1 million shall be made available to the public at least ten (10) days prior to council action.
Economic Impacts: None
Environmental Considerations: California Environmental Quality Act (CEQA): This report concerns administrative activities and government fiscal activities that do not constitute a “project” as defined by CEQA Guidelines sections 15378(b)(2) and 15378(b)(4) and are not subject to the provisions of CEQA. (CEQA Guidelines, section 15060(c)(3).)

Sustainability: Not applicable.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: Since the existing contracts for these services expire at the end of October, 2023, it is vital that the City Council waive the 10-day notice requirement for this contract to ensure that the City is able to continue to perform appropriate pre-employment and other necessary non-industrial medical examinations.
In recent years it has become increasingly difficult to find providers who are adequately staffed with medical professionals who provide non-industrial medical services. The City currently works with Dignity and would like to ensure a successor contract is in place for continuation of these services when the current contract ends.
Financial Considerations: Funding for this contract is included in the Human Resources fiscal year 2023/24 operating budget. Funding for future fiscal years beyond FY2023/24 and any supplemental contracts is subject to Council approval.
Local Business Enterprise (LBE): LBE Preference was included in the sourcing event.
