Description/Analysis
Issue Detail: The property owners within the River District corridor have proposed to renew the River District Property and Business Improvement District (PBID) for a ten-year term. The previous renewal was approved by Council on July 15, 2014, for a ten-year term, which expires

on December 31, 2024. The PBID will continue to provide a higher level of security, maintenance services, and advocacy activities to promote the area as a desirable place to live, work, and do business.

The total PBID assessment budget for the first year of this renewal will be approximately $751,570. The service area includes approximately 548 assessed parcels. The City owns 64 parcels within the PBID that have been assessed for the last nine years under the PBID and have benefitted from the PBID services. City staff is thus recommending that the City-owned parcels continue to be included as assessed parcels in the renewed PBID. If City Council wishes to support the renewal of the PBID, the Council may delegate to the City Manager or City Manager’s designee the authority to sign the property owner’s petition and assessment ballot on behalf of the City property that is located within the PBID.

Policy Considerations: The proceedings under which the PBID is proposed to be renewed are set forth in California Streets and Highways Code section 36600 et seq., referred to as the “Property and Business Improvement District Law of 1994.”
Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” under CEQA Guidelines Section 15378(b)(2) and Section 15378(b)(5). The proposed action in this report is therefore not a “project” subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: The recommended action authorizes the City Manager to sign the property owner’s petition and assessment ballot in the affirmative on behalf of the City property that is located within the PBID.

Financial Considerations: If the PBID is renewed, the City will continue to participate as a property owner. City-owned properties will have a total assessment of approximately $110,694 for the first year of this renewal. With this renewal, the 64 City-owned property assessments will increase from fiscal year 2023/24. The City’s assessment is budgeted for and paid from the General Fund. Future assessment rates are anticipated to be subject to an increase of no more than five percent (5%) annually.

RESOLUTION NO.

Adopted by the Sacramento City Council

DESIGNATING THE CITY MANAGER OR THE CITY MANAGER’S

DESIGNEE AS THE SIGNATURE AUTHORITY FOR CITY-OWNED

PROPERTY IN THE RENEWED RIVER DISTRICT
PROPERTY AND BUSINESS IMPROVEMENT DISTRICT NO. 2014-01

BACKGROUND:

A. On July 15, 2014, the property owners within the River District corridor renewed the River District Property and Business Improvement District (River District PBID) for a ten-year term under the PBID Law of 1994 (California Streets and Highways Code section 36600 et seq. The initial term of the River District PBID renewal was from January 1, 2015 to December 31, 2024.

B. The property owners have now proposed renewal of the River District PBID for a ten-year term.

C. The City owns 64 parcels within the River District PBID. The City-owned parcels have been assessed under the PBID since its formation. The City-owned parcels will have a total annual assessment of approximately $751,570 for the first year of the renewal term. Future assessment rates may be subject to an increase of no more than five (5%) annually.

D. City staff recommends that the City-owned parcels be included as assessed parcels in the renewed River District PBID because the City properties have thus far benefitted from the River District PBID’s services. Staff is thus seeking Council approval to delegate the City Manager or the City Manager’s designee as the signatory for the property owner’s petition and assessment ballot supporting renewal of the River District PBID.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
