Description/Analysis
Issue Detail: On September 24, 2019, City Council approved the Professional Services Agreement with MIG, Inc. for the preparation of the Parks Plan 2040. The Parks Plan 2040 is considered as one of the components of the 2040 General Plan that will receive environmental clearance from the adoption of the 2040 General Plan’s Master Environmental Impact Report (MEIR). The Parks Plan 2040 is currently being drafted to incorporate the goals and policies of the General Plan. The content and the extension of the schedule for the Draft MEIR and General Plan has resulted in additional analysis for the drafting of the Parks Plan 2040. These changes have had an effect on the policies and key directions that had been drafted prior to the General Plan Update and MEIR release.

The original contract with MIG, Inc. had been previously extended from the original period ending on June 30, 2021, to a revised contract period ending on September 30, 2022, with the first Supplemental Agreement. The first extension to the consultant services agreement would have had the Parks Plan 2040 completed by Spring of 2023. However, due to the revisions needed to the Parks Plan 2040, additional tasks have been added to the agreement and MIG, Inc.’s 2023 rates are

now applicable to the new tasks.

The original contract with MIG, Inc. with an amount of $389,276 has been conservatively applied to the original tasks as outlined in the Contract Scope of Work. The first Supplemental Agreement added $75,740 to the budget, for a total of $465,016. The current request to add project tasks and update the consultant’s rate is an additional request of $91,292 for a new total not-to exceed amount of $556,308 to complete the project.

Policy Considerations: The Parks Plan 2040 is a component of the City’s General Plan 2040 and Master EIR, the Parks Plan 2040 ensures that the policies are aligned with the General Plan policies, level of service standards, implementation action programs, and is responsive to the current economic, social, and technological trends.

As required by City Code 3.64.040, for agreements originally awarded for a price of at least $250,000, but less than $1,000,000, council approval is required to issue supplemental agreements that increase the agreement amount, if the sum of all such supplemental agreements exceeds 10% of the original agreement price.

Economic Impacts: None.

Environmental Considerations: The approval of supplemental contracts is not considered a project as defined by Section 15378 of the California Environmental Quality Act guidelines. The recommended action involves no physical construction and has no potential to cause a significant impact to the environment.

Sustainability: The Parks Plan 2040 in conjunction with the General Plan 2040 will ensure that the relevant Sustainability goals, policies, and programs are in place to help reduce the city’s carbon footprint, adjust to changing climate, and quality of life.

Commission/Committee Action: Not Applicable.

Rationale for Recommendation: Supplemental funds are required to continue with the update for the Parks Plan 2040 and consistency with the General Plan 2040.

Financial Considerations: There are adequate financial resources in the Parks Plan 2040 Project (L19112500)(Fund 3204) to support this supplemental agreement of $91,292.

Local Business Enterprise (LBE): MIG, Inc. has satisfied the LBE requirement by contracting with a minimum of 5% of the contract.
