Additional Description/Analysis
Issue Detail: The Fairbairn Water Treatment Plant Laboratory Building, located at 7501 College Town Drive, is one of two water treatment plant facilities where the City of Sacramento tests the safety and potability of the City’s drinking water. The building was constructed in the early 1990s and has served as a lab since that time. Over the years during rainfall events, water leaks in the walls have allowed some water to enter the building, causing stains on ceiling tiles, carpet, and other interior finishes. Because of this, city staff have been temporarily relocated while repairs were conducted. This has resulted in operational inefficiencies and an inconvenience to the occupants.

On September 20, 2022, the City Council awarded a construction contract to DPR Construction, Inc. (DPR) for $2,172,953, to repair the building. A Notice to Proceed with construction was issued to

DPR on March 22, 2023.

After construction started, DPR commenced demolition of selected exterior sections of the building.

While performing the demolition, a significant amount of mold was discovered behind the walls. As more areas were uncovered, it was found that the mold was pervasive throughout the entire exterior and extended into the vapor barriers, outer sheathing, and in some areas into the internal drywall. As a result of this unforeseen condition, an entirely new exterior underlayment system was required to be designed to mitigate the mold issue. New sheathing, insulation, vapor barrier, and interior drywall were added to the building, creating a nearly new wall system. Because this issue was inside the wall, the extent of the damage was not found during the pre-design investigation phase and was only discovered during demolition.

Change Order No. 1 totaling $171,189 was executed to address part of the unforeseen site conditions. Change Order No. 2 further addresses the unforeseen conditions.

Policy Considerations: The recommendations in this report are in accordance with the provisions of City Code Section 3.60, which requires City Council approval of contracts and contract change orders of $250,000 or more.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The action is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines, Section 15301.

The action involves the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, or mechanical equipment, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The exemption covers interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances; and similar facilities; restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety, unless it is determined that the damage was substantial and resulted from an environmental hazard such as earthquake, landslide, or flood. The project qualifies for a Categorical Exemption under Article 19 of CEQA Guidelines Section 15301, existing facilities. No environmental review is necessary.

Sustainability: Under the General Plan, Climate Action Plan Policies and Programs, this qualifies under LU 2.6.5 Existing Structure Reuse. “City shall encourage the retention of existing structures and promote their adaptive reuse and renovation with green building technologies to retain the structures’ embodied energy, increase energy efficiency, make it more energy efficient, and limit the generation of waste. (RDR)”

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Ratifying Change Order No. 1 and approving Change Order No. 2 with DPR Construction Inc. for the Fairbairn Water Treatment Plant Laboratory Building Exterior Improvements Project is necessary to expedite the completion of repairs to this facility. These changes are required to complete the waterproofing for this critical infrastructure and protect it from potential water intrusion and the subsequent damage caused by water infiltration.

Financial Considerations: There is sufficient funding within the Department of Utilities (DOU) Facility Improvements and Rehabilitation Program (Z14140600) to execute Change Order No. 2 in the amount of $682,379 (Water Fund, Fund 6005) for the Fairbairn Water Treatment Plant Laboratory Building Exterior Improvements Project.

Local Business Enterprise (LBE): DPR Construction is an LBE.
