2-Construction Change Order No. 4 - Martin Brothers Construction Description/Analysis
Issue Detail: The North 12th Complete Street Project transformed the North 12th Street Corridor from Richards Boulevard to H Street into a complete street by installing a Class IV separated bikeway along the west side of North 12th Street. The project also included construction of new sidewalks, landscaping, aesthetic improvements, street and pedestrian lighting, and traffic signal enhancements.

On May 4, 2021, the City Council awarded a Construction Contract for the North 12th Complete Street Project to Martin Brothers Construction for an amount not to exceed $5,125,101 (City Agreement 2021-0518).

During construction, unanticipated additional quantities of class I contaminated soil were encountered at the intersection of 12th Street and Dos Rios Street beyond what was originally bid in the contract.

The contractor submitted a claim for handling and disposing of the contaminated soil in the amount of $307,528. A claims hearing was held in accordance with the City Standard Specifications.

The parties reached an agreement to settle the claim for an amount not to exceed $250,000.

Construction Contract Change Order (CCO) No. 4 will cover the cost of handling and disposing of the additional quantities of contaminated soil, ensuring it is sent to a Class I landfill facility consistent with this settlement.

Policy Considerations: The action requested supports the City’s General Plan goals of improving the transportation system, expanding public safety, achieving sustainability through reduced dependence on the private automobile, and enhancing livability and economic vitality. The project provides much needed improvements to the bicycle and pedestrian facilities for continuous mobility and connectivity for pedestrians, bicyclists, vehicles, and transit in a disadvantaged community.

Economic Impacts: This new infrastructure associated with this change order is expected to create 1 total jobs (0.58 direct jobs and 0.42 jobs through indirect and induced activities) and create $154,358 in total economic output ($97,293 of direct output and another $57,065 of output through indirect and induced activities).

The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.

Environmental Considerations:

California Environmental Quality Act (CEQA) / National Environmental Policy Act (NEPA): The City Council adopted the Mitigated Negative Declaration and Mitigation Monitoring Plan on April 10, 2018 (Resolution No. 2018-0117) for the North 12th Street Complete Streets Project. The project was subject to the California Environmental Quality Act (CEQA) for the City action of approving the project and subject to the National Environmental Policy Act (NEPA), compliance with which was overseen by Caltrans, due to federal funding. In compliance with CEQA, the City prepared an Initial Study, approved the Mitigated Negative Declaration, and adopted a Mitigation Monitoring Plan.

In compliance with NEPA, Caltrans determined on April 23, 2018, that the project qualified for a Categorical Exclusion under 23 CFR 771.117(c): activity (c)(3) and is

therefore categorically excluded from having to prepare an environmental assessment (EA) or environmental impact statement (EIS).

Approving this construction CCO is further implementation of the approved project. No further environmental review is required for subsequent actions of a previously approved project.

Sustainability: This project is consistent with the City’s General Plan goals for the design of complete streets that enable safe access for all users (i.e., pedestrians, bicyclists, motorists, and transit riders) of all ages and abilities. Proper removal and disposal of hazardous soil removes potential exposure to toxic materials.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Approval of construction change order No. 4 is needed to provide funding for handling and disposing of contaminated soil and the project closeout.

Financial Considerations: The total estimated cost of the North 12th Complete Street Project (T15165000), including engineering, right of way acquisition, construction, and construction management is approximately $8.5 million. There is sufficient funding available in the North 12th Complete Streets Project (T15165000) to execute CCO No. 4 to City Agreement 2021-0518 with Martin Brothers Construction for an amount not to exceed $250,000, for a new total contract not-to- exceed amount of $5,739,000 and cover the remaining closeout costs of the project.

There are no General Funds planned or allocated for this project.

Local Business Enterprise (LBE): The North 12th Complete Street Project (T15165000) has federal construction funding and requires conformance with Disadvantaged Business Enterprise (DBE) requirements. Therefore, the City’s LBE requirements are held in abeyance.

The DBE goal for this project is 17%. Martin Brothers Construction pledged 17.8% in DBE which exceeds the project DBE Goal.
