Additional Description/Analysis
Issue Detail: Staff recommends Council approve Change Order No. 8 with CSI Engineering, Inc. for the City Agreement No. 2022-0735, to alleviate conflicts between the storm drain pipe and other utilities due to unforeseen conditions and special circumstances.
Policy Considerations: This Change Order exceeds the City Manager’s approval authority and requires Council approval.
The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements, and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-Day review on November 3, 2023, in compliance with City Code.
Economic Impacts: This Change Order is expected to create 4.76 total jobs (2.74 direct jobs and
2.02 jobs through indirect and induced activities) and create $735,109.78 in total economic output ($463,345.31 of direct output and another $271,764.47 of output through indirect and induced activities).
The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.
Environmental Considerations: The subject project was reviewed and determined to be categorically exempt from the California Environmental Quality Act (CEQA). The project includes the replacement of an existing storm drain pipe (utility systems) involving no expansion of capacity (CEQA Guidelines Section 15302 (c)).
Sustainability: The proposed project is consistent with the 2035 General Plan as it replaces a large diameter storm drain trunk main at the end of its useful life which improves infrastructure reliability.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: The utilities within Fruitridge Road between the railroad tracks and Franklin Boulevard have been installed at different times with little documentation, and mostly prior to that roadway being annexed into the City. As the large diameter storm drain mainline was excavated, conflicts with crossing and adjacent utilities were identified. These conflicts are addressed on either a time and materials basis or an agreed-to lump sum basis so that the storm drain replacement can

continue. A listing of the extra work items is shown in the Background section of this document.
Financial Considerations: The original not-to-exceed amount of the contract was $1,495,510.00.
The net change by previous change orders in the amount of $446,754.77, increased the contract not- to-exceed amount to $1,942,264.77. Proposed Change Order No. 8 in the amount of $1,190,586.51 would increase the contract not-to-exceed amount to $3,132,851.28.
Sufficient funding exists in the Storm Drainage Contingency Program (W14000200, Fund 6021).
However, the Storm Drainage Property Related Fee Fund is in litigation and the funding is on hold. To provide sufficient funding for this project and to reimburse the funding sources, the following budget transfers are recommended.
Project/Fund Balance Fund Amount
Drainage Master Plan Program (I14710100) 6011 ($300,000) Storm Drainage Fund Balance 6011 ($500,000)
Drainage Collection System R&R Program 6011 $800,000
Storm Drainage Contingency Program (W14000200) 6021 ($800,000) Drainage Master Plan Program (I14710100) 6021 $300,000
Storm Drainage Property Related Fee Fund Balance 6021 $500,000 DOU intends to reimburse the Storm Drainage Fund (6011) balance from the Storm Drainage Property Related Fee Fund (6021) balance in the Fiscal Year that the litigation is successfully resolved.
There are no General Funds allocated or planned for this project.
Local Business Enterprise (LBE): CSI Engineering, Inc. is not an LBE.
Background Conflicts with the 48-inch diameter storm drain replacement pipe have arisen as explained in the Rationale for Recommendation section. To resolve these conflicts, extra work was performed by the contractor. A listing and explanation of the extra work items in the change order follows:
1. Utility Conflicts - The Contractor encountered several utilities in conflict with the new storm drain pipe (water mains and services, sewer mains and services, dry utilities including electrical conduits and telecommunications conduits, and gas mains and services) which needed to be relocated to accommodate the new, thicker-walled pipe. Conflicts are typically resolved starting with the trenching and removal of the conflicting service or mainline, the replacement of the service or mainline in a non -conflicting location, then the installation of the new pipe. In many cases the conflicting utility was

field located via a pothole before the excavation to speed up the performance of this extra work.
2. Private drain line connections - The Contractor encountered multiple private drain lines connected to the existing storm drain pipe. Instead of disconnecting or rerouting the private drainage lines, it was decided to install new manholes at those locations consistent with the current standards. Three of those were able to be realigned to connect to existing manholes.
3. Connect to concrete vault at Railroad ROW - The existing vault had no access from the street so a manhole was proposed adjacent to that vault to provide access. Conflicting utilities at the face of the vault required the manhole to be moved away by several feet requiring additional excavation/ backfill/ surface restoration and a segment of HDPE pipe to connect the manhole with the vault which was not envisioned in the design.
4. SMUD High Pressure Gas Main - Several locations where the excavation for the new storm drain pipe was near to the high pressure main required field-location by potholing by SMUD so that the proximity to the excavation could be identified. SMUD also required the presence of their inspector during the potholing.
5. Equipment idle time and rented materials - Through the course of the work, the contract duration has been extended due to conflicts, weather and other unforeseen events and special circumstances well beyond what was anticipated at the bid. The Contractor has been required to cover additional costs of various rented materials such as trench plates and shoring, as well as equipment that remained idle at the job site and couldn’t be used elsewhere.
6. Pipe size reduction restocking fee - From manhole number 515 (located at station 15+93.17) easterly to the end of the project, the City and Contractor agreed to reduce the size of the pipe to increase installation efficiency. Between manholes 515 and 5 the Contractor installed 42-inch diameter reinforced concrete pipe, and between manholes 5 and 617 the Contractor installed 36-inch diameter reinforced concrete pipe. This type of substitution requires the payment of a restocking fee to the pipe manufacturer.
7. Thick asphalt concrete on Fruitridge Road - From the western end of the project to approximate station 8+75 (850 linear feet), the Contractor encountered thicker asphalt concrete paving than was expected, approximately double the expected thickness. Additional cost was incurred in removing, handling and off hauling the asphalt concrete to facilitate the replacement of the storm drain pipe.
8. Manhole 627 - The manhole in Franklin Boulevard at the eastern terminus of the project was found to be a vault. To make the new pipe connections the contractor had to investigate the structure of the vault to determine wall thickness and reinforcement.
File ID: 2023-01160 11/14/2023 Consent Item 47.
9. Extended traffic control - Through the course of the work, the contract duration has been extended due to conflicts, weather and other unforeseen events and special circumstances well beyond what was anticipated at the bid. Therefore, the costs to provide traffic control for the project has increased beyond the costs anticipated at the time of bid.

9) Through the course of the work, the contract duration has been extended due to conflicts, weather and other unforeseen events and special circumstances to well beyond what was anticipated at the bid. Therefore the costs to provide traffic control for the project has increased beyond the costs anticipated at the time of bid. The additional cost of $17,846.02 was computed by dividing the lump sum bid price of $20,000.00 by the total anticipated contract days to return a cost of $307.69 per day, the n multiplying that by the additional days not already covered by extra work (58 days). Compensation includes all markups, profits, surcharges, taxes, and overhead costs. No additional compensation will be provided due to this contract change.
