Issue Detail: Staff recommends Council authorize the City Manager or City Manager’s designee to execute Change Order No. 1 to City Agreement No. 2023-1315 with Navajo Pipelines, Inc. for an amount not-to-exceed $977,900, bringing the agreement’s total not-to-exceed amount to $1,227,899.
City Agreements 2023-1282 with Fox Loomis, Inc. and 2023-1315 with Navajo Pipelines, Inc. are for the emergency construction services to repair the failed sewer mains near Pocket Road and Sea Lion Court that had led to a deep depression forming in the roadway that made it unsafe for vehicle traffic for a time being.
File ID: 2023-01410 11/28/2023 Consent Item 8.
City staff was able to stabilize the situation and install temporary underground bypass piping to ensure the sewer mains still functioned appropriately, however, the bypass system is intended to be a short-term solution to allow time for a contractor to repair the issue. The City still deems this an emergency given that if the pumps or piping would have any failures, the City could suffer multiple sanitary sewer overflows (SSO’s) adjacent to the Pocket Canal. In addition, the City would be left vulnerable if the rehabilitation was prolonged by undertaking the City’s standard contracting procedure.
The work performed by Fox Loomis, Inc. is to install roughly twenty-six (26) dewatering wells that would pump down the groundwater to allow the sewer repair to be performed safely. Navajo Pipelines, Inc. will perform work associated with supporting Fox Loomis, Inc. in their dewatering efforts, and have also provided the City with a cost proposal to perform the Sewer Improvements that will mitigate the issues from the failed sewer main that led to the roadway depression. This cost proposal has been captured into Change Order No. 1 for Agreement No 2023-1315 for $977,900.
Policy Considerations: This action is consistent with City Code Section 3.60.070, which requires the City Manager to present a report to Council describing the emergency, the actions taken, and the emergency contracts that were executed.
Economic Impacts: This project is expected to create 5.91 total jobs (3.40 direct jobs and 2.51 jobs through indirect and induced activities) and create $912,505.96 in total economic output ($575,159.48 of direct output and another $337,346.48 of output through indirect and induced activities).
The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.
Environmental Considerations: This project is exempt from the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines governing existing facilities, in that it meets the definition of restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety.
Sustainability: The proposed project is consistent with the 2035 General Plan as it improves infrastructure reliability and addresses existing safety and health impacts.
Commission/Committee Action: Not applicable.
File ID: 2023-01410 11/28/2023 Consent Item 8.
Rationale for Recommendation: City Code Section 3.60.070 allows for the City Manager to negotiate and contract for public projects without advertising for bids when public interest and necessity demand immediate action, repair or replacement to safeguard life, health, or property, to permit the continued conduct of city operations or services, or to mitigate further damage.
Given the efforts to address the safety concerns around the roadway depression, an emergency contract was necessary to ensure that repairs were conducted in a timely manner to prevent further depressions and sinkholes from becoming safety hazards, and furthermore, to prevent the separated sewer from backing up and causing an SSO and potentially entering the local waterways.
An emergency project number was created for this issue to track staff time and any other expenses related to the depression forming on Pocket Road. City staff has identified funding from other projects and the fund reserves that it hopes to use to provide for these expenses and requires City Council approval to transfer those funds between projects in excess of $249,999.
Financial Considerations: The total estimated cost for the project is $3,355,617, which includes employee services, equipment, and materials used to stabilize the initial emergency of $1,355,617. It is anticipated that this project will require an additional $2,000,000 to fund the construction and the additional staff time needed for the sewer repairs. Staff recommends transferring $2,000,000 from the Wastewater Fund Balance (Fund 6006) to the Separated Pipe Rehabilitation and Replacement Program (X14160500, Fund 6006).
There are no General Funds planned or allocated for this project.
Local Business Enterprise (LBE): LBE requirements are suspended for contracts that are emergency in nature, however, Navajo Pipelines, Inc. and Fox Loomis, Inc. both qualify as an LBE.
Background: In 2006, a roadway depression appeared near the intersection of Pocket Road and Sea Lion Court and was caused by inflow and infiltration (I&I) due to structural failures along a 12- inch sewer main. To remedy the situation, approximately 100 linear feet (LF) of 6” pipe sleeve was installed in the 12-inch sewer main and the roadway depression was repaired. This was intended as a temporary repair, but due to budget restrictions and conflicting priorities, a permanent repair was never completed.
On May 12, 2023, another roadway depression was discovered at the same location as the 2006 depression. This was caused by similar structural failures within the sewer main, as groundwater and sediment continued to enter the sewer main. City staff immediately installed traffic control and moved traffic away from the damaged area. On June 13, 2023, City staff installed a plug on the failed sewer main and installed a bypass system, which stabilized the roadway. After multiple weeks of the roadway being stabilized, during the week of July 17, 2023, Public Works repaved the roadway and

reopened the road to vehicle traffic.
The City hired GEI Consultants, Inc., a geotechnical engineering consulting firm, who determined that this area was problematic due to high groundwater elevations, poor soil characteristics, and deep sewer main depth. Sewer repairs in this area would be subjected to similar issues that caused the current roadway depression and would not guarantee reliability or long-life expectancy. As a result, the department’s engineering staff evaluated the option to re-route the sewer flows north to avoid the area of concern while continuing sewer services to residential properties.
Although the City was able to stabilize the situation, the bypass pumps are a temporary repair, and City staff still deemed the full repair needed as an emergency, given that if the pumps or bypass piping fail, the adjacent area would be subject to potential SSO’s. With the emergency nature in mind, City staff reached out to three general contractors, who have good working relationships with the City, for proposals to perform the repair work: Navajo Pipelines, Inc., Subterra Construction, Inc., and Florez Paving. Navajo Pipelines, Inc. provided the best proposal for that the work, which is incorporated into Change Order No. 1.
Due to high groundwater in the Pocket area, for Navajo Pipelines, Inc. to perform their work safely, the groundwater needs to be drawn down. Therefore, the City reached out to Fox Loomis, Inc., a dewatering contractor, for a cost proposal to perform the work. Fox Loomis, Inc. will install dewatering wells with the assistance of Navajo Pipelines, Inc.
