Description/Analysis
Issue Detail: To mitigate the impacts of homeless encampments in the City, the Department of Community Response (DCR) recommends that City Council approve Supplemental Agreement No. 2 to City Agreement No. 2022-0665 with Forensiclean LLC in an amount not-to-exceed $720,000 to provide disposal of trash related to DCR Cleanup services.

Prior to Fiscal Year (FY)2022/23, disposal services connected to homeless mitigation via encampment cleanup had been managed by the Department of Public Works. In FY2022/23, the services were realigned to be managed by the Department of Community Response.

In March 2023, City Council approved City Agreement No. 2023-0375 with Forensiclean to continue and expand cleanup and litter abatement coverage services. The expansion included an increase in clean-up teams throughout the City, as well as extended hours. Forensiclean disposes of the collected trash at the North Area Recovery Station (NARS) using their own account and receives reimbursement of the fees on a monthly basis.

Earlier this year, the City also established the Incident Management Team (IMT) to help streamline and prioritize resources in its response to the homelessness crisis. With more targeted outreach and clean-up efforts, DCR recommends City Council approve Supplemental Agreement No. 2 to City Agreement No. 2022-0665 to provide funding for the increase of trash disposal and extend services through March 31, 2025. Submitted invoices for reimbursement shall include a log detailing date and weight of trips to NARS.

Since July 2021, Forensiclean has responded to over 30,000 311 cases and collected about 121,482 cubic yards of trash.

Policy Considerations: Pursuant to Sacramento City Code section 3.56.090, any agreement for non -professional services that is for $250,000 or more requires City Council approval.

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements, and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-day review on November 22, 2023, in compliance with the City Code.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): This report concerns maintenance activities that do not constitute a “project” and are not subject to the provisions of California Environmental Quality Act (CEQA). (CEQA Guidelines §§ 15378(a), (b)(2)).

Sustainability: The homeless encampment cleanup services support the safe collection and disposal of waste to reduce impacts on public health and natural resources.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Citywide clean-up services address ongoing efforts to mitigate the impact of homelessness on the City.

Financial Considerations: Sufficient funding is available (Measure U Fund, Fund 2401) in the Community Response MYOP (I23000100) to execute the supplemental agreement with Forensiclean in an amount not-to-exceed $720,000.

Local Business Enterprise (LBE): Forensiclean LLC is a business local to the City of Sacramento and is a registered LBE.
