Description/Analysis
Issue Detail: Pursuant to Sacramento City Code Chapter 12.40 and California Vehicle Code Section 21102.1, vehicular and pedestrian traffic is currently restricted through the below identified alleys as provided in the following Resolutions:
R1997-146: Alley Bounded by 12th Street/13th Street/D Street and E Street R1997-416: Alley Bounded by Carmel Street/Cypress Street/Rivera Drive and Rio Linda Boulevard
R1997-601: Alley Bounded by: Eleanor Avenue/Las Palmas Avenue/Branch Street and Del Paso Boulevard
File ID: 2023-01541 12/12/2023 Consent Item 3.
The restriction required the placement of metal gates within the alley. Through field verification, city staff has determined gates have been absent from these three alleys for at least five years. As public works staff has not received any complaints concerning these alleys during that time period, city staff thinks that is evidence that the alleys no longer need to be restricted for the protection or preservation of the public peace, safety, health or welfare.
Policy Considerations: Sacramento City Code Chapter 12.40 authorizes the City Council to terminate vehicular and pedestrian traffic restrictions through alleys if the City Council determines the restrictions are no longer necessary for the protection or preservation of the public peace, safety, health or welfare.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): The proposed action regarding alleys is categorically exempt from CEQA review pursuant to CEQA Guidelines section 15301. The activity consists of the operation, repair, permitting, or minor alteration of existing public facilities involving negligible or no expansion of use.
Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: As public works staff has not received any complaints concerning these alleys during that five year time period, city staff thinks that is evidence that the alleys no longer need to be restricted. Further, adoption of the attached Resolution will help provide an accurate account of the restricted alleys listed as part of the Alley Abatement Program. Finally, accurate information regarding the city’s alley restrictions will make the City’s records more accurate for the benefit of the general public and city departments.
Financial Considerations: The estimated cost to process this request is approximately $5,000 of staff time. There is sufficient funding in the Alley Abatement Program (T15100900) to support staff time to process this request.
Local Business Enterprise (LBE): Not applicable.
Background: Through city council resolutions, the City Council restricted vehicular and pedestrian traffic through the alleys identified in this report for the protection or preservation of public peace, safety, health or welfare. Pursuant to authorization in the resolutions, the City caused alley gates to

be constructed within the alleys to restrict vehicular and pedestrian traffic. The gates that once existed in the alleys have been removed. The gate that was installed pursuant to resolution 1997-146 at the alley bounded by D, E, 13th and 14th Street was removed in approximately 2010 at the time the City Council separately approved a partial vacation (abandonment) of that alley. The absence of these gates has exceeded more than five years. After reviewing calls for service for each alley, the Police Department supports removal of these alley restrictions and not re-installing the gates as a matter of public safety as indicated in Attachment 2. Within the past 5 years, the Department of Public Works has not received any requests to re-install the gates or to keep the alley restrictions.
Additionally, the restricted alley listed under City Council Resolution 1997-601 has been superseded by two gates installed for a temporary closure by City Council Resolution 2022-319. As previously stated, there are no current gates for the alleys listed in the attached proposed resolution. To maintain proper records, the Department of Public Works seeks to remove these restrictions as noted in City Council Resolutions 1997-146, 1997-416 and 1997-601.
