Description/Analysis
Issue Detail: The Department of Utilities (DOU) has an ongoing need for sampling, laboratory testing, technical support, and disposal services for CSS waste management. The City periodically generates waste materials from pipeline cleaning activities and temporarily stores the waste in bins at the City’s Meadowview Service Center. To dispose of the materials, the City requires periodic sampling for constituents of concern, evaluation of data relative to waste disposal requirements, and assistance in creation and maintenance of waste profiles for disposal companies.

Policy Considerations: The recommendations in this report are in accordance with City Code Chapter 3.60 requiring City Council for approval for agreements of $250,000 or more.

Economic Impacts: None.

Environmental Considerations: The activity described in this report consisting of approval of an agreement for the ongoing sampling, laboratory testing, technical support, and disposal services for CSS waste management has been determined to be exempt pursuant to the California Environmental Quality Act (CEQA), CEQA Guidelines Section 15308. The activity is an action taken by regulatory agencies, as authorized by state or local ordinance, to assure the maintenance, restoration, enhancement, or protection of environment where the regulatory process involves procedures for protection of the environment.

Sustainability: The proposed work is consistent with the 2035 General Plan, section U 1.1, as maintenance improves infrastructure reliability.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: On September 12, 2023, the Department of Utilities issued a Request for Proposals (RFP) for Sampling, Laboratory Testing, Technical Support, and Disposal Service for Combined Sanitary Sewer (CSS) Management. The RFP was advertised on the City’s Planet Bids website as well as with Metropolitan News Company, publisher of the Sacramento Bulletin. Proposals were due on October 18, 2023, and one response was received. A selection committee comprised of City staff from the Department of Utilities reviewed the proposal and determined that Stantec Consulting Services, Inc., was responsive and possesses the required experience. Based on the review, staff recommend awarding a contract to Stantec Consulting Services, Inc.

Financial Considerations: Sufficient funding for this agreement exists in DOU’s Fiscal Year 2023/24 operating budget to fund the first year of the agreement. Funding for future fiscal years shall be subject to funding availability in the budget adopted for the applicable fiscal year.

There are no general funds allocated or planned for this project.

Local Business Enterprise (LBE): Stantec Consulting Services, Inc. is not an LBE.

Subtask 5.1 – Waste Profiling, Project Setup, and Initial Bin Delivery CONTRACTOR will coordinate with the subcontracted waste hauler and receiving facility to execute a waste profile. Waste will be transported to Waste Management’s Kettleman Hills facility for disposal as non-RCRA waste. CITY has determined this facility currently provides the most cost-effective option for the anticipated waste, but additional facilities will be considered based on the outcome of the profile. This subtask includes project management, disposal facility coordination, set-up and delivery of soil bins, monthly bin rental, transportation, disposal of solid waste, and contractor/subcontractor oversight and task-related health and safety planning. Subtask 5.2 – Waste Disposal CONTRACTOR will coordinate with CITY staff as needed to coordinate waste disposal events. These disposal events will occur no less than quarterly and no more than twelve (12) events annually and include disposal facility coordination, cradle-to-grave manifest tracking, bin rental, transportation, and disposal solid waste, and contractor/subcontractor oversight and task related health and safety planning. Task 5 Assumptions: Waste will consist of "sludge" (solid waste) with no free liquid. Assumes up to 20 yards per event, with no bin being loaded with a quantity greater than 20 tons. Waste can be profiled for disposal at Waste Management Kettleman Hills as non-RCRA waste and that fecal coliform is below acceptable levels. Assumes adequate access for delivery of one roll-off bin and simultaneous pickup of up a second roll-off bin for each event. Each disposal event can be performed in a single mobilization, with access to materials readily provided by CITY staff. Field oversight during waste bin removal can be performed using standard Level D personal protective equipment, and extraneous safety measures (i.e. fall protection, confined space management, etc.) will not be required. Field oversight during waste bin removal will be performed during normal business hours (Monday – Friday, 7:00am - 3:30 pm) and can be completed as scheduled by the receiving facility and the transportation contractor. 6. If negotiations are not successful, then DOU may enter into negotiations with the next-ranked firm(s) or individual(s), and so on until an agreement has been reached. Evaluation Criteria The City will validate and evaluate all proposals received. All requirements identified in the RFP must by satisfied in order to ensure that a proposal will qualify for consideration. Selection of the top ranked firm may be made based solely on the selection committee’s review and ranking of the proposals, without conducting any interviews. If interviews are deemed necessary, they will be conducted with the top ranked firms (minimum of two) and considered in the selection. If interviews are held, the selection committee will select the top-ranked firm(s) based on the proposal scores as indicated in Attachment 2 – Proposal Rating Form. The interviews will be scored separately, and the firm that has the highest score, based on the Interview Criteria, as indicated in Attachment 2, will be selected. All requirements identified in this RFP must be satisfied for a proposal to qualify for consideration. A staff panel will review the proposals which will be evaluated based upon their relative ranking using the criteria listed in Attachment 2. At the completion of the evaluation process, a total point value will be compiled for each proposal. The award recommendation(s), if any, will not necessarily be based on the lowest prices proposed or on the point values assigned. LBE Five Percent (5%) Proposal Evaluation Preference For contracts under $250,000, firms that qualify as a Local Business Enterprise (LBE) will receive a 5% preference on all City procurement opportunities. For professional service contracts only, this preference also applies to procurement opportunities of $250,000 or more. For contracts to be awarded in response to a solicitation for proposals, a firm that qualifies as an LBE shall receive additional points during the scoring process so the final score awarded to the LBE is increased by 5% of the total possible evaluation points.

ATTACHMENT 4 LOCAL BUSINESS ENTERPRISE (LBE) PROGRAM 5% PREFERENCE FORM NOTE: Proposers must provide responses to the following items in order to qualify for the 5% preference.1. LBE FIVE PERCENT (5%) PREFERENCE For contracts under $250,000, firms that qualify as an LBE will receive a 5% preference on all City procurement opportunities. For contracts to be awarded in response to a solicitation for bids, a bid or quotation submitted by a firm that qualifies as an LBE will receive a 5% bid evaluation preference for the purpose of determining the lowest responsible bidder. This means that, for bid evaluation purposes, the total price bid by an LBE shall be reduced by 5%. However, this reduction only applies for bid evaluation purposes, and the resulting contract or purchase order will reflect the actual amount bid by the LBE. For contracts awarded in response to a solicitation for proposals or qualifications, a firm that qualifies as an LBE shall receive additional points during the scoring process, so the final score awarded to the LBE is increased by 5% of the total possible evaluation points.
