Issue Detail: FEMA has approved the award of $1,234,067 in federal funding to the City of Sacramento for resiliency improvements to the Sam & Bonnie Pannell Community Center (Pannell Community Center) from the Fiscal Year 2023 LPDM. Funding is allocated to the City via a subaward

to Cal OES. To proceed with grant acceptance and award, staff seek City Council approval of an updated Cal OES Form 130 designating authorized agents for the project. The recommended actions would allow for acceptance of subaward from Cal OES, authorization of City agents to execute documents with Cal OES for the project, and establishment of project budgets for implementation.

Funding is for the construction of a backup power system at the Pannell Community Center. Together with leveraged funding from the California Air Pollution Control Officers Association, this project includes installation of air filtration upgrades. Improvements will allow for the extended activation and operation of the Pannell Community Center during power outages, as well as activation as a Clean Air Center during wildfire smoke events.

Policy Considerations: The 2021 Local Hazard Mitigation Plan adopted by the City Council in February 2022 (Resolution No. 2022-0034) identifies community centers such as the Pannell Community Center as critical facilities for at-risk populations. This grant application will fund building upgrades that support the resiliency of this facility. Investments will allow for the continuity of shelter services during disasters and extreme climatic events, which are increasing in frequency. Funding also supports the 2040 General Plan Vision Statement and Guiding Principles (Resolution No. 2019- 0433), which commits to proactively prepare for climate change impacts. Previously, City Council Resolution No. 2023-0086 authorized the City’s application for this funding.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): This report involves an administrative action and does not involve activities that constitute a “project” as defined by Sections 15061(b)(3) and 15378(b)(4) of the California Environmental Quality Act (CEQA) Guidelines. Prior to any construction activities, all necessary environmental review for compliance with CEQA guidelines and any applicable federal environmental review requirements will be completed.

Sustainability: This project will improve the sustainability of the Pannell Community Center, which is often activated during emergency events to support the needs of vulnerable populations.

Improvements will enhance the capability of the building to function as an emergency shelter during power outages, disasters, and wildfire smoke events. These efforts will advance the City’s commitment to prepare for the effects of climate change (Resolution No. 2019-0433).

Commission/Committee Action: Not applicable.

Rationale for Recommendation: This funding will support cost-effective implementation of resiliency upgrades at one of the City’s critical facilities in South Sacramento. Funding will improve the reliability of the facility during disaster events and prepare for the impacts of climate change.

Improved functionality of the Pannell Community Center will ensure availability of shelter and clean air services when needed by vulnerable populations.

Financial Considerations: FEMA has awarded the project $1,234,067 in federal funding, which is available to the City as a subaward from Cal OES. A portion of local cash match is already available in the Pannell Community Center Resiliency Project (C15002000) totaling $268,417, including both state and local funds. To cover outstanding local cost share needs, this report recommends moving $148,800 (Fund 1001) from PSAF Generator Upgrades (F13000300) to the Pannell Community Resilience Project (C15002000). In total, these state and local funding sources would meet FEMA’s minimum 25% local cost share requirement. Project funding is summarized in the following table.

Federal funding: FEMA award LPDM23-PJ0006 (75%) $1,234,067 Local cash match (25%)
Pannell Community Center Resiliency Project - California Air Pollution Control Officers Association (CAPCOA) Clean Air Center Grant (C15002000, Fund 1001 & Fund 3702)
$268,417
PSAF Generator Upgrades (F13000300, Fund 1001) $148,800 Subtotal $417,217
Total project cost $1,651,284
State match is provided by a $228,417 Clean Air Center Grant from the California Air Pollution Control Officers Association, which the City has already accepted and allocated to the project (Resolution No. 2023-0222).

Local Business Enterprise (LBE): Not applicable.

Background: In April 2023, City staff applied to the FEMA LPDM Program to access a funding allocation specified by Representative Doris Matsui in the Fiscal Year 2023 Congressionally Directed Spending Requests. Although funding was specifically designated for the Pannell Community Center in the amount of $1,977,200, the City was required to complete a project application for FEMA evaluation prior to accessing the funds. Criteria in the LPDM Program resulted in changes to the project scope of work. The LPDM Program requires 25% local cost share. Due to limitations in eligible tasks and local cash match, the final scope of work reflects a slight reduction from the Fiscal Year 2023 award, with allowable federal costs limited to $1,234,067.

Cal OES Form 130 Instructions
A Designation of Applicant’s Agent Resolution for Non-State Agencies is required of all Applicants to be eligible to receive funding. A new resolution must be submitted if a previously submitted resolution is older than three (3) years from the last date of approval, is invalid, or has not been submitted.

When completing the Cal OES F

Resolution Section:

Governing Body: This is the group resp
onsible for appointing and approving the
Authorized Agents.

Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc.

Name of Applicant: The public entity establis
hed under the laws of the
State of California.

Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California.

Authorized Agent: These are the individuals th
at are authorized by the Governing Body
to engage with the Federal Emergency Management Agency and the California Governor’s Office of Emergency Services regarding grants for which they have applied.

There are two ways of completing this section:

1. Titles Only: The titles of the Authorized Agents should be entered here, not their names. This allows the document to remain valid if an Authorized Agent leaves the position and is replaced by another individual. If “Titles Only” is the chosen method, this document must be accompanied by either a cover letter naming the Authorized Agents by name and title, or the Cal OES AA Names document. The supporting document can be completed by any authorized person within the Agency (e.g., administrative assistant, the Authorized Agent, secretary to the Director). It d
oes not require the Governing Body’s signature.

2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents would be listed. A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document, or their title changes.

Checking Universal or Disaster-Specific Box: A Universal resolution is effective for all past disasters and for those declared up to three (3) years following the date of approval. Upon expiration it is no longer effective for new disasters, but it remains in effect for disasters declared prior to expiration. It remains effective until the disaster goes through closeout unless it is superseded by a newer resolution.

Governing Body Representative: These are the names and titles of the approving Board Members.

Examples include: Chairman of the Board, Director, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents. A minimum of three (3) approving board members must be listed. If less than three are present, meeting minutes must be attached in order to verify a quorum was met.

Certification Section:

Name and Title: This is the individual in attendance who recorded the creation and approval of this resolution.

Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents or Approving Board Member. If a person holds two positions (such as City Manager and Secretary to the Board) and the City Manager is to be listed as an Authorized Agent, then that person could sign the document as Secretary to the Board (not City Manager) to eliminate “Self-Certification.”
