2-Mitigation Fee Act Five-Year Report
Description/Analysis
Issue Detail: The City imposes impact fees pursuant to the Mitigation Fee Act (California Government Code section 66000 et seq., hereafter the Act) on new development for the purpose of defraying all or a portion of the cost of public facilities associated with or required to support new development. The types of development for which impact fees are generally charged include new residential dwelling units, non- residential buildings, and commercial and residential additions or changes in use of existing buildings. These types of development stress existing public facilities and triggers demand for new and improved facilities. Therefore, using impact fee revenues to support the demand for new and improved facilities can provide consistent levels of service for residents.
For the City to charge impact fees, the City is required to identify a reasonable relationship between the need for public facilities and the type of proposed development. In addition, the City may only utilize the fee revenues for the specific type of public facilities for which purpose the fee was paid.
The City establishes separate funds for each impact fee program. When an impact fee is paid, the payment is credited to the appropriate fund. Interest earned on the money in each fund is credited to such fund.
File ID: 2023-01558 1/9/2024 Consent Item 4.
The Act requires that every five years the City report certain information regarding unexpended development impact fees. The Mitigation Fee Act Five-Year Report for the Fiscal Year Ended June 30, 2022 (Attachment 2) fulfills the five-year reporting requirement for the River District Fee Fund.
The report presents the following information as required by the Act:
1. Identifies the purposes to which the fees are to be put.
2. Demonstrates a reasonable relationship between the fees and the purposes for which they have been charged.
3. Identifies all funding sources and amounts of funding anticipated to complete the financing of incomplete improvements, if any.
4. Designates the approximate dates on which the funding of incomplete improvements is expected to be deposited into the appropriate fund or account.
Pursuant to the Act, the report included as Attachment 2 was made available to the public on December 22, 2023.
Policy Considerations: Filing the required five-year report will satisfy the requirements of the Act.

MITIGATION FEE ACT FIVE YEAR REPORT SECTION I
1 SECTION I
INTRODUCTION
The City of Sacramento (the “City”) imposes impact fees pursuant to the Mitigation Fee Act (California Government Code section 66 000 et seq., hereafter the “Act”) on new development for the purpose of defraying all or a portion of t he cost of public facilities associated with or required to support new development. The types of development for which impact fees are generally charged include new residential dwelling units, non- residential buildings, and commercial and residential additions or changes in use of existing buildings. These types of development stress existing public facilities and triggers demand for new and improved faciliti es. Therefore, usin g impact fee revenues to support the demand for new and improved facilities can pr ovide consistent levels of service for residents.
PURPOSE
This report was prepared on behalf of the City to fulfill the five-year reporting requirements set forth in the Act. Section 66001(d) of the Act requires local agencies to report for the fifth fiscal year following the first deposit of impact fees into the account or fund, and every five years thereafter, certain information rega rding unexpended deve lopment impact fee revenue.
This report presents the five-year findings required by the Act for the City’s River District Specific Plan Area Development Impact Fee Program (“River District Fee Program” or “Program”) as of June 30, 2023.
Pursuant to California Government Code section 66001(d), the following requirements are addressed within this report for the Program’s Development Impact Fees (“Impact Fees”):
Identify the purpose to wh ich the fee is to be put.
Demonstrate a reasonable relationship between the fee and the purpose for which it is charged.
Identify all sources and am ounts of funding anticipated to complete financing of incomplete improvements.
Designate the approximate dates on which the identifi ed funding referred to is expected to be deposited into the appropriate account or fund.

2 ORGANIZATION AND CONTENTS OF REPORT
General information for the Program and corresponding Impact Fees follows in Section II.
Information includes the use, pur pose, and relationship of the fee to the public facilities funded by the Program’s Impact Fees. In addition, fund balances for the Program’s Impact Fees are provided as of June 30, 2023. Fund balances for the Program’s Impact Fees have been identified as the “Available Fund Balance” and allocated amongst the incomplete projects in Table 1 of Section II of the report. Please be advised, the Available Fund Balance allocations presented in Table 1 for the Program’s Impact Fees are not dedicated funds for that specific incomplete project. Fund balances will be used for incomplete projects at the City’s discretion based on funding and infrastructure needs, along with consideration for the timing of new development. Outstanding obligations identified in the report include unpaid loans, unused Impact Fee credits earned by developer s, and reimbursement amounts due to developers. Developers can earn Impact Fee credits or are due reimbursements upon constructing impact f ee eligible improvements that exceed the value of the Impact Fees due for their respective development. As of June 30, 2023, the River District Fee Program has no outstanding obligations. Furthermore, Section II provides the following additional information:
A listing of incomplete projec ts and outstanding obligations. An estimate of the remaining co st to complete each project. A breakdown of the sources of funding anticipated for projects. The anticipated fiscal year(s ) as to when funding may be available for the incomplete projects.
A summary of the overall projected revenues and expenditures and estimated shortfall or surplus at completion for the Program’s Impact Fees.
For additional details related to the Program, please see the latest Finance Plan for the Program, which is available on file with the Infrastructure Finance Division of the City’s Finance Department.

RIVER DISTRICT SPECIFIC PLAN AREA IMPACT FEE PROGRAM
The River District Specific Plan Area (the “River District Area”) was established in 2011, and the River District Fee Program was established in 2016 to fund backbone infrastructure improvements in the River District Area of the City, all of which are identified in more detail in the Updated River District Finance Plan (adopted by the Sacramento City Council on February 14, 2017, per Resolution No. 2017-0075). The Rive r District Area is centrally located in the City and is immediately north of the Railyards Specific Plan Area, east of the Sacramento River, south of the American River, and west of the 16 th Street Corridor. Fee
revenues collected from the River District Impact Fee Program are used to fund the design, construction, installation, improvement, a nd acquisition of storm drainage, water, transportation and roadway, open space, light rail transportation stations, library, and public safety facilities and improvements.
TRANSPORTATION IMPACT FEE
New development in the River District Area generates new residents, employees, and patrons that create new vehicl e, bicycle, and pede strian trips. The increase in traffic demands requires expanded roadway capacity and improved connectivity through roadway enhancements to accommodate new development. The purpose of the Transportation Impact Fee is to fund the construction, enhancements, and ex pansion of roadway improvements and facilities that mitigate t he impacts of the additi onal vehicular trips generated by the new development. Roadway improvements funded by the Transportation Impact Fee include construction and expans ion of roadway segments, intersection improvements, freeway improvements, and bi keway improvements. Completion of the roadway improvements is crucial to allow for expanded roadway capacity, which provides the improvements necessary fo r a continued stable flow of traffic which mitigates the impacts of additional vehicle, bicycle, and pedestrian trips resulting from new development.
As of June 30, 2023, the Tr ansportation Impact Fee had a fund bala nce of $4,180,554.
Table 1A below shows a summary of the estimated remaining construction costs along with funding sources for each incomplete project.

STORM DRAINAGE IMPACT FEE
Development planned for the River District Area necessitates enhancements to the current storm drainage system to accommodate development and the anticipated growth. These improvements aim to enhance water quality, limit stormwater runoff, improve efficiency of the existing system, and reduce and prevent flooding in the River District Area. As new developments create additional impervious surfaces, increases in stormwater runoff will be generated, prompting the need for expanded collection and conveyance capacity in the existing storm drainage system. The purpose of the Storm Drainage Impact Fee is to fund Funding

WATER IMPACT FEE
New development in the River District Area generates new residents, employees, and patrons that generate additio nal water consumption demands, necessitating a need for water infrastructure. The existing water supply infrastructure serving the developed River District Area is sufficient, requiring no new transmission lines for water service. The purpose of the Water Impact Fee is to fund the installation of ne w distribution lines crucial for connecting the current water infrastructure system to new developments within the River District Area. The water distribution enhance ments involve the establishment of a more refined grid network of 8- and 12-inch mains located in existing roadway right-of-way. Costs associated with water improvements linked to specific transportation improvements are largely included in the costs of those par ticular transportation improvements. Any miscellaneous water improvements not accounted for in the roadway improvement project costs will be funded by t he Water Impact Fee. Completion of the water improvements Funding

New development in the River District Area generates new residents, employees, and patrons that places additio nal demands for transportation and utility infrastructure, necessitating the orderly construction of necessary roadways and utilities and the linking of new improvements to the existing infrastruc ture grid. Since development in the River District Area is anticipated to occur irregularly, the purpose of the Transportation and Utility Impact Fee is to provide matching, gap, or additional funding for certain transportation and utility costs to avoid piecemeal construction of major roadway facilities. The Transportation and Utility Fee is intended to fund frontage improvements in the circumstance where road frontage improvements are required before adjacent development is prepared to proceed, and to facilitate development of nearby and adjoining parcels using the same utility lines for installation of connection s that will serve future development. Completion of these transportation and utility improvements ensures the orderly construction of roadways and utilities that will accommodate the increased demand and population resulting from new development.
As of June 30, 2023, the Transportation and Utility Impact Fee had a fund balance of $1,024,924. Table 1D below shows a summary of the es timated remaining construction costs that are to be paid by the Transportation and Utility Impact Fees, along with funding sources for each incomplete project.

OPEN SPACE FACILITIES IMPACT FEE
New development in the River District Area generates new residents, employees, and patrons that places additional demands on par k and other recreational amenities. The purpose of the Open Space Facilities Impact Fee is to provide funding for the acquisition of
5.7 acres of open space situated alongside the American River. This acquisition serves a dual purpose: it establishes the appropriate buffer between the American River and the new developments, while also augmenting the impacts placed on the parks and recreational amenities for those in the River District Area. Acquisition of the new open space will provide a recreational amenity that will be primaril y used by the River District Area residents.
As of June 30, 2023, the Open Space Facilities Impact Fee had a fund balance of $340,203.
