Description/Analysis
Issue Detail: In 2004, the City Council adopted Resolution 2004-0122, which pursuant to City Code Chapter 12.40, restricted vehicular and pedestrian traffic through certain alleys in the Dixieanne neighborhood by means of gates. In 2022, the City of Sacramento received a Caltrans Clean California Grant for the Dixieanne Neighborhood Clean and Green Alleys Project which proposed the conversion of several gates to removable bollards to improve pedestrian and bicycle access for

residents while maintaining restricted access for certain motor vehicles. The restriction by use of gates is no longer necessary and restriction by use of bollards is sufficient for the protection or preservation of the public peace, safety, health, or welfare.

Policy Considerations: The recommendation enhances multimodal choices by improving the attractiveness of walking and bicycling to increase travel choices and aid in achieving a more balanced transportation system and reducing air pollution and greenhouse gas emissions (General Plan Policy M 1.2.1). The recommendation also supports the conversion of underused facilities by converting underused rights-of-way facilities for bicyclists and pedestrians (General Plan policy M

5.1.9). The use of bollards as opposed to gates will continue to provide for the protection or preservation of the public peace, safety, health, or welfare.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The Environmental Planning Services section of the Community Development Department has reviewed the proposed restrictions of traffic and determined that the activity is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301(c) and (f) of the CEQA Guidelines in that this activity involves the operation and minor alteration of existing public facilities and topographical features with negligible or no expansion of existing or former use.

Sustainability: The recommendation promotes walkable blocks through a reinvestment project that creates walkable, publicly accessible alley pedestrian routes (General Plan Policy LU 2.7.6). The recommendation also enhances walking and biking through improvements by introducing new pedestrian and bicycle connections (General Plan Policy LU 4.2.1).

Commission/Committee Action: None.

Rationale for Recommendation: Adoption of the recommendation is necessary for complete implementation of the Dixieanne Clean and Green Alleys Project. Adoption of the recommendation will continue to provide for the protection or preservation of the public peace, safety, health, or welfare by restricting certain motor vehicles from use of the alleys for illegal activities while enhancing mobility for pedestrians and bicyclists.

Financial Considerations: There is sufficient funding within the Dixieanne Neighborhood Clean and Green Alleys Project (T15235100) for the removal of the existing gates and installation of removable bollards.

Local Business Enterprise (LBE): Not applicable.

Background: In 2004, property owners and residents that lived adjacent to the subject alleys raised concerns regarding illegal activities occurring within the alleys that led to City Council approval of the restriction of vehicular and pedestrian traffic (R2004-0122) for seven alleys by means of gates for the protection and preservation of the public peace, safety, health, or welfare. The duration of the restriction on these seven alleys is until the City Council finds that such restriction is no longer necessary for the protection or preservation of the public peace, safety, health, or welfare.

In 2022, the City of Sacramento received a Caltrans Clean California Grant for the Dixieanne Clean and Green Alleys Project authorized by City Council (R2022-0021) which included funding to activate selected alleys by converting the existing gates to bollards to maintain the restriction of vehicle through traffic but allow unimpeded access for pedestrians and bicyclists on the alleys to be improved with permeable interlocking concrete pavers and public art.

Five of the seven alleys approved for restrictions under R2004-0122 have been identified for improvement under the Dixieanne Neighborhood Clean and Green Alleys Project. The five subject alleys are:

1. The Alley bounded by Dixieanne Avenue, Oakmont Street, Calvados Avenue and Cambridge Street.

2. The alley bounded by Dixieanne Avenue, Cambridge Street, Calvados Avenue and Beaumont Street.

3. The alley bounded by Dixieanne Avenue, Beaumont Street, Calvados Avenue and Empress Street.

4. The alley bounded by Dixieanne Avenue, Empress Street, Calvados Avenue and Boxwood Street.

5. The alley bounded by Dixieanne Avenue, Boxwood Street, Calvados Avenue and Erickson Street.

The Police Department supports the conversion of the existing gates to bollards in that use of bollards will continue to provide for the protection and preservation of the public peace, safety, health, or welfare as well as to reclaim the public right-of-way for the benefit of the surrounding community.

Additionally, the Fire Department and Public Works Department have no concerns with the conversion.

RESOLUTION NO.

Adopted by the Sacramento City Council

RESOLUTION AUTHORIZING THE MODIFICATION OF EXISTING TRAFFIC

RESTRICTIONS ON FIVE ALLEYS WITHIN THE DIXIENANNE NEIGHBORHOOD OF COUNCIL DISTRICT 2 (T15235100).

BACKGROUND
A. Pursuant to City Code Chapter 12.40, through City Council Resolution 2004-0122 the City Council restricted vehicular and pedestrian traffic through certain alleys by use of gates for the protection or preservation of the public peace, safety, health, or welfare including the following alleys:
a. The Alley bounded by Dixieanne Avenue, Oakmont Street, Calvados Avenue and Cambridge Street (R2004-0122).
b. The alley bounded by Dixieanne Avenue, Cambridge Street, Calvados Avenue and Beaumont Street (R2004-0122).
c. The alley bounded by Dixieanne Avenue, Beaumont Street, Calvados Avenue and Empress Street (R2004-0122).
d. The alley bounded by Dixieanne Avenue, Empress Street, Calvados Avenue and Boxwood Street (R2004-0122).
e. The alley bounded by Dixieanne Avenue, Boxwood Street, Calvados Avenue and Erickson Street (R2004-0122).

B. The Police Department has opined that the protection or preservation of the public peace, safety, health, or welfare for the above listed alleys can be achieved by use of removable bollards to restrict certain motor vehicles.

C. In 2022, the City Council authorized staff to apply for Caltrans Clean California Grant funding for the Dixieanne Neighborhood Clean and Green Alleys Project which included the plan to convert the existing gates to bollards as well as the installation of permeable interlocking concrete pavers, fence repairs, shade tree planting, and public art installation (R2022-0021).

D. In 2022, full funding for the Dixieanne Neighborhood Clean and Green Alley Project was awarded to the City and a Capital Improvement Program was established (R2022-0270).

E. Staff worked with the community to identify the specific alleys in the Dixieanne neighborhood that would receive enhancements with the Clean California Grant funding.

F. Sacramento Fire Department and Sacramento Police Department were consulted regarding the replacement of existing gates with removable bollards.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1: Protection or preservation of the public peace, safety, health, or welfare of the neighborhood can be achieved along the subject alleys with removable bollards that restrict certain motor vehicles through the alleys while allowing pedestrian and bicyclist through they alleys.

Section 2: The restriction of vehicular and pedestrian traffic authorized through resolution 2004-0122 through the alley bounded by Dixieanne Avenue, Oakmont Street, Calvados Avenue and Cambridge Street; the alley bounded by Dixieanne Avenue, Cambridge Street, Calvados Avenue and Beaumont Street; the alley bounded by Dixieanne Avenue, Beaumont Street, Calvados Avenue and Empress Street; the alley bounded by Dixieanne Avenue, Empress Street, Calvados Avenue and Boxwood Street; and the alley bounded by Dixieanne Avenue, Boxwood Street, Calvados Avenue and Erickson Street is modified by use of bollards instead of gates. The Public Works Director is directed to remove the gates and install bollards.

Section 3: The restrictions are approved with the following conditions:
a) A locking security device approved by the City of Sacramento Fire Department will be installed on the removable bollards. b) City departments and utility companies will have twenty-four (24) hour access to their facilities within the alley.
