Additional Description/Analysis
Issue Detail: Under the California Vehicle Code (CVC), a section of a highway or street is a “speed trap” if the prima facie speed limit is not justified by an Engineering and Traffic Survey (E&TS) performed within a specified time period, and the enforcement of the speed limit involves the use of radar or any other electronic device for measuring the speed of moving objects. The evidence of a speeding violation based on a speed trap is inadmissible in court and may result in the inability to prosecute violators in excess of the posted speed limit. In order to ensure compliance with these requirements, the E&TSs have been performed for re-establishing or reducing speed limits on 27 speed zones on various streets. City Council approval through resolution is necessary to re-establish or reduce speed limits on the subject speed zones. Additionally, the previously adopted Resolution 2020-0240 that established citywide posted speed limits must be rescinded and superseded with a new Resolution.

Policy Considerations: The recommendations in this report are consistent with the City’s 2035

Page 1 of 3 ends

General Plan goal (M1.1.2) of managing the travel system to ensure safe operating conditions; and the California Vehicle Code.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The Community Development Department Environmental Planning Services Manager has reviewed the proposed action and determined that this project is exempt from the provisions of the California Environmental Quality Act (CEQA) under Class 1, Section 15301(c) of the CEQA Guidelines. Projects exempted under Class 1, Section 15301(c), consist of the operation, repair, or minor alteration of existing highways, streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities involving negligible or no expansion of use.

Sustainability: The action requested herein is consistent with the City’s long-term sustainability goals to reduce greenhouse gas (GHG) emissions. A reduction in GHG emission can be achieved by establishing speed limits that are representative of the speed of free-flowing traffic conditions.

Commission/Committee Action: None.

Rationale for Recommendation: As required by the CVC, this report recommends re-establishing speed limits on 24 speed zones on various streets and reducing speed limits on 3 speed zones, These recommendations are based on the E&TSs that were performed in accordance with the established traffic engineering practices.

Financial Considerations: The cost associated with performing the speed surveys, manufacturing, and installation of speed limit signs is funded with the Department of Public Works operating budget (Gas Tax Fund, Fund 2002 and Traffic Safety Fund, Fund 2006).

Local Business Enterprise (LBE): Not applicable.

Background: Speed limits in California are governed by Sections 32 (Actions Local Authorities May Take by Resolution), 627 (Engineering and Traffic Surveys), 22348 through 22413 (Speed Laws), 40802 (Speed Trap), and 40803 (Speed Prosecutions) of the CVC. According to CVC Section 40802, a section of a highway or street is a “speed trap” if the prima facie speed limit is not justified by an Engineering and Traffic Survey (E&TS) performed within the specified time period, and enforcement of the speed limit involves the use of radar or other electronic device for measuring the speed of moving objects. Under CVC Section 40803, the evidence of a speeding violation based on a speed trap is inadmissible in court. This could result in the inability to prosecute violators in excess of the posted speed limit. In view of this, the prima facie speed limits on various streets of the City must be determined and established on the basis of an E&TS.

Page 2 of 3 ends

File ID: 2024-00397 2/6/2024 Consent Item 5.

Conducting an E&TS for establishing speed limits is governed by the CVC, and the California Manual on Uniform Traffic Control Devices (MUTCD). When a speed limit is posted on the basis of an E&TS, it should be established using the 85th percentile speed of free-flowing traffic. California MUTCD standard, consistent with CVC Section 22358.6 states that a posted speed limit shall be established at the nearest 5 mph increment of the 85th percentile speed of free-flowing traffic, except for cases in which the nearest 5 mph increment would require a rounding up. In those cases, the speed limit may be rounded down to the nearest 5 mph increment below the 85th percentile speed if no further reduction is used. If additional reduction is applied, then the E&TSs shall document in writing the conditions and justification for the lower speed limit and be approved by a registered Civil or Traffic Engineer. Since the E&TSs are usually valid for a period of 5,7 or 14 years, the City must update the E&TSs for each existing speed zone prior to their expiration date.

In order to ensure compliance with the requirements set forth in the CVC, the E&TSs have been performed for re-establishing speed limits on 27 speed zones on various streets of the City. These 27 speed zones include:
(1) Re-establishing the speed limits for 24 speed zones, and (2) Reducing the speed limit for 3 speed zones
The E&TSs for justifying the proposed speed limits were performed in accordance with the requirements set forth in the CVC, California MUTCD and established traffic engineering practices.

Attachment 1 presents the summary of the E&TSs for each of the 27 speed zones. A brief discussion for each of the proposed speed limits that require justification is presented in Attachment 2.

Based on the background information presented herein, Staff recommends that the City Council adopt a Resolution approving the re-establishment or reduction of speed limits on the 27 speed zones as listed in Attachment 1.

A list of Citywide posted speed limits that are recommended to be adopted as part of a new City Council Resolution is presented in Exhibit A. The subject list incorporates the re-established or reduced speed limits for the 27 speed zones as summarized in Attachment 1.

The previously adopted City Council Resolution No. 2020-0240 for the Citywide posted speed limits will need to be rescinded and superseded with a new Resolution in order to incorporate the re- established or reduced speed limits for the above referenced speed zones.

DESCRIPTION FOR PROPOSED SPEED LIMITS THAT REQUIRE JUSTIFICATION

A. Re-establishing Speed Limits for Existing Speed Zones:

1. Center Parkway (Mack Road to Calvine Road):

The existing speed zone has a posted speed limit of 40 mph. Since the average 85th percentile speed as indicated by an E&TSs is 45.7 mph, this speed zone should be posted at 45 mph. However, this speed zone is characterized by additional pedestrian activity due to residential density and Valley High School and Valley Hi Park within this speed zone, as well as being in the City’s High Injury Network. Therefore, considering pedestrian safety, the recommendation of the City Traffic Engineer is to re-establish the speed limit on this speed zone at 40 mph.

2. Duckhorn Drive (Arena Boulevard to San Juan Road):

The existing speed zone has a posted speed limit of 35 mph. Since the average 85th percentile speed as indicated by an E&TSs is 41.9 mph, this speed zone should be posted at 40 mph. However, this speed zone is characterized by additional pedestrian activity due to Hummingbird Park and residential land use. Therefore, considering pedestrian safety, the recommendation of the City Traffic Engineer is to re-establish the speed limit on this speed zone at 35 mph.

3. El Camino Avenue (East Levee Road to Del Paso Boulevard):

The existing speed zone has a posted speed limit of 30 mph. Since the average 85th percentile speed as indicated by two E&TSs is 37.5 mph, this speed zone should be posted at 40 mph. However, the speed zone is characterized by additional pedestrian activity due to residential density and uncontrolled, marked crosswalks at Edgewater Rd, Hawthorne St, Forrest St, and Cantalier St, as well as being in the City’s High Injury Network. Therefore, considering pedestrian safety and CVC Section 22358.8, the local agency finds that establishing a speed limit at 40 mph would be more than reasonable or safe, therefore the recommendation of the City Traffic Engineer is to re-establish the speed limit on this speed zone at 30 mph.

4. Fruitridge Road (South Land Park Drive to Martin Luther King Boulevard):

The existing speed zone has a posted speed limit of 40 mph. Since the 85th percentile speed as indicated by three E&TS is 46.7 mph, this speed zone should be posted at 45 mph. However, this speed zone is characterized by pedestrian activity due to Belle Cooledge Park, Sutterville Preschool, and Learning Tree Preschool, being on a major bus route, and in the City’s High Injury Network. Additionally, the Fruitridge Light Rail station is located between 24th St and 28th St. Therefore, considering pedestrian safety, the recommendation of the City Traffic Engineer is to re-establish the speed limit on this speed zone at 40 mph.

5. La Riviera Drive (College Town Drive to Watt Avenue):

The existing speed zone has a posted speed limit of 35 mph. Since the 85th percentile speed as indicated by an E&TS is 41 mph, this speed zone should be posted at 40 mph. However, the speed zone is characterized by additional pedestrian activity due to residential density, Glenbrook Park, and uncontrolled, marked crosswalks at Lido Circle, Mediterranean Way, Moorbrook Way, and Glenville Circle, as well as being in the City’s High Injury Network. Therefore, considering pedestrian safety, the recommendation of the City Traffic Engineer is to re-establish the speed limit on this speed zone at 35 mph.

6. Mabry Drive (Maybrook Way to Natomas Boulevard):

The existing speed zone has a posted speed limit of 25 mph. Since the 85th percentile speed as indicated by an E&TS is 31.5 mph, this speed zone should be posted at 30 mph. However, this speed zone is characterized by additional pedestrian activity due to residential density, Westlake Charter School, and Burberry Community Park. Therefore, considering pedestrian safety, the recommendation of the City Traffic Engineer is to re-establish the speed limit on this speed zone at 25 mph.

7. Main Avenue (Kelton Way to Rio Linda Boulevard):

The existing speed zone has a posted speed limit of 40 mph. Since the 85th percentile speed as indicated by an E&TS is 47.2 mph, this speed zone should be posted at 45 mph. However, the speed zone is characterized by additional pedestrian activity due to residential density but there are no sidewalks on portions of this speed zone. Therefore, considering pedestrian

safety, the recommendation of the City Traffic Engineer is to reduce the speed limit on this speed zone to 40 mph.

8. North B Street (Bannon Street to North 16th Street):

The existing speed zone has a posted speed limit of 35 mph. Since the 85th percentile speed as indicated by an E&TS is 41.4 mph, this speed zone should be posted at 40 mph. However, the speed zone is characterized by additional pedestrian activity due to uncontrolled, marked crosswalks at N 10th St and Ahern St and demographic factors including the presence of the unhoused. Additionally, there are no sidewalks on portions of this speed zone. Therefore, considering pedestrian safety, the recommendation of the City Traffic Engineer is to reduce the speed limit on this speed zone to 35 mph.

9. Redding Avenue (Q Street to 850’ North of San Joaquin Street):

The existing speed zone has a posted speed limit of 30 mph. Since the 85th percentile speed as indicated by an E&TS is 35.4 mph, this speed zone should be posted at 35 mph. However, the speed zone is characterized by additional pedestrian activity due to Mae Fong Park and a mid-block uncontrolled, marked crosswalk between 4th Ave and San Joaquin St.

Therefore, considering pedestrian safety, the recommendation of the City Traffic Engineer is to reduce the speed limit on this speed zone to 30 mph.

RESOLUTION NO.

Adopted by the Sacramento City Council

February 6, 2024

RE-ESTABLISHING SPEED LIMITS ON 24 SPEED ZONES, REDUCING SPEED LIMITS ON 3 SPEED ZONES, AND RESCINDING RESOLUTION NO. 2020-0240

BACKGROUND
A. According to California Vehicle Code (CVC) Section 40802, a section of a highway or street is a “speed trap” if the prima facie speed limit is not justified by an Engineering and Traffic Survey (E&TS) performed within the specified time period, and the enforcement of the speed limit involves the use of radar or any other electronic device for measuring the speed of moving objects. Furthermore, the evidence of a speeding violation based on a speed trap is inadmissible in court (CVC Section 40803). This could result in the inability to prosecute violators of the speed limit. In view of this, the prima facie speed limits on various streets of the City must be determined and established on the basis of an E&TS.

Conducting an E&TS for establishing speed limits is governed by the CVC and the California Manual on Uniform Traffic Control Devices (MUTCD). Since the E&TSs are usually valid for a period of seven years, the City must update the E&TS for each existing speed zone prior to their expiration date.

B. In order to ensure compliance with the requirements set forth in the CVC, the E&TSs have been performed for re-establishing speed limits on 24 speed zones and for reducing speed limits on 3 speed zones on various streets of the City.

C. The E&TSs for justifying the proposed speed limits were performed in accordance with the requirements set forth in the CVC, California MUTCD, and established traffic engineering practices.

D. Based on the background information presented herein, staff recommends that the City Council adopt a resolution re-establishing or reducing the speed limits on 27 speed zones.

E. The previously adopted Resolution No. 2020-0240 for the citywide posted speed limits will need to be rescinded and superseded with a new resolution in order to incorporate the recommended speed limits for the above referenced 27 speed zones.

F. A list of citywide posted speed limits that is recommended to be adopted as part of this City Council Resolution is presented in Exhibit A.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. Pursuant to California Vehicle Code Sections 32 (Actions Local Authorities May Take by Resolution), 627 (Engineering and Traffic Surveys), 22352 (Prima Facie Speed Limits), 22357 (Increase of Local Speed Limits to 65 Miles Per Hour), and 22358 (Decrease of Local Speed Limits), the following declared prima facie speed limits (and maximum speed limits) have been established with Engineering and Traffic Surveys and are established as shown in Exhibit A: List of Citywide Posted Speed Limits.

Section 2. Resolution No. 2020-0240 is hereby rescinded.

Section 3. Exhibit A: List of Citywide Posted Speed Limits is hereby incorporated into and is a part of this Resolution.
