Issue Detail: Staff went to City Council on June 13, 2023, to recommend the use of a Request for Qualification (RFQ) process to establish a qualified Contractor list for cleaning and inspection of large

diameter wastewater and storm drainage pipes using a variety of inspecting technologies and equipment. The purpose of the RFQ was to develop a list of qualified on-call Contractors to assist Department of Utilities’ staff in maintaining and inspecting wastewater and storm drainage pipe infrastructure. Upon receiving Statements of Qualification (SOQs), staff proposed to enter into contracts with all Contractors deemed qualified. City Council approved the use of this process with a two-thirds vote.

Policy Considerations: In conformance with City Code 3.64.020, City Council approval is required to execute professional service agreements for services if the amount expended under the agreement is $250,000 or more. Pursuant to the Professional Services Procurement Policy, section.1 (c)(1), when on-call services contracts are used, the amount of the procurement is the cumulative amount of the on-call services contracts if multiple on-call services contracts are being used for the same scope of services. This report was available to the public for a 10-day review in conformance with City Code Section 4.04.020 on February 01, 2024.

Economic Impacts: None.

Environmental Considerations: Per the California Environmental Quality Act (CEQA) approval of the proposed Agreement has been determined to be exempt from CEQA pursuant to CEQA Guidelines Sections 15301 and 15309 (Existing Facilities and Inspections). The work resulting from the Agreement consists of the operation, repair, maintenance and minor alteration of existing facilities and mechanical equipment and inspections to check for quality, health, and safety of facilities and operations.

Sustainability: The proposed contracts are consistent with the 2035 General Plan as they improve infrastructure reliability and sustainability by providing supporting services that help continue operations and address existing safety and health impacts.

Commission/Committee Action: None.

Rationale for Recommendation: On August 2, 2023, staff issued a Request for Qualifications (RFQ) to establish a qualified list of contractors to clean and inspect large diameter wastewater and storm drainage pipes (Q23141311020). On the due date of August 24, 2023, seven Contractors submitted Statements of Qualification (SOQs). A panel of four staff members reviewed and rated the SOQs and determined that all seven Contractors have appropriate experience in aspects of cleaning and inspecting large diameter pipes and are qualified to be on the on-call list. As such, staff recommends that the City enter into agreements with all seven Contractors.

Financial Considerations: After execution of the agreements, services are authorized by issuing a task order from approved budget. Task orders will be managed by staff and the aggregate amount of all task orders shall not exceed $4,000,000 for the total project.

There is sufficient funding for the first year (FY23/24) in the following Department of Utilities budgets:
the Combined Sewer System Management Plan (I14630200) and the Condition Assessment Program (I14010800). Funding of these agreements in future fiscal years will be subject to availability of sufficient funds in the budget adopted for the applicable fiscal year.

There are no General Funds allocated or planned for this work.

Local Business Enterprise (LBE): The requirement for LBE participation has been waived by the Director of Utilities as there are a limited number of contractors that provide these services, with few to no local contractors.

Background: Water utility industry standards and best management practices for preventative maintenance of utility pipe systems includes periodic cleaning and inspection. The Department of Utilities (DOU) does not have the equipment nor the staff necessary to properly clean and inspect large-diameter pipe mains. DOU has an ongoing need to clean, inspect, and assess the condition of large diameter pipes (36” or larger), force mains, and levee pipes. Cleaning and condition assessment of these pipes is necessary to ensure continuation of services to customers, protect public health and safety, protect the environment, and meet federal, state, and local regulations.

The use of On-call Agreements will assist the Department of Utilities in cleaning and inspecting largediameter pipes as the City does not have the proper equipment or staffing to do the specialized work required; or to assist staff in completing scheduled workload in a timely manner. Establishing Agreements with Contractors for these services is a best management practice and allows staff to select Contractors based on their experience and specific available equipment for each task. Upon approval of the Agreements, task orders will be issued to assign specific tasks throughout the term of the contract. Task orders will be sent to all Contractors under the on-call contract for their review and response. Task orders will be assigned based on Contractor responses using a combination of qualification considerations including cleaning experience, inspection experience, ability to provide specific equipment or technologies and experience using them, past performance with the City, schedule availability, and other relevant factors.

Task orders for individual tasks or larger projects will be developed based on need and may include, but are not limited to, cleaning and/or inspection of large diameter pipe, both gravity and force mains, and pipes in or near levees within both the wastewater and storm drainage systems. Task work for emergency pipe cleaning and inspection, regardless of pipe size, may also be issued at the City’s discretion. It is anticipated that the City will utilize these services on tasks where the estimated costs range from $15,000 to $500,000.
