Description/Analysis
Issue Detail: On October 22, 2021, the City, the Regents of the University of California Wexford Development, LLC and the American Federation of State, County, and Municipal Employees Local 3299 (“AFSCME”) executed a term sheet setting forth the obligations of the parties to resolve

AFSCME’s litigation over Aggie Square. These obligations were memorialized in two settlement agreements - one between AFSCME and the Regents and the second between AFSCME and the City. Collectively the settlement agreements obligated the Regents to provide $5 million towards a new AFSCME 3299 Greg McNair UC Workers Housing Fund (“Fund”) to be administered by the City.

The Fund would be used to implement housing stability programs including rent or utility assistance, home repair, and assistance to avoid eviction. The City and AFSCME agreement was approved on November 12, 2021. The agreement was amended on May 22, 2023 to modify the definition of eligible applicants.

City staff have been working with AFSCME representatives on the type of programs the AFSCME membership would find beneficial. To guide this effort and the related Stockton Boulevard Housing Anti-Displacement Program included in the Aggie Square Community Benefit Partnership Agreement, staff conducted individual resident surveys. The survey collected results from 367 individuals within the identified community zip codes surrounding Stockton Boulevard and UC Davis employees in the AFSCME Local 3299 employee union.

As a result of this input, a prioritization emerged for housing stabilization services:
· The proposed $500,000 contract with Step Up on Second Street, Inc. will be known as the Step Up Homeless Prevention, Housing Coordination, Stability and Retention Program. This 12-month contract will aid households who are unsheltered, at risk of losing housing and/or other identified voucher holders who need help covering unexpected household costs, identifying housing options, completing the necessary application process, paying the required application fees, and associated moving/household costs. For more vulnerable households, landlord support and retention services will also be paired with this work.

Eligible applicants are:
1) Individuals whose income is no greater than Moderate Income (120% of area median income) and whose principal place of work or employer is located within census tracts 3,14,15,17.02,18,29,90.10,105.01,105.11 or 2533 and primary residence is within zip codes 95817, 95820, 95824, 95828 (the priority zip codes in the Community Benefit Partnership Agreement which surround Aggie Square, “Local Residents”). 2) Individuals whose primary residence is within the Local Residents zip codes and whose income is no greater than Very Low Income (60% of area median income).

If approved, the contract is envisioned to begin by early March. Marketing and outreach will be coordinated through AFSCME.

Policy Considerations: Appropriation of these funds and the approach of utilizing housing Anti- displacement programming aligns with programs included within the City’s updated Housing Element

of the General Plan and will be coordinated with the ongoing work to develop and implement the Stockton Boulevard Specific Plan.

Economic Impacts: The $5 million allocated for this program will help to provide an inclusive economic development approach to the Aggie Square project, ensuring that local area residents will be provided an opportunity to benefit from the project. It will also benefit the local organizations who will administer the programming.

Environmental Considerations: The actions specified in this report do not constitute a “project” under the California Environmental Quality Act (CEQA) because it is the creation of government funding mechanisms or other government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines section 15378(b)(4). Any individual program that results in any CEQA-qualifying projects would be reviewed separately.

Sustainability: The establishment of the AFSCME 3299 Greg McNair UC Community Housing Fund along with the allocation of resources, will assist in promoting sustainable communities and strengthening the infill areas of Oak Park, Elmhurst, Tahoe Park and other historically underinvested neighborhoods.

Commission/Committee Action: Not Applicable.

Rationale for Recommendation: The Aggie Square development will be an economic boost to the Stockton Boulevard area, the City, and the region by increasing available jobs, education, and training opportunities. However, as part of this growth, the development may result in increased demand on the housing stock immediately surrounding Aggie Square and displacement pressure on existing residents and local AFSCME members.

To address those concerns, the CBPA and AFSCME and SIWD agreements included language regarding the establishment of Stockton Boulevard/Aggie Square anti-displacement programming to assist existing residents and address some of the pressures in the local housing market. The primary focus of the City’s funds will be in areas immediately adjacent to Aggie Square, characterized as the zip code areas of 95817, 95820, 95824, 95828. The funding allocated in this report will establish housing anti-displacement programming, support low-income residents, and strive to maintain a mix of affordability within the Stockton Boulevard area to sustain a healthy, diverse community.

Work under the Fund will complement the array of programs already launched under the Stockton Boulevard Housing Anti-Displacement Program launched in Spring 2023 which include contracts with Step Up, Salvation Army, Habitat for Humanity, and Unseen Heros/CLTRE.

Financial Considerations: On November 12, 2021, two settlement agreements, one between the

City and AFSCME and the second between the Regents and AFSCME, were executed to resolve litigation brought by AFSCME over the Aggie Square project. These agreements required the Regents to provide $5 million to establish the AFSCME 3299 Greg McNair UC Workers Housing Fund to be administered by the City. This report recommends the acceptance of the $5 million from the settlement agreement that the Regents of the University of California is obligated to provide towards the AFSCME Local 3299 to be administered by the City, the establishment of the AFSCME Anti-Displacement Externally Funded Project (E02000120) along with the revenue and expenditure totaling $5 million in the Externally Funded Program Fund (Fund 2703).

The City may recover from the $5 million reasonable administrative fees, not to exceed 6% of the total Project amount.

Local Business Enterprise (LBE): Local non-profit, private, and public agencies will be partnered with for the provision of these anti-displacement programs.

AFSCME Anti-Displacement Housing Program Budget Authority

BACKGROUND

A. On April 13, 2021, the City, the Regents of the University of California ("Regents”), and Wexford Development, LLC (“Wexford”) entered into a Community Benefit Partnership Agreement (“CBPA”) for Aggie Square.

B. The CBPA included the establishment of a Stockton Boulevard Housing Fund of at least $50 million in funding, including a $5 million affordable housing program funded with $2.5 million in philanthropic contributions and matched by $2.5 million over five years by the Regents.

C. On October 22, 2021, the City, the Regents of the University of California (“Regents”), Wexford (“Wexford”), and the American Federation of State, County, and Municipal Employees Local 3299 (“AFSCME”) executed a term sheet setting forth the obligations of the parties to resolve AFSCME’s litigation over Aggie Square. These obligations were memorialized in two settlement agreements: one between AFSCME and the City, and the second between AFSCME and the Regents. These two settlement agreements obligated the Regents to provide the $5 million included in the CBPA towards a new AFSCME 3299 Greg McNair UC Workers Housing Fund (“Fund”) to be administered by the City.

D. On December 14, 2021, the City Council adopted resolution 2021-0359 establishing a new Stockton Boulevard Housing Anti-Displacement Project, including revenue and expenditure budgets in the amount of $5 million. These funds were part of the City’s $50 million Stockton Boulevard Housing Fund committed in the CBPA.

E. On February 7, 2023, utilizing $2 million of the City’s Stockton Boulevard Housing Anti- Displacement Project funds, City staff brought four pilot anti-displacement and housing stabilization programs to City Council to be implemented in the four zip codes (95817, 95820, 95824, 95828) around Aggie Square. These programs ranged in services from home repair, first-time homebuyer assistance, and homeless prevention. Since then, these pilots have operated in the community with great success and positive impact.

F. To fulfill the obligations under the set of agreements between the City, the Regents, and AFSCME the establishment of the 3299 Greg McNair UC Workers Housing Fund

(“Fund”) is being recommended. City staff have been working with AFSCME representatives on the type of programs the AFSCME membership would find beneficial. To guide this effort, the related Stockton Boulevard Housing Anti- Displacement Program included individual resident surveys in the Aggie Square CBPA.

The survey collected results from 367 individuals within the identified community zip codes surrounding Stockton Boulevard and UC Davis employees in the AFSCME Local 3299 employee union. The Fund would be used to implement and expand housing stability programs including rent or utility assistance, home repair, and assistance to avoid eviction.
