Description/Analysis
Issue Detail:
The California Department of Resources Recycling and Recovery (CalRecycle) has established the Senate Bill (SB) 1383 Local Assistance Grant Program to provide funding to local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383. To receive these funds, CalRecycle requires the governing body of the applicant to adopt a resolution authorizing the local jurisdiction to apply for the grant program and identify the job title or his/her designee authorized as the signature authority to execute all documents necessary to implement and secure payment.
On November 14, 2023, City Council approved Resolution 2023-0349, authorizing the Department of Public Works, Recycling and Solid Waste Division (RSW) on behalf of the City to apply for the grant for the estimated grant funding available to the City in a not to exceed amount of $864,034. The application was submitted in a timely fashion and reviewed by CalRecycle.

Following submission of the application, CalRecycle informed the City that because not all jurisdictions applied for the grant, the funds allocated for those jurisdictions plus additional funds that became available will be redistributed to the jurisdictions that did apply. Due to the fact fewer jurisdictions applied than anticipated there is a larger pool of available grant funds that will be distributed to applying agencies that were awarded grant funding. The City is now eligible to receive $1,349,680 in funding instead of $864,034. Staff is bringing forth this Resolution to amend the amount of funding the City is authorized to receive so that CalRecycle can provide those additional funds.
Policy Considerations:
The recommendations in this report are consistent with the City’s General Plan waste diversion goal to encourage recycling and composting to divert organic material from being sent to landfills, and the City’s Climate Action Plan’s strategy to reduce the amount of organic waste sent to landfills and decrease the City’s methane emissions generated by waste.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): No environmental review is necessary because the recommendations in this report involve administrative activity and are not considered to be a project in accordance with Section 15378(b)(2) of the CEQA Guidelines.
Sustainability: Recycling organic material such as yard waste, food waste, and food-soiled paper is required by SB 1383 and reduces the amount of methane emissions generated at landfills. Organic waste can be processed into resources, including compost and mulch, which provide nutrients and temperature regulation to plants, improve water retention, and prevent erosion.
Commission/Committee Action: None.
Rationale for Recommendation: CalRecycle requires the governing body of the applicant to adopt a resolution authorizing submission of the application. Upon award, RSW will use these funds to purchase compost created from the City’s residential organic waste for application at City parks and facilities. RSW will also distribute compost to residents to help the City meet its annual SB 1383 recovered organic waste product procurement target. RSW will hire a waste consultant to conduct residential route reviews to address contamination and recommend methods for providing education and outreach on source-separation as required by SB 1383. RSW also intends to purchase a new side-loader truck to service the increased number of residential customer accounts, ensuring compliance with SB 1383 in neighborhoods that were previously exempt from these services. While Council previously approved the submission of the application to CalRecycle and authorized the City

Manager or the City Manager’s designee to execute all documents necessary to accept the award, the City needs to amend Resolution 2023-0349 to increase the not to exceed amount the City can accept and to increase the revenue and expenditure budgets in the Solid Waste Grant in order to implement the grant award.
Financial Considerations: SB 1383, passed in 2016, established new requirements for organic waste disposal. Compliance requires significant investments by local trash collection agencies. This funding supports funding to meet these requirements. Staff recommends adopting the amended Resolution to receive the additional available funding from the CalRecycle SB 1383 Local Assistance Grant Program (OWR4: FY2022-23) in an amount not to exceed $1,349,680. No matching funds are required.
There are no General Funds planned or allocated to this project.
Local Business Enterprise (LBE): Not applicable.
RESOLUTION NO. 2024-
Adopted by the Sacramento City Council
March 12, 2024
Amend Resolution 2023-0349 for California Department of Resources Recycling and Recovery (CalRecycle) SB 1383 Local Assistance Grant Program
BACKGROUND
A. The State Department of Resources Recycling and Recovery (CalRecycle) has established the Senate Bill (SB) 1383 Local Assistance Grant Program to provide funding to local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383; and
B. In furtherance of this authority CalRecycle is required to establish procedures governing the administration of the SB 1383 Local Assistance Grant Program; and
C. CalRecycle’s SB 1383 Local Assistance Grant Program requires, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of the Grant Program; and
D. The City of Sacramento Department of Public Works, Recycling and Solid Waste Division is seeking this grant program to aid in funding its implementation of regulation requirements associated with SB 1383; and
E. On November 14, 2023, City Council adopted Resolution No. 2023-0349 which authorized the City Manager or City Manager’s designee to: 1) submit an application for the California Department of Resources Recycling and Recovery (CalRecycle) Senate Bill (SB) 1383 Local Assistance Grant Program (OWR4: FY2022-23) in an amount not to exceed $864,034; 2) execute all documents necessary to implement and secure such payment, if awarded; and 3) establish an SB 1383 Local Assistance Grant Program (OWR4 FY2022-23) Grant Project (G15003200) and related revenue and expenditure budgets in an amount not to exceed $864,034 (Solid Waste Grant Fund, Fund 6207), if awarded, to implement regulation requirements associated with SB 1383; and
F. Following the adoption of Resolution 2023-0349, the City Manager submitted an application to CalRecycle seeking funding in a not to exceed amount of $864,034 for the SB 1383 Local Assistance Grant Program; and
G. CalRecycle subsequently informed the City that the application had been reviewed and accepted and the City of Sacramento Department of Public Works, Recycling and Solid Waste Division (RSW) had been awarded funding as part of the SB 1383 Local Assistance Grant Program. At that time, CalRecycle stated that fewer jurisdictions than anticipated applied for an award of funding. Consequently, agencies that did apply would be awarded a larger not to exceed amount of grant funds since more funds were available to jurisdictions that applied and were awarded funding; and
H. On February 15, 2024, CalRecycle informed RSW that the City was eligible to receive $1,349,680 in funding as part of the SB 1383 Local Assistance Program; and
I. Section 3 of Resolution No. 2023-0349 authorizing the City Manager or City Manager’s designee to establish the SB 1383 Local Assistance Grant Project (G15003300), and related revenue and expenditure budgets in an amount not to exceed $864,034 (Solid Waste Grant Fund, Fund 6207) to implement regulation requirements associated with SB 1383 needs to be amended so that the related revenue and expenditure are increased to an amount not to exceed $1,349,680 in order to receive the award.
BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. Section 3 of Resolution 2023-0349 is hereby amended to reflect the correct amount so that the provision now reads: The City Manager or the City Manager’s designee is authorized to establish the SB 1383 Local Assistance Grant Project (G15003300), and related revenue and expenditure budgets in an amount not to exceed $1,349,680 (Solid Waste Grant Fund, Fund 6207), if awarded, to implement regulation requirements associated with SB 1383.
Section 2. Except as amended in Section 1 above, all other sections in Resolution 2023- 0349 shall remain the same and in full force and effect.
