Description/Analysis
Issue Detail: In August 2022, the City Council adopted an ordinance amending Chapter 12.24 of the Sacramento City Code relating to Sidewalk obstructions. As a result of the ordinance amendment, the Department of Community Response (DCR) sought Council approval to suspend competitive bidding in favor of issuing Requests for Proposals (RFP) to further expand a Citywide Cleanup initiative.

In November 2022, DCR issued an RFP to expand citywide cleanup services and in March 2023, awarded Forensiclean a one-year contract in the amount of $4,001,701 to provide cleanup services.

To continue DCR’s efforts to mitigate the impacts of homeless encampments in the City, DCR recommends that City Council approve Supplemental Agreement No. 1 to City Agreement No. 2023- 0375 with Forensiclean LLC in an amount not-to-exceed $4,001,701 to provide cleanup services for an additional year, from April 1, 2024 through March 31, 2025.

Forensiclean will continue to provide cleanup and litter abatement coverage to mitigate the effects of unsheltered homelessness in the City. Currently, Forensiclean responds to requests to cleanup abandoned encampments, as well as provides regular trash service to those currently living in encampments and to City operated respite sites. Forensiclean has built strong relationships with unhoused individuals in our community as well as our non-profit partners. Forensiclean remains a critical partner to the City’s Incident Management Team in their ability to provide an immediate response when targeted outreach is needed.

Forensiclean teams respond to 311 calls throughout the City, 7-days a week, between 7:00 a.m. - 5:00 p.m. This agreement includes five cleanup crews assigned to specific districts for more effective and efficient cleanup efforts, as well as three Citywide crews that respond to designated areas of need and assist the Incident Management Team.

In 2023, Forensiclean responded to nearly 17,000 cases via the City’s 311 system and collected approximately 59,839 cubic yards of trash, or 10,938,524 pounds of trash, the equivalent of 10 Boeing 747 airplanes. Forensiclean currently averages a 16-hour response rate. 311 Trash Calls Closed

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. 2024, in compliance with City Code.

Economic Impacts: None.

Environmental Considerations: This report concerns administrative activities and government fiscal activities that do not constitute a “project” and are not subject to the provisions of California Environmental Quality Act (CEQA) (CEQA Section 15378(b)(2)).

Sustainability: Homeless encampment cleanup services support the safe collection and disposal of waste to reduce impacts of unsheltered homelessness on public health and natural resources.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Services provided under this agreement address the ongoing mitigation of the impacts that homelessness has had on the City.

Time is of the essence in addressing these needs as the current Citywide Cleanup Agreement expires on March 31, 2024.

Financial Considerations: Sufficient funding is available in the Homeless and Community Outreach MYOP (I23004000) to support the recommended budgetary transfer of $1,195,222 (Operating Grants, Fund 2702) to the Community Response MYOP (I23000100). After completion of the recommended transfer, sufficient funding will be available in the Community Response MYOP (I23000100) to execute a supplemental agreement with Forensiclean LLC in amount not-to-exceed $4,001,701. The funding will be supported by Operating Grants (Fund 2702) and by the Measure U Fund (Fund 2401).

Due to the forecasted structural budget gap, the City Manager has directed City departments to minimize costs and for all new contracts to receive an additional level of scrutiny to ensure they are necessary for the operation of the City. This contract has been reviewed and approved by the City Manager’s Office to advance to Council for approval. Funding for the proposed contract beyond FY2023/24 is subject to Council approval.

Local Business Enterprise (LBE): Forensiclean LLC is a business local to the City of Sacramento and is a registered LBE.
