1-Description/Analysis
Description/Analysis
Issue Detail: The Community Development Department (CDD) and the Sacramento Police Department (SPD) have an operational requirement for heavy duty tow services. On an annual basis, the City of Sacramento tows approximately over 380 heavy duty (Class C & D) vehicles and vessels for various types of violations. The volume of heavy-duty tows has increased over the past several years as CDD and the Police Department continue to remove heavy duty vehicles that are abandoned, dangerous, dismantled, or inoperable.
The request to suspend competitive bidding and authorize CDD to use an on-call Request for Qualification process will provide the option to add new companies to the existing rotation after the RFQ closes and agreements are executed.

Providing CDD the ability to continuously increase tow companies on the heavy-duty tow rotational list will reduce response times when code enforcement officers call to remove a vehicle and the overall time it takes to remove an abandoned, dismantled, wrecked or inoperative vehicle from city streets. A large pool of tow companies on the tow rotation also provides relief to the tow companies as the number of heavy-duty vehicles abated increases. The California Vehicle Code requires tow companies to store abandoned, dismantled, dangerous, wrecked and inoperative vehicles for a minimum of 15 days after towing, reducing their ability to store vehicles due to a lack of space on their property.
Policy Considerations: CDD recommends the suspension of competitive bidding and use of an on- call RFQ process to evaluate and select experienced, qualified tow service companies on a rotational basis and add new tow companies on a continuous basis. City Code section 3.56.230(C) authorizes the City Council to suspend competitive bidding for any purchase or contract when, upon a two-thirds vote, the City Council determines it is in the best interests of the CITY to do so.

Rationale for Recommendation To authorize CDD to use an on-call Request for Qualification process will provide the option to add new companies to the existing rotation after the RFQ closes and agreements are executed. This will provide the ability to continuously increase tow companies on the heavy-duty tow rotational list which will reduce response times when code enforcement officers call to remove a vehicle and the overall time it takes to remove an abandoned, dismantled, wrecked or inoperative vehicle from city streets. It will provide opportunities for new companies to establish business relations in our City that qualify to be added to the existing list, and the addition of tow companies as needed on the tow rotation also provides relief to the existing tow companies as the number of heavy-duty vehicles abated increases. The California Vehicle Code requires tow companies to store abandoned, dismantled, dangerous, wrecked, and inoperative vehicles for a minimum of 15 days after towing, reducing their ability to store vehicles due to a lack of space on their property.
Financial Considerations: Not applicable.
Local Business Enterprise (LBE): The minimum LBE participation requirement will be waived as the CITY will suspend competitive bidding and utilize an alternate procurement method to select vendors.
