Description/Analysis
Issue Detail: Staff recommends Council retroactively ratify Change Order No. 3 with Navajo Pipelines, Inc. for the City Agreement No. 2023-1315, to perform work on a time and materials basis to do additional traffic control, saw cutting, potholing, excavation, and trench backfill to install the dewatering well discharge piping that was needed to lower the groundwater levels in the area to perform the sewer replacement. This change order was previously authorized and approved by the Assistant City Manager, but after further review, the change order amount exceeded the $250,000 accumulative approval authority that was previously set by Resolution 2023-0382, and therefore should have received City Council approval to compensate the Contractor for the work.

Excluding Change Order No. 1, which was approved with Resolution 2023-0382, the accumulative amount with Change Order No. 3 is $408,494.04, which exceeds the $250,000 approval authority, as shown below.

Additionally, staff recommends Council authorize the City Manager or the City Manager’s Designee to execute Change Order No. 4 with Navajo Pipelines, Inc. for the City Agreement No. 2023-1315 for additional effort to remove the dewatering well discharge piping, and the additional paving required to meet City Standards and to provide a good riding surface. The City directed the Contractor to increase the paving limits beyond the typical trench restoration due to the narrow proximity between trenches, the edge of the trench pave in the driving lane wheel path, and the poor pavement conditions that continued to unravel as the Contractor worked up against it. In total, the compensation for this change order was $264,441.36.
Policy Considerations: This Change Order exceeds the City Manager’s approval authority and requires Council approval.
Economic Impacts: This Change Order is expected to create 1.06 total jobs (0.61 direct jobs and
0.45 jobs through indirect and induced activities) and create $163,275.35 in total economic output ($102,913.70 of direct output and another $60,361.65 of output through indirect and induced activities).
The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.
Environmental Considerations: This project was determined to be exempt from the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines governing existing facilities, in that it meets the definition of restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety.
Sustainability:
The proposed project is consistent with the 2040 General Plan goal, PFS-3.1, as it aims to continue

to provide reliable wastewater utility services to the residents throughout the city.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: Change Order No. 4 is needed to provide compensation for all the labor, equipment, markup, surcharges, and fees associated with the additional work required to remove the dewatering discharge piping performed between January 1, 2024, and January 31, 2024, and the additional paving efforts that were performed between February 12, 2024, and February 23, 2024. This value exceeds the approval authority of $250,000 for change orders that was set in Resolution 2023-0382.
Financial Considerations: The original not-to-exceed amount of the contract was $249,999.00.
The net change by previous change orders, in the amount of $1,386,394.04, increased the contract not-to-exceed amount to $1,636,393.04. Proposed Change Order No. 4 in the amount of $264,441.36 would increase the contract not-to-exceed amount to $1,900,834.40. There are sufficient funds in the Separated Pipe Rehabilitation/Replacement Program (X14160500, Fund 6006) to execute this Change Order.
