Additional Description/Analysis
Issue Detail: As provided in Sacramento City Code Chapter 12.16 and California Vehicle Code Section 21101.4 and pursuant to City Council Resolution 2022-0319, the City Council extended the temporary closure of the subject alleys/streets to through vehicular and pedestrian traffic for 18

months determining the closure extensions would assist in preventing the occurrence or reoccurrence of serious and continual criminal activity. The City Council may extend temporary closures for up to eight additional periods of up to 18 months if the extension would assist in preventing the occurrence of reoccurrence of serious and continual criminal activity. This request for an eighteen (18) month extension is the second of potentially eight authorized extensions. The subject alleys/streets will remain physically closed to through vehicular and pedestrian traffic once the closure extensions for these subject alleys have been approved by the City Council. The adjacent property owners overwhelmingly support the temporary closure status of the subject alleys/streets due to the continual criminal activity. The Police, Fire, and Public Works Departments support and recommend the 18-month time extension of the existing temporary closures of the subject alleys and streets as listed in Exhibit A and Exhibit B of the attached Resolution.

Policy Considerations: The procedures under which the closure to vehicular and pedestrian traffic is initiated are set forth in Vehicle Code Section 21101.4 and Sacramento City Code Chapter 12.16.

These codes allow the temporary closures of alleys and streets to through vehicular and pedestrian traffic for the protection or preservation of the public peace, safety, health or welfare. The temporary closures are consistent with the Public Work’s Strategic Plan vision statement, “The Department of Public Works strives to preserve and enhance quality of life”.

Economic Impacts: None
Environmental Considerations:

California Environmental Quality Act: Temporary closures of streets and alleys constitute a minor alteration of a public facility, with no increase in use and no additional automobile lanes.

The action is categorically exempt from CEQA review pursuant to CEQA Guidelines section 15301(c).

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: Adoption of the attached Resolution will provide the continued security of the adjacent properties by eliminating the opportunity for individuals to commit illegal acts and illegal dumping within these subject alleys and streets.

Financial Considerations: The estimated cost for processing this time extension request is approximately $18,000. Typically, these costs would be covered through the Alley Abatement Program (T15100900); however, ongoing expenses to maintain existing assets have exceeded available program funding. These costs will be absorbed by the Fiscal Year 2023/24 Department of Public Works, Engineering Services Division’s operating budget.

Page 2 of 4 ends

File ID: 2024-00579 4/9/2024 Public Hearing Item 17.

Due to the forecasted structural budget gap, the City Manager has directed City departments to minimize costs and for all new General Fund expenses to receive an additional level of scrutiny to ensure they are necessary for the operation of the City. This expense has been reviewed and approved by the City Manager’s Office to advance to City Council for approval. Funding for the proposed expense beyond FY2023/24 is subject to City Council approval.

Local Business Enterprise (LBE): Not applicable.

Background: The subject alleys/streets are public rights-of-way that were once unrestricted to through vehicular and pedestrian traffic. Due to the continued illegal activity such as burglary, prostitution, vandalism, and illegal dumping the City Council approved initial 18 month closures of the subject 108 alleys/streets to through pedestrian and vehicular traffic. Pursuant to Council Resolution 2022-0319, the temporary closures of these alleys/streets were extended for 18 months. That initial 18 month extension is close to expiration. To maintain the temporary closure status of these alleys/streets for an additional (18) months requires City Council approval. The temporary closures were processed pursuant to State Vehicle Code 21101.4 and City Code Section 12.16. The alley/street locations are included as Exhibits A and B.

Extension of a temporary closure of streets requires that certain criteria be met:

1. Continuation of the temporary closure will assist in preventing the occurrence or reoccurrence of the serious and continual criminal activity found to exist when the immediately preceding temporary closure was authorized. This finding shall be based upon the recommendation of the police department.

2. The street has not been designated as a through highway or arterial street.

3. Vehicular or pedestrian traffic on the street contributes to criminal activity.

The Police Department, Fire Department and Department of Public Works support the temporary closure time extensions as provided in Attachments 2, 3, and 4.

The approval of the time extension for the temporary closures requires that the security devices, wrought iron gates, locking mechanisms, electric gates, bollards and non-standard gates be maintained by the responsible parties as described in the initial temporary closure.

The temporary closure time extension of the subject alleys/streets listed are not-to-exceed eighteen (18) months unless the closures are extended pursuant to the procedures set forth in Sacramento City Code Chapter 12.16. Pursuant to Sacramento City Code Chapter 12.16, once approved, the closures may be extended up to an additional eight (8) consecutive periods of not more than eighteen (18) months each. Noticing to the public regarding the temporary street closures has been

CT: CLEARANCE FOR THE TEMPORARY CLOSURE, TIME EXTENSION OF 108 ALLEYS/STREETS LOCATED IN COUNCIL DISTRICTS 2, 3, 4, 5, 6 & 7
In reference to the requested Temporary Closure time extension of the subject alleys/streets in Council Districts 2, 3, 4, 5 , 6 and 7, I have reviewed the material of the subject rights -of-way. I find that the subject alleys/streets are under the City of Sacramento’s jurisdiction and the temporary closures of the subject areas do not include through highways or arterial streets. It also appears that maintaining the temporary closures will allow adequate and safe traffic circulation on the adjacent streets . The Department of Public Works supports the temporary closure time extension request of the subject alleys/streets, per Exhibit A and Exhibit B.

RESOLUTION 2024-XXXX

Adopted by the Sacramento City Council

April 9, 2024

Temporary Street Closure Time Extension of 108 Alleys/Streets in Council Districts 2, 3, 4, 5, 6 and 7 Proceeding No. TSC24-0001

BACKGROUND

A. The City previously approved the Temporary Closure of the 108 subject alleys/streets in Council Districts 2, 3, 4, 5, 6 and 7. The council districts were realigned, and several Temporary Closures now exist in district 7. This request is for the second 18 month time extension of the 108 active Temporary Closures. The first eighteen month extension was authorized by City Council Resolution 2022-0319.

B. In accordance with Section 21101.4 of the Vehicle Code of the State of California and with Chapter 12.16 of the Sacramento City Code, the City Council hereby considers approval of the extensions of the temporary street closures to through vehicular and pedestrian traffic of the subject alleys/streets identified in Exhibit A of this resolution to help prevent occurrences of crime-related activities.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

SECTION 1.

Based upon substantial evidence present in the record of the proceedings regarding this matter, City Council hereby makes the following findings:

A. The extensions of the closures of the 108 subject alleys/streets to vehicular and pedestrian traffic will assist in preventing the occurrence or reoccurrence of the serious and continual criminal activity that was found to exist when the 108 alleys/streets were initially closed.

B. The alleys/streets recommended for closure are under the City's jurisdiction and have not been designated as a through highway or arterial street.

C. Vehicle or pedestrian traffic in the alleys/streets recommended for closure contributes to the criminal activities that are occurring there.

Resolution YYYY-XXXX Month XX, 202X Page 2 of 3
D. The alleys/streets closures will not adversely affect traffic flow, safety on the adjacent streets or in the surrounding neighborhoods, the operation of emergency vehicles, the performance of municipal of public utility services, or the delivery of freight by commercial vehicles in the vicinity of the alleys/streets recommended for closure.

SECTION 2.

The extensions of the temporary closures of the subject alleys/streets identified in Exhibit A of this resolution to through vehicular and pedestrian traffic are necessary for the protection or preservation of the public peace, safety, and health or welfare of the neighborhoods.

SECTION 3.

Under Vehicle Code Section 21101.4 of the California Vehicle Code, all temporary closures are valid for 18 months except for when this period has been extended for an additional 18 months of not more than eight additional consecutive periods by resolution.

SECTION 4.

The City Council approves the extensions of the temporary closures of the subject alleys/streets identified in Exhibit A to through vehicular and pedestrian traffic for up to an additional 18 months from their current expiration dates as provided below with the following conditions.

A. A locking security device approved by the Sacramento Fire Department will be installed on each gate.

B. City departments and utility companies will have twenty-four-hour access to their facilities within the alleys/streets.

C. Adjacent property owners may be granted access to the alleys/streets through the security device that has been approved by the City’s Department of Public Works.

D. In the event that the traffic control device(s) requires construction by a private entity for improvements in the public rights-of-way, a revocable encroachment permit must be obtained from the Department of Public Works. The revocable encroachment permit may be issued subsequent to this Resolution but must be obtained prior to the construction of improvements in the alleys/streets.

SECTION 5.

Exhibits A and B are attached and are a part of this Resolution.
