Additional Description/Analysis
Issue Detail: Both the alley located west of 60 Nedra Court and a portion of Morning Star Drive at Morrison Creek were previously temporarily closed prior to 2010. Both temporary closures have

expired. Closure of both the alley west of 60 Nedra Court and a portion of Morning Star Drive at Morrison Creek will assist in preventing the occurrence or reoccurrence of serious and continual criminal activity. The Police Department, Fire Department and Department of Public Works support these temporary closures.

Policy Considerations: The procedures for the temporary closure to vehicular and pedestrian traffic are set forth in the Vehicle Code Section 21101.4 and Sacramento City Code Chapter 12.16 allowing the temporary closure for the protection or preservation of the public peace, safety, health or welfare.

The temporary closure will improve and expand public safety and enhance livability.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The Community Development Department, Environmental Planning Services section has reviewed the proposed temporary street and alley closures and determined that the activity is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301(c) of the CEQA Guidelines in that this temporary street closure involves a minor alteration of an existing public facility, with no additional automobile lanes and no expansion of use beyond what currently exists. Access to the street will be given to appropriate departments and agencies.

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: The approval of the temporary closure of the alley west of 60 Nedra Court and a portion of Shining Star Drive at Morrison Creek will provide security for the adjacent property owners and area residents by reducing opportunities for individuals to commit illegal acts such as drug use, vandalism and illegal dumping. Notices were sent to all adjacent properties and the Department of Public Works received a majority of support from the respondents to keep the gates and maintain the temporary closures.

Financial Considerations: The estimated cost for processing these temporary closure requests is approximately $6,000. Typically, these costs would be covered through the Alley Abatement Program (T15100900); however, ongoing expenses to maintain existing assets have exceeded available program funding. These costs will be absorbed by the Fiscal Year 2023/24 Department of Public Works operating budget.

Due to the forecasted structural budget gap, the City Manager has directed City departments to minimize costs and for all new General Fund expenses to receive an additional level of scrutiny to

ensure they are necessary for the operation of the City. This expense has been reviewed and approved by the City Manager’s Office to advance to City Council for approval. Funding for the proposed expense beyond FY2023/24 is subject to City Council approval.

Local Business Enterprise (LBE): Not applicable.

Background: The City Council previously approved the temporary closure of the alley west of 60 Nedra Court and a portion of Shining Star Drive through City Council Resolutions 2003-0872 and 2006-0494. The alley west of Nedra Court was approved for temporary closure in 2003. That temporary closure has expired.

The Temporary Closure of a portion of Shining Star Drive restricts pedestrian and vehicular traffic across Morrison Creek to Phoenix Park Housing. The Temporary Closure of a portion of Shining Star Drive was approved in 2006 and has since expired. Although the temporary closures expired, the gates were never removed. In addition, through a separate revocable permit the alley west of Nedra Court has been used as outdoor space for an adjacent childcare center. The adjacent property owners and residents have been notified and a majority of the residents who responded do not object to keeping the gates and maintaining the temporary closure. The Police, Fire, and the Public Works Departments support the temporary closures for both locations detailed in this report.
