Issue Detail: The adjacent property owners have requested the temporary closure of the alleys to help deter illegal activity such as theft, vandalism, drug use and illegal dumping. Both alleys currently have two existing gates that meet city standards for temporary closure by way of restricting pedestrian and vehicular traffic. The adjacent property owners and residents do not object to the

requested temporary closures. The Police, Fire, and the Public Works Departments support these temporary closures.

Policy Considerations: The procedures for the temporary alley closure to vehicular traffic are set forth in the Vehicle Code Section 21101.4 and Sacramento City Code Chapter 12.16 allowing the temporary closure for the protection or preservation of the public peace, safety, health or welfare. The temporary closure will improve and expand public safety and enhance livability.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The Community Development Department, Environmental Planning Services section has reviewed the proposed temporary street and alley closures and determined that the activity is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301(c) of the CEQA Guidelines in that this temporary street closure involves a minor alteration of an existing public facility, with no additional automobile lanes and no expansion of use beyond what currently exists. Access to the street will be given to appropriate departments and agencies.

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: Temporary closure of both alleys will provide security for the adjacent properties that abut the alley for 18 months by reducing opportunities for individuals to commit illegal acts such as theft, vandalism, drug use and illegal dumping. Notices were sent to all adjacent properties and the Public Works Department has not received any objections to the temporary closure of either alley. The temporary closures can be extended an additional 18 months with City Council approval.

Financial Considerations: The estimated cost to process the temporary closure of the subject alleys is approximately $6,000. Typically, these costs would be covered through the Alley Abatement Program (T15100900); however, ongoing expenses to maintain existing assets have exceeded available program funding. These costs will be allocated to the Fiscal Year 2023/24 Department of Public Works operating budget.

Due to the forecasted structural budget gap, the City Manager has directed City departments to minimize costs and for all new General Fund expenses to receive an additional level of scrutiny to ensure they are necessary for the operation of the City. This expense has been reviewed and approved by the City Manager’s Office to advance to City Council for approval. Funding for the

proposed expense beyond FY2023/24 is subject to City Council approval.

Local Business Enterprise (LBE): Not applicable.

Background: The subject alleys are public rights-of-way that provide access to the adjacent properties that have encountered elements of criminal activity such as theft, vandalism, drug use and illegal dumping. To address these issues the Public Works Department received a request for temporary closure to restrict pedestrian and vehicular traffic through the subject alleys. Wrought iron gates to secure the alleys have been constructed to city standards which preceded the City Council’s approval for closure. Once approved the temporary closure of these alleys will be valid for (18) months from the time of initial approval. To maintain the temporary closure beyond the initial (18) month period will require City Council approval per State Vehicle Code 21101.4 and City Code Chapter 12.16 which provide for up to eight (8) additional extensions of not more than (18) months each. Noticing to the public regarding the temporary closures has been completed prior to this City Council meeting in accordance with City Code Section 12.16.220.

Temporary closure of streets requires that certain criteria be met:

1. The temporary closure will assist in preventing the occurrence or reoccurrence of the serious and continual criminal activity found to exist when the immediately preceding temporary closure was authorized. This finding shall be based upon the recommendation of the police department.

2. The street has not been designated as a through highway or arterial street.

3. Vehicular or pedestrian traffic on the street contributes to criminal activity.

Support for the temporary closures in addition to meeting the criteria for this action is provided as Attachments 3, 4, and 5 by the Police Department, Fire Department, and Public Works Department, Transportation Division, respectively.
