Description/Analysis
Issue Detail: The Fire Department (FD) Training Division has received a donation request from American River College (ARC), a community college within the Los Rios Community College District (LRCCD), to donate surplus Self-Contained Breathing Apparatus (SCBA) 4.5 Air Packs and associated parts. The Training division has determined that 47 SCBAs are in various states of disrepair or are no longer supported (parts, maintenance, etc.). The SCBAs are now surplus to the City's needs and, if not donated, will be offered for sale at public auction where it would be expected to have minimal sales value due to not meeting current NFPA recommendations/edition updates; therefore, will be little, if any, market for a Fire Department or emergency response. By donating to an educational program, the SCBAs can be utilized to teach basic operations and familiarization procedures. In addition, the FD will donate an inventory of proprietary SCBA parts to assist with ongoing repair/maintenance of the 47 SCBAs that the manufacturer no longer supports. Refer to attachment 2 of the inventory list that is requested to be donated. Due to the SCBAs' age and the

high use volume, no serial numbers or asset ID tags are legible.

Policy Considerations: City Code, Chapter 3.80.030 (F), provides that surplus personal property may be donated to any other public agency organization exempt under section 501(c)(3) of the Internal Revenue Code by resolution of the City Council. The recipient LRCCD meets this criterion, making the organization eligible for donated surplus items.

Economic Impacts: None.

Environmental Considerations: Ongoing administrative maintenance activities, such as purchases of supplies, equipment, or materials that are not made for purposes of a public construction project, do not constitute a "project" and are exempt from the California Environmental Quality Act (CEQA) CEQA Guidelines, Section 15061(b) (3), 15378(b) (2).

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: The Fire Department (FD) Training Division has received a donation request from ARC, a community college within the LRCCD, to donate surplus Self- Contained Breathing Apparatus (SCBA) 4.5 Air Packs. The Training division has determined that the SCBAs are in various states of disrepair or are no longer supported (parts, maintenance, etc.). The SCBAs are now surplus to the City's needs and, if not donated, will be offered for sale at public auction where it would be expected to have minimal sales value due to not meeting current NFPA recommendations/edition updates; therefore, will be little, if any, market for a Fire Department or emergency response. Therefore, this report recommends donating the SCBAs and associated parts to ARC.

Financial Considerations: In their current condition, the salvage value of the SCBAs is estimated at approximately $500 each if the City were to sell them at a public auction. However, the 47 SCBAs are more than moderately used, more than fifteen (15) years old, and no longer meet NFPA recommendations/edition updates; therefore, they cannot be used in the front line for a Fire Department or emergency response. Authorizing and executing the hold harmless agreement would protect the City from any further financial liability associated with the donated SCBAs.

Local Business Enterprise (LBE): Not Applicable.
