2 - Supplemental Agreement
Description/Analysis
Issue Detail: SCS Engineers (SCS) provides professional engineering support services to ensure compliance with landfill regulations. The second Supplemental Agreement will extend the term of the agreement through September 27, 2027, and increase the budget by $163,599 for a new not-to- exceed amount of $368,699. These funds will be used to continue the engineering consulting services that SCS provides for landfill closure, monitoring, and reporting work. Both the Sacramento County Environment Management Department Local Enforcement Agency (County LEA) and the California Department of Resources Recycling and Recovery (CalRecycle) also require a certified engineer to develop, review, and sign these reports.
Policy Considerations: The recommendations in this report are in accordance with Sacramento City Code section 3.64.040 which requires Council approval for a supplemental agreement that increases the
File ID: 2024-01026 5/28/2024 Consent Item 5.
agreement amount to $250,000 or more.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): This report concerns administrative activities and government fiscal activities that do not constitute a “project” and is not subject to the provisions of CEQA (CEQA Guideline Sections 15060(c)(3), 15378(b)(2), and 15378(b)(4)).
Sustainability: Appropriate monitoring and management of former landfill sites is intended to prevent potential pollution and hazards.
Commission/Committee Action: None.
Rationale for Recommendation: Certified engineering consultant services are necessary for the City to fulfill its ongoing regulatory obligations with its multiple closed landfill sites. Besides assisting the City with regulatory reporting, SCS is involved in addressing several outstanding requests for compliance related to the City’s closed landfills. As a result, a sizable portion of the agreement’s current budget is being used to respond to these compliance requests from regulatory agencies.
RSW staff recommends Council approve Supplemental Agreement No. 2 with SCS to replenish the budget, establish a contingency amount for future regulatory concerns, and extend the agreement’s term for one additional year.
Financial Considerations: The second Supplemental Agreement will increase the not-to-exceed amount by $163,599 which accounts for extending the contract term by one additional year to September 27, 2027, reconciling the costs of several unexpected requests for compliance, and setting aside a contingency amount for future compliance measures at the City landfills. This increase sets the new not-to-exceed amount to $368,699. There is sufficient funding available to execute this Supplemental Agreement in the Landfill Site Closure Project (Y14000100), the 28th St Landfill Regulatory Project (Y15000100), and the Commercial Waste Compliance MYOP (I15220000).
Local Business Enterprise (LBE): SCS Engineers is not an LBE. This agreement was awarded under RFQ EV00000031 for On-Call Environmental Services, which was a competitive procurement conducted by the City’s Economic Development Department in 2019. This RFQ required consultants to submit their Local Business Enterprise certification status. LBE firms were given 5 additional points on the evaluation criteria worksheet.

August 16, 2023 File No. 010743223 City of Sacramento C/O Mr. Chris Thoma 2812 Meadowview Road Sacramento, CA 95832 Subject: Proposal Work Plan for Mitigation of Gas Exceedance at Probe S-21D 28th Street Landfill, Sacramento, CaliforniaDear Mr. Thoma: SCS Engineers (SCS) is submitting this proposal to the City of Sacramento (City) to prepare a work plan to attempt to mitigate and lower the methane concentration in S-21D to within the compliance limit of less than 5 percent by volume. SCS proposed following scope of work to assist the City with development of the work plan. SCOPE OF WORK Based on an initial assessment of available methane concentration data from S-21D, adjacent gas management and monitoring infrastructure, and supplemental information provided by the City, SCS will prepare a work plan for modifications to the gas collection system intended to lower the methane concentration in S-21D to within the compliance limit. Specifically, SCS believes that high groundwater has flooded the vertical landfill gas extraction wells adjacent to S-21D and has significantly restricted gas collection in the area. Specifically, SCS proposed the work plan to provide necessary guidance and direction for making modifications to landfill gas extraction well E-144 to include an in-casing water extraction pump. The goal of the modification will be to automatically draw down the water within E-144 in order to open up the casing screens and allow gas to be extracted. The work plan will propose an observation time frame to assess efficacy of the E-144 modification prior to proposing an alternate remediation effort. COMPENSATION SCS will complete the scope of work for a time and materials not-to-exceed fee of $7,500. This budget is intended to cover draft preparation of the work plan and necessary comment/response cycles with the City and Regional Water Quality Control Board (RWQCB) to obtain approval. This budget is does not include any services beyond obtaining work plan approval from the RWQCB. Any change in scope requested by the City could result in an increase in fees. SCS will contact the City prior to performing any additional services. Fees will be billed on a time and materials (T&M) basis.
Mr. Thoma August 16, 2023 Page 2 SCHEDULE SCS will provide the City with a draft to the City for review by August 25, 2023 and assumes the initial submittal will be provided to the RWQCB by September 4, 2023. CLOSING SCS appreciates the opportunity to continue providing professional services to the City. Please contact Mike Bradford if you have any questions or require additional information for any aspect of this proposal reference with this Phase I work plan at the earliest possible time is appreciated. Task 434 – S-21 Compliance IssueBackgroundIn 2020, methane exceedances were detected in probe S-21-D. After initial mitigation steps did not yield sustained results, the City installed three new LFG extraction wells within the vicinity of S-21-D which were ultimately successful at lowering the methane exceedance. Then on July 27, 2023, methane was detected again in probe S-21-D, reaching a peak level of 77% methane. After reporting this exceedance to the LEA, the City prepared and implemented four work plans, known as Phase I – IV, to achieve compliance with Title 27 which states that e is noncompliant if gas readings exceed 5%. These work plans are the subject Task 434 – S-21 Compliance Issue. Task 434 Creation – $67,867.00 Task 434 was created to address the most recent methane exceedances detected at S-21-D since July 27, 2023. Starting on August 9, 2023, the scope of work and compensation for Task 434 were discussed through a series of email correspondences between Chris Thoma, the City’s Integrated Waste Planning Superintendent, and Michael Bradford, Project Director of SCS Engineers. A subsequent work plan proposal was submitted by SCS Engineers on August 16, 2023, which serves as the starting point of all engineering services rendered for the most recent methane exceedances at S-21-D. Phase I Work Plan – September 5, 2023 – $5,232.50 1. Sound extraction well E-144 and probe S-21D for the presence of water.2. If water is present in E-144, remove water and install a submersible water pump to maintain waterlevels low enough to keep well screens unsubmerged.Phase II Work Plan – October 30, 2023 – $5,748.00 1. Connect LFG probes S-21-D and S-21-R to the LFG collection system—S-21-D will be connected for only 48 hours and S-21-R will be connected continuously.2. Install water extraction pumps into LFG extraction wells VW-142 and VW-143 to aid in localizeddrawdown of groundwater in the vicinity of S-21-D.3. Reroute and improve LFG collection at MW-1, MW-2, and MW-3 by installing a closed isolation valvebetween MW-3 and MW-4 and connecting MW-1, MW-2, and MW-3 to a nearby header to the westfor better vacuum.Phase III Work Plan – December 8, 2023 – $52,168.00 Cost Breakdown: Planning DesigningReviewing Reporting $10,955.00 $21,911.00 $9390.00 $9912.001. Continue implementation of Phases I and II corrective actions.2. Design and install a 39-waste mass withoutpunching into native soil below the mass. This new extraction well will be placed northwest of wellE-144 and probe S-21-D.Phase IV Work Plan – January 26, 2024 – $4,718.50 1. Continue implementation of Phases I, II, and III corrective actions.
2. Closely monitor the new LFG extraction well, E-145, and the overall LFG extraction system over a 60-day period after going online.3. If readings at probe S-21-D plateau or trend upwards, the City will do the following:i. Connect probe S-21-D to the LFG collection system for 48 hours to evacuate gas in the immediate pore space around the probe.ii. Design and install a second ve 3117 Fite Circle, Suite 108, Sacramento, CA 95827 | 916-361-1297 | Fax 916-361-1299 Environmental Consultants & Contractors
