Description/Analysis
Issue Detail: On-Call contracts are often established to augment staff during times of peak workload, to provide specialized work, and work on essential facilities. The purpose of using a Request for Qualifications (RFQ) process is to develop a list of qualified on-call general contractors that will be solicited to assist the facilities staff in delivering projects using a variety of delivery methods, including design build, design assist and standard bid / build. Projects may include, but are not limited to public buildings and facilities, public safety facilities, community centers, libraries, park facilities, pools, corporation yards, and offsite improvements. Appropriate contract and City Council approvals will be required prior to execution of a contract for a specific project.

The existing contracts for the Current On-Call General Contractor Services List for Public Works, Facilities Maintenance Division, were previously approved by City Council on May 14, 2019 (Motion No. 2019-0138) and expired in May 2024. A new On-Call General Contractor Services List is required to be approved to continue the “best practice” for cost effective and efficient project delivery.
Policy Considerations: The recommendation in this report is in accordance with City Code Section
3.60.170(D), which states that the restrictions and provisions of the City Code requiring the award of contracts by competitive bidding shall not apply when, upon two-thirds vote of the City Council, it is determined that it is in the best interests of the City to suspend competitive bidding for any contract.
As currently defined, competitive bidding means awarding to the low bidder, regardless of qualifications. Using RFPs, proposals are submitted and considered through a competitive process whereby the most qualified cost-effective vendors are selected for potential use on future projects.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): This report concerns the suspension of competitive bidding and authorization to issue an RFQ for construction services. Such actions are exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15378(b)(2) of the CEQA Guidelines because they amount to continuing administrative activities and pursuant to Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty there is no possibility that the activity in question may have a significant effect on the environment. Prior to approval of contracts for construction services, appropriate environmental review under CEQA will be completed.
Sustainability: Not applicable.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: The use of the On-Call General Contractor Services List will assist the Facilities Division in delivering projects during times of peak workload; when specialized work is required; or when operations within essential facilities are being interrupted. Establishing On-Call general contractor lists are considered best management practices. Appropriate contract and City Council approvals will be obtained prior to execution of a contract for a specific project.
On February 26, 2024, staff issued Request for Qualification for On-Call General Contracting Services (Q24014541001). A total of ten responses were received. A selection committee, comprised of City staff from the Department of Public Works, reviewed the proposals. Committee members selected firms by scoring each based upon criteria that was identified in the RFQ. The top-ranked

eight firms are recommended to be placed on the On Call General Contractors List, refer to Exhibit A for a list of the general contractors.
Financial Considerations: There are no financial considerations associated with this report. Prior to the execution of a contract for a specific project, available funds must first be secured.
Local Business Enterprise (LBE): The vendors identified in Exhibit A may or may not be an LBE.
The minimum LEB participation requirement is waived as the City has suspended competitive bidding and utilized an alternate procurement method to select vendors.
