Description/Analysis
Issue Detail: The Sacramento Employment and Training Agency (SETA) is a joint powers authority (JPA) of the City and County of Sacramento that was formed in 1978 and has been operating under the current Joint Exercise of Powers Agreement (Agreement) since 1988 (City Agreement No. 87293). SETA is a leading agency in advancing economic mobility for Sacramento residents. They offer children and family services, community programs and resources, and workforce development services.

Councilmembers Guerra and Vang are the two City Councilmembers appointed to the five-member SETA Governing Board. On April 8, 2024, Councilmember Guerra, in partnership with Councilmember Vang, provided direction to staff to work with the County of Sacramento on an amendment to the Agreement that includes the following:

1. Give the SETA governing board the sole authority to appoint and dismiss SETA’s executive director.

2. Expand the SETA governing board from five members to seven members.

A. The seven members will consist of two members appointed by the board of supervisors; two members appointed by the city council; and three public members jointly appointed by the board and the council.

B. Of the three public members appointed jointly by the board and council:
(1) one member must represent a labor organization; this member must have experience operating an apprenticeship program.
(2) one member must represent the business community; this member must be a high- level executive of a private employer in Sacramento county. (3) one member must represent a community college district in Sacramento county; this member must have experience with apprenticeship programs, early childhood education programs, or certificate programs.

C. Provide that the jointly appointed public members will serve one-year terms.

D. Provide that the office of the incumbent jointly appointed public member will terminate immediately as of the effective date of the amendment.

3. Provide that only the members appointed unilaterally by the Board of Supervisors and the City Council may serve as chairperson and vice-chairperson.

A. Provide that each year the chairperson must alternate between a member appointed unilaterally by the Board of Supervisors and a member appointed unilaterally by the City Council.

4. Provide SETA the authority to enter into contracts up to the federal simplified acquisition threshold, which is currently $250,000, without Board of Supervisors or City Council approval.

5. Provide that the amendment is effective July 1, 2024.

Staff has worked with Councilmembers Guerra and Vang and the City Attorney’s Office to draft the attached First Amendment to the Agreement (Attachment 2).

Policy Considerations: The City of Sacramento and County of Sacramento are the two members of the SETA joint powers authority initially formed in 1978 and therefore both parties must approve amendments to the Agreement.

Economic Impacts: None.

Environmental Considerations: The proposed action is not a project under CEQA because it relates to government administrative activities that do not involve any commitment to a specific

project which may result in a potentially significant physical impact on the environment. (Cal. Code Regs., tit. 14, §§ 15060(c)(3), 15378(b)(4)).

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: The current Agreement has been in effect since 1988. The proposed amendments update the Agreement to better align with SETA’s current work and ensure that the governing board has the experience to guide policy that is reflective of community and employer needs.

Financial Considerations: No fiscal impacts to the City.

Local Business Enterprise (LBE): Not applicable.
