Additional Description/Analysis
Issue Detail: Staff is presenting for Council review the emergency construction contract, City Agreement C2024-0966 with Steve P. Rados, Inc. for an amount not to exceed $249,999 to perform the emergency repair work required to mitigate the sinkholes and underground voids that have formed at the intersection of 5th Street and Crate Avenue that make it unsafe for vehicle traffic.

Additionally, due to the anticipated complexity of the work, staff recommend that City Council authorize the City Manager or City Manager’s designee to execute contract change orders up to $250,000.

On April 24th, 2024, City Operations and Maintenance staff responded to reports of a small sinkhole at the intersection of 5th Street and Crate Avenue when a City vehicle’s rear axle descended into a separate sinkhole approximately thirty feet away. The sinkhole conditions were severe enough for the City to close the roadway to all traffic. Due to the severity of the sinkhole and the risk that it creates

for the health, safety, and wellbeing of the public, the City has deemed this to be an emergency and proceeded to move forward with the emergency contracting process per City Code 3.60.070. On May 7th, 2024, City staff met on site with general contractor, Steve P. Rados, Inc., to discuss the issue and to provide them with authorization to proceed with investigation and repairs. The intersection remains closed for the contractor to identify the source and severity of the sinkhole and conduct all necessary repairs.

Additionally, located in the same intersection where the sinkholes have formed includes sewer and drainage connections to the City’s combined sewer system, as part of the Northwest Land Park development, also known as, “The Mill,” completed in 2017. Currently, the sewer and drainage tie-ins have failed and are experiencing the same settlement that is causing the sinkholes.

This project aims to eliminate further settlement on 5th Street and Crate Avenue, bring the combined system to the current City standards by eliminating the structural risks associated with existing geotechnical conditions, and ensure all residential properties retain proper utility services. The project will also include traffic control, dewatering, excavation, backfill, and surface restorations.

Policy Considerations: This action is consistent with City Code Section 3.56.260, which authorizes the City Manager to enter into emergency contracts up to $250,000 and requires the City Manager to present a report to Council describing the emergency, the actions taken, and the emergency contracts that were executed.

Economic Impacts: This project is expected to create 1.00 total jobs (0.58 direct jobs and 0.43 jobs through indirect and induced activities) and create $154,358.75 in total economic output ($97,293.50 of direct output and another $57,065.25 of output through indirect and induced activities).

The indicated economic impacts are estimates using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.

Environmental Considerations: This project is exempt from the California Environmental Quality Act (CEQA) under Class 1, Section Number 15301(d) of the CEQA Guidelines governing existing facilities, in that it meets the definition of restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety.

Sustainability: The proposed project is consistent with the 2040 General Plan policy PFS-3.1, “Provision of Adequate Utilities,” as it improves infrastructure reliability in the combined sewer

system, reduces further maintenance costs, and addresses existing safety and health impacts.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: City Code Section 3.56.260 allows for the City Manager to negotiate and contract for public projects without advertising for bids when public interest and necessity demand immediate action, repair or replacement to safeguard life, health, or property, to permit the continued conduct of city operations or services, or to mitigate further damage.

An emergency contract was necessary in this instance to ensure that repairs were conducted in a timely manner to prevent the sinkholes from causing any health and safety risks to the pedestrian and vehicle traffic. Steve P. Rados, Inc. was contacted and selected to perform the emergency repair work in compliance with Section 8-10, “Payment by Cost and Percentage” of the City’s Standard Specifications.

An emergency project was created for this issue to track staff time and any other expenses related to the sinkholes at 5th Street and Crate Avenue. City staff has identified funding from the fund reserves that it plans to use to provide for these expenses.

Financial Considerations: Sufficient funds exist in the Combined Collection System Rehabilitation & Replacement Program (X14170100, Fund 6006) to award a contract to Steve P. Rados, Inc. for an amount not-to-exceed $249,999.

There are no General Funds allocated or planned for this project.

Local Business Enterprise (LBE): LBE requirements are suspended for contracts that are emergency in nature, however, Steve P. Rados, Inc. qualifies as an LBE.
