Description/Analysis
Issue Detail: The Department of Youth, Parks, & Community Enrichment (YPCE) is seeking approval to award a construction change order to Saenz Landscape Construction Company in the amount of $58,536 for the Robertson Park Restroom Replacement Project. The additional work includes, over excavation of three feet of unsuitable soils for prefabricated restroom pad and installation of compacted aggregate base to replace unsuitable soils, removal and replacement of 969 square feet of existing concrete around the proposed building, installation of additional electrical improvements which includes installation of a new Musco sports field lighting controller, rearranging existing and new electrical components in the restroom chase to meet California Electrical Code. Robertson Park is a 9.18-acre park site, located at 3525 Norwood Avenue, Council District 2. This project is expected to be completed in Summer 2024.

Policy Considerations: City Code Chapter 3.60.210 provides that public construction contracts over $250,000 but less than $1,000,000 requires City Council approval for change orders exceeding 10%.

File ID: 2024-01334 7/30/2024 Consent Item 14.

Robertson Park Restroom Replacement Change Order No. 2 will exceed 10% of the original contract amount.

Economic Impacts: Not applicable.

Environmental Considerations: The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Guidelines, as it consists of the operations, repairs and minor alterations of existing public facilities, mechanical equipment, and topographic features (City Park).

Sustainability: Robertson Park Restroom Replacement Project has been reviewed for consistency with the goals, policies, and targets of the City’s 2040 General Plan, the 2018 YPCE Strategic Plan, the existing Parks and Recreation Master Plan 2005-2010 and Draft Parks Plan 2040.

The Draft Parks Plan 2040 incorporates policy guidelines that ensure new park development and existing park improvements address the principle of Sustainability. Specifically, to incorporate sustainable landscaping and facilities that limit water usage and energy consumption, such as drought tolerant landscaping and low impact development.

Policy 4.7: Support the reuse and wise use of resources in parks.

Policy 4.8: Reduce water use and support water conservation in parks.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Change Order No. 2 in the amount of $58,536 is a result of unforeseen issues during construction of the Robertson Park Restroom Replacement Project. The soil at restroom location was determined by a Geotechnical engineer to have unsuitable soil. They recommended over excavation of unsuitable soil. The soil removed will be replaced with compacted aggregate base. In addition, the contractor will remove and replace an additional 969 square feet of concrete paving around this restroom. The existing paving does not meet the Americans with Disabilities Act (ADA). The new paving will meet ADA requirements. Finally, the installation of additional electrical improvements is required. This cost includes installation of a new Musco field lighting controller.

Financial Considerations: The original contract not-to-exceed amount was $378,536. Change Order No. 1 in the amount of $12,122 was approved on April 8, 2024. Proposed Change Order No. 2, in the amount of $58,536 would increase the contract not-to-exceed amount to $449,194. There is sufficient funding in the Robertson Park Restroom Replacement Project (L19190100) budget to approve Change Order No. 2.

Local Business Enterprise (LBE): Saenz Landscape Construction exceeded the 5% LBE participation requirement.
