2-Change Order No. 3 to Contract No. 2023-1530
Description/Analysis
Issue Detail: East Portal Park is a 7.38-acre community park located at 1120 Rodeo Way, Planning Area 6, Council District 4.

On November 14, 2023, the contract with Pride Industries One, Inc. for the East Portal Park Restroom Renovation Project (L19188100) for the renovation of the existing restroom building, including an accessible concrete walkway in the amount of $262,882 was executed. The work consists of renovating the existing restrooms, and includes demolition, walls and ceilings, metal fabrication, doors and hardware, skylights, electrical, lighting, plumbing, restroom fixtures, painting, caulking, sealant, signage, replacement of existing concrete walkways and building permit coordination.

Change Order No. 3 in the amount of $13,867 is to install an exterior disconnect and ringed meter as required by SMUD to connect new 3-wire electrical power; and to extend the toilet service (one

regular portable, one ADA portable and one hand wash station, serviced 3x per week) due to the estimate 4-6-month lead time on to SMUD extend 3-wire power to restroom building.

Change orders 1 and 2 totaled $24,580 were within the City Manager’s authority. An additional amount of $13,867 will increase the contract amount to $301,329 which exceeds the City Manager’s change order authority of 10% of the original contract price. The East Portal Park Restroom renovations are expected to be complete by late Fall 2024.

Policy Considerations: City Code Chapter 3.60 provides that City Council approval is required for change orders in total that exceed 10% of the original contract amount.

Economic Impacts: Not applicable.

Environmental Considerations: The change order has been reviewed for compliance with the requirements of the CEQA as a project component of the East Portal Park Restroom Renovation Project (L19188100). The project was exempt from environmental review under California Environmental Quality Act Guidelines under State Class 1 and Sections 15301. The project consists of the operation, repair and minor alteration of existing public facilities, mechanical equipment or topographical features involving negligible or no expansion or former use (City Park).

Sustainability: The East Portal Park Restroom Renovation Project has been reviewed for consistency with the goals, policies, and targets of the City’s Climate Action Plan for Internal Operations 2016 Update, the 2040 General Plan, the 2018 YPCE Strategic Plan, and the Parks and Recreation Master Plan 2005-2010. The park will advance the goals, policies, and targets of these plans by reducing greenhouse gas emissions and air pollution through the addition of trees and improving the health of all residents through access to a diverse mix of wellness activities. The restroom renovation will include sustainable design and maintenance guidelines, including water/energy efficient appliances.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Approval of Change Order No. 3 is necessary to complete the restroom renovation project.

Financial Considerations: Sufficient funding is available in the East Portal Park Restroom Renovation Project (L19188100) to execute Change Order No. 3 in the amount of $13,867 with Pride Indistries One, Inc.

Local Business Enterprise (LBE): Pride Industries One, Inc. exceeded the 5% LBE participation requirement.
