Description/Analysis
Issue Detail: Staff recommends Council review the emergency construction agreement with Florez Paving, for the repairs of the sewer main and void identified beneath the Accessory Dwelling Unit (ADU) located at 1713 Burnett Way.

On Thursday, May 16, 2024, City Operations and Maintenance crews reached out to the Engineering staff to inform them that while attempting to assist the property owner on a failed sewer service connection to the main, a large void was detected beneath the ADU at 1713 Burnett Way. The alignment of the sewer main runs along the back side of several backyards and is aligned directly beneath the ADU. City crews were attempting to assist the property owner by sealing failed sewer service internally, but there was a large chunk of concrete in the pipe at the location of the failed sewer service connection. Crews first needed to push the concrete debris to the nearest manhole to remove it. During the attempt to remove the debris where efforts were aided by a closed-circuit

television (CCTV) camera, the camera fell through a damaged portion of the pipe and was stuck inside the void beneath the ADU.

Due to safety concerns stemming from the integrity of the foundation and extents of the void beneath the cantilevered section of the ADU, City staff reached out to Florez Paving to examine the situation and determine if they would be able to perform the emergency work necessary to secure the slab of the ADU, retrieve the CCTV camera, repair the sewer pipe, and fill the void. Florez Paving agreed that they could do the work and mobilized on site immediately. The final cost of the work was $35,000, which was determined using the Cost and Percentage Payment method from section 8-10 of the City’s Standard Specifications.

Policy Considerations: Per City Code 3.56.260, “Emergency Purchases,” upon the award of a contract from this section, the city manager shall present a report to the city council, at the next available meeting of the council, describing the emergency, the actions taken, and the number and cost of contracts entered into with outside vendors and contractors.

Economic Impacts: This change order is expected to create 0.14 total jobs (0.08 direct jobs and

0.06 jobs through indirect and induced activities) and create $21,610.23 in total economic output ($13,621.09 of direct output and another $7,989.14 of output through indirect and induced activities).

Environmental Considerations: This project has been determined to be exempt from the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines governing existing facilities, in that it meets the definition of restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety.

Sustainability: The proposed project is consistent with the 2040 General Plan policy PFS-3.1, “Provision of Adequate Utilities,” as it improves infrastructure reliability in the combined sewer system and reduces further maintenance costs.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: City Code Section 3.56.260 allows for the City Manager to negotiate and contract for public projects without advertising for bids when public interest and necessity demand immediate action, repair or replacement to safeguard life, health, or property, to permit the continued conduct of city operations or services, or to mitigate further damage.

An emergency contract was necessary in this instance to ensure that repairs were conducted in a timely manner to prevent the void beneath the ADU from becoming a safety hazard, and furthermore, to prevent the combined sewer wastewater from potentially creating a health hazard. Florez Paving was selected to perform the emergency repair work in compliance with Section 8-10, “Payment by

Cost and Percentage” of the City’s Standard Specifications.

Financial Considerations: The proposed agreement is for an amount not-to-exceed $35,000.

Sufficient funding exists in the Wastewater Operating Budget (Fund 6006) to award the agreement.

There are no General Funds allocated or planned for this project.

Local Business Enterprise (LBE): Florez Paving is an LBE.
