RESOLUTION NO. 2024-
Adopted by the Sacramento City Council
September 17, 2024
ADOPTING FINDINGS OF FACT AND CONDITIONS OF APPROVAL FOR THE LARGE LOT TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY ±30.52 ACRES INTO THREE LOTS IN THE MULTI-UNIT DWELLING (R-3A-PUD) ZONE AND SINGLE-UNIT DWELLING OR DUPLEX DWELLING ZONE (APN 053-0180-053-0000) (P23-018)
BACKGROUND
A. On August 8, 2024, the City Planning and Design Commission conducted a public hearing on the Delta Shores East Phase Project and forwarded to the City Council a recommendation to approve the Project (P23-018).
B. On September 17, 2024, the City Council conducted a public hearing, for which notice was given under Sacramento City Code Section 17.812.010 and 17.812.030.
BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. Based on the verbal and documentary evidence received at the hearings on the Delta Shores Planned Unit Development (P23 -018), the City Council approve the Large Lot Tentative Map and Site Plan and Design Review of the map attached as Exhibit C, based on the findings of fact set forth below:
Section 2. 200-Year Flood Protection: The project site is within an area for which the local flood -management agency has made adequate progress (as defined in California Government Code section 65007) on the construction of a flood-protection system that, for the area intended to be protected by the system, will result in flood protection equal to or greater than the urban level of flood protection in urban areas for property located within a flood- hazard zone, as demonstrated by the SAFCA Urban Level of Flood Protection Plan and Adequate Progress Baseline Report and the SAFCA Adequate Progress Toward an Urban Level of Flood Protection Engineer’s Report, each accepted by the City Council on June 21, 2016 (Resolution No. 2016-0226), and the SAFCA 2023 Adequate Progress Annual Report accepted by the City Council on October 24, 2023 (Resolution N o. 2023- 0337).
F. The Large Lot Tentative Map to subdivide to subdivide approximately ±30.52 acres into three lots in the Multi-Unit Dwelling (R-3A-PUD) zone and Delta Shores Planned Unit Development approved based on the following findings of fact:
1. None of the conditions described in City Code section 17.828.090 and Government Code section 66474 exist with respect to the proposed subdivision as follows:
a. The proposed map is consistent with the General Plan, all applicable community and specific plans, Title 17 of the City Code, and all other applicable provisions of the City Code;
b. The design and improvement of the proposed subdivision is consistent with the General Plan, all applicable community and specific plans, Title 17 of the City Code, and all other applicable provisions of the City Code as conditioned; c. The site is physically suitable for the type of development; d. The site is physically suitable for the proposed density of development; e. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat;
f. The design of the subdivision and the type of improvements are not likely to cause serious public health problems;
g. The design of the subdivision and the type of improvements will not conflict with easements, acquired by the public at large, for access through, or use of, property within the proposed subdivision.
2. The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan, all applicable community and specific plans, Title 17 of the City Code, and all other applicable provisions of the City Code (Gov. Code §66473.5);
3. The discharge of waste from the proposed subdivision into the existing community sewer system will not result in a violation of the applicable waste discharge requirements prescribed by the California Regional Water Quality Board, Central Valley Region, in that existing treatment plants have a design capacity adequate to service the proposed subdivision (Gov. Code §66474.6);
4. The design of the proposed subdivision provides, to the extent feasible, for future passive or natural heating and cooling opportunities (Gov. Code §66473.1); and
5. The City has considered the effect of the approval of this Large Lot Tentative Map on the housing needs of the region and has balanced these needs against the public service needs of its residents and available fiscal and environmental resources (Gov. Code §66412.3).
G. The Site Plan and Design Review of the Map is approved based on the following findings of fact:
1. The design, layout, and physical characteristics of the proposed development are consistent with the General Plan and any applicable specific plan or transit village plan, in that the subdivision promotes efficient infill development and growth in an existing urbanized area by facilitating the development of an underutilized property with new housing, a park, and needed sewer infrastructure near light rail, shopping center, increasing retail viability, adding to the housing diversity of the neighborhood, and promoting a walkable, bike- friendly neighborhood.
2. The design, layout, and physical characteristics of proposed development are consistent with all applicable design guidelines and with all applicable development standards or, if deviations from design guidelines or development standards are approved, the proposed development is consistent with the purpose and intent of the applicable design guidelines and development standards, in that the design and layout of the subdivision make efficient use of the under-developed property.
3. All streets and other public access ways and facilities, parking facilities, and utility infrastructure are adequate to serve the proposed development and comply with all applicable design guidelines and development standards, in that the tentative map satisfies all development standards and can be adequately served by public infrastructure.
4. The design, layout, and physical characteristics of the proposed development are visually and functionally compatible with the surrounding neighborhood, in that the proposed lot sizes will facilitate the development of high density residential, a park, and a sewer lift station, consistent with the surrounding area, and near regional commercial uses and Morrison Creek Light Rail Station.
5. The design, layout, and physical characteristics of the proposed development ensure energy consumption is minimized and use of renewable energy consumption is encouraged, in that the project facilitates the efficient use of underutilized land within an existing urbanized area. Staff recommends that the project, to the extent possible, incorporate green building methods in the construction of structures.
6. The design, layout, and physical characteristics of the proposed development are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance, in that the proposed tentative map will facilitate development that is compatible with uses found in the surrounding neighborhood.

Parks
F51. Development Agreement Amendment: Upon amendment to the Development Agreement, the development is required to meet the Parkland Dedication Requirement of 3.5 acres per 1000 residents for the remainder of the maximum buildout of 5,222 residential units. The Quimby obligation is based on the number of residential units proposed in the Delta Shores PUD EIR, which at the time of the EIR, the parkland dedication for the PUD was approximately 52 acres of public parkland dedication. The currently approved 1,191 single family units and 235 attached units’ final tentative maps were required to dedicate at the rate of 5.0 acres per 1,000 residents resulting in a parkland in the amount of 21.247.
F52. The 4
th Development Agreement Amendment would allow the Development to dedicate based on the maximum density permitted under the zoning, instead of the maximum buildout under the EIR. The planned additional development allows for 1,719 single- family detached unit s and 1,938 attached units. Consistent with City Code 17.512, the parkland dedication requirement at 3.5 acres per 1,000 residents results in a parkland dedication requirement in the amount of 30.678 acres.
Therefore, in addition to the previously approved final maps’ parkland dedication at
5.0 acres per 1,000 in the amount of 21.247 acres, the total parkland dedication requirement for Delta Shores PUD based on the maximum residential density permitted by zoning code is 51.925 acres.
F53. Tentative Parcel Map: The planned additional development allows for 1,719 single- family detached units and 1,938 attached units. Consistent with City Code 17.512, the parkland dedication requirement at 3.5 acres per 1,000 resident results in a parkland dedication requirement in the amount of 30.678 acres. If, at any time, building permit(s) are requested for more than 1,719 single-family detached units and 1,938 attached units, the then owner of the parcel(s) shall be required to pay an additional in-lieu fee at that time based on the additional dwelling units. The amount of the fee shall be determined according to the then applicable provisions of the City Code, and payment shall be made prior to issuance of the certificate of compliance.
A note to this effect shall be placed on the tentative parcel map.
F54. Park Dedication – IOD: Pursuant to Sacramento City Code Chapter 17.512 (Parkland Dedication) the applicant shall provide on City’s form an irrevocable offer of dedication (IOD) of the parks sites identified on the tentative map as Lot P -10, comprising 10.98 acres. At the time of delivery of the IOD, the applicant shall (1) provide to City a title report demonstrating that it holds full and clear title to Lot P-10, including all interests necessary for maintenance and access; (2) provide a Phase 1 environmental site assessment of Lot P-10; (3) if the environmental site assessment identifies any physical conditions or defects in Lot P-10 which would interfere with its intended use as a park, as determined by PPDS in its sole discretion, applicant shall complete a supplemental assessment and remedy any such physical condition or defect, to the satisfaction of PPDS; and (4) take all actions necessary to ensure that Lot P -10 are free and clear of any wetland mitigation, endangered or threatened animal or plant s pecies, sensitive habitat or other development restrictions. The applicant shall be solely responsible, and at its sole cost, for any required mitigation costs or measures associated with Lot P -10. Note: For parkland dedication calculation, a buildable acre is a typical acre of the subdivision, with a slope less than 10%, and on which building is not excluded because of flooding, public rights-of-way, easements, or other restrictions.
F55. Improvements: The applicant shall construct the following public improvements prior to and as a condition of City’s acceptance of the park/parkway site(s):
a. Lot P-10 should be located on Cosumnes River Boulevard with a vehicular and pedestrian access point from the right of way. Residential and retail/commercial/office spaces adjacent to park and shall have “eyes on park” for increased security and safety. Pr ovide public access through off -street trails or right-of-way linkages from public parks to other private open spaces. b. Full street improvements for Lot P-10 including but not limited to curbs, gutters, accessible ramps, street paving, streetlights, and sidewalks; and improved surface drainage through the site.
c. A concrete sidewalk and vertical curb along all street frontages that open onto Lot P -10. The sidewalk shall be separated from the curb (detached) for community and regional parks unless otherwise approved by PPDS. d. A six foot high masonry wall, or alternative combination of material such as tubular steel and block wall, as approved by the City PPDS on property lines separating public park from adjacent private uses. The material shall be approved by PPDS.
e. A twelve inch (12") storm drain stub and six inch (6") sanitary sewer stub to the back of the sidewalk at a location approved by PPDS for future service.
Number of stubs and locations to be approved by PPDS. Storm Drain and Sewer stubs are to be marked with a 3' high, white 4" x 4" post indicating stub or service location.
f. One water tap for irrigation, one water tap for domestic water, and electrical and telephone service, quantity and location as approved by PPDS. The irrigation water tap shall be 4 inches for parkland 4 acres and over; and the domestic water tap shall be 1 inch. Water taps and telephone and electrical services shall be marked with a 3' high, white 4" x 4" post indicating stub or service location.
g. A ten-foot (10') wide driveway at a location approved by PPDS. The driveway is to provide future maintenance access to the park.
h. The Applicant shall rough grade as required by City Code to provide positive drainage as approved by PPDS.
i. Lot P -10 shall not contain ‘LID’ features for the purpose of collecting stormwater without the approval of PPDS.
j. Site Plan: The applicant shall submit a site plan and electronic file showing the location of all utilities on the park/parkway sites to the PPDS for review and approval.
F56. Design Coordination for PUE’s and Facilities: A buildable acre is a typical acre of the subdivision, with a slope less than 10%, and on which building is not excluded because of flooding, public rights -of-way, easements, or other restrictions. If a 12.5 foot public utility easement (PUE) for underground facilities and appurtenances currently exists or is required to be dedicated adjacent to a public street right-of- way contiguous Lot P-10, the applicant shall coordinate with PPDS and SMUD regarding the location of appurtenances within the PUE to minimize visual obstruction in relation to the park(s) and to best accommodate future park improvements. The applicant shall facilitate a meeting(s) with SMUD and PPDS prior to SMUD’s facilities coordinating meeting for the project. Note: Any PUE and underground facilities and appurtenances shall be reduced from the parkland acreage.
F57. Multi-Use Trail: A multi- use trail and adjacent landscaping shall be dedicated and constructed as specified below and in compliance with the PPDS “Park Design Guidelines” available by contacting PPDS.
a. Location and width of trail: The multi -use trail shall be dedicated either as an IOD or as an easement, as approved by PPDS. At the time of dedication, the applicant shall (1) take all actions necessary to convey to and vest in the City full and clear tit le to the multi -use trail, including all interests necessary for maintenance and access; (2) provide a title report and title insurance insuring that clear title in fee is vested in the City at the time of dedication; (3) provide a Phase 1 environmental si te assessment of the multi -use trail; (4) if the environmental site assessment identifies any physical conditions or defects in the multi-use trail that would interfere with its intended use as a multi-use trail, as determined by PPDS in its sole discretion, applicant shall complete a supplemental assessment and remedy any such physical condition or defect, to the satisfaction of PPDS; and (5) take all actions necessary to ensure that the multi-use trail is free and clear of any wetland mitigation, endangered or threatened animal or plant species, sensitive habitat or other development restrictions. The applicant shall be solely responsible, and at its sole cost, for any required mitigation costs or measures associated with the multi-use trail. b. The applicant shall submit and obtain PPDS approval of the alignment and design of the multi- use trail prior to submitting improvement plans for the trail. c. The proposed multi -use trail shall comply with Class I bike trail standards, including regulatory signage, as defined in Chapter 1000 of State Department of Transportation Highway Design Manual. The trail shall be 12’ of asphalt concrete paving, with clear , graded shoulders that are a minimum of 2’ in width. Shoulders should be decomposed granite or an alternate material approved by PPDS. Pavement sections shall be 3" minimum asphaltic concrete over 6" min of aggregate base, with a centerline stripe (refer to PPDS Trail detail and specification).
d. Vehicular access controls shall be placed at the entrance to all access points to the trail (refer to PPDS details and specifications for approved designs). e. If designed as joint -use with utility service roads utilizing the service roads aggregate base as the trail’s aggregate base course, Applicant shall design the pavement to meet all required design loads, as approved by PPDS and the Department of Utilities.
f. Where a multi-use trail is located adjacent to any embankment with a greater than 4:1 slope, the Applicant shall, at their own expense, install a post -and- cable fence along the top of the embankment, between the embankment and the multi-use trail.

RE: Delta Shores East Phase (P23-018)
Dear Angel Anguiano,
Thank you for the continued inclusion of Civic Thread in the Delta Shores routings. Cycle 2 for Delta Shores East Phase addresses a number of alterations from the previous cycle, specifically addressing crossings and providing network improvements to offset the loss of two pedestrian bridges originally planned. Additionally, zoning and land-use designations have been altered to accommodate different housing densities and the conversion of a portion of the community park into high density residential.
There are several commendable revisions made to the current plans including:
• New provision for off-street multi-use paths on the north and south side of Cosumnes River Boulevard connecting 24th Street, Tidal Street, and Delta Shores Circle South;
• The designation of 12’ widths for the off-street multi-use paths; • Conversion of a portion of the community park to HDR-12 housing; • Altering residential density in key places from R-1 to R-3.
In addition to those revision Civic Thread supports, we provide the following recommendations which we feel both enhance the stated values of connectivity and safety provided by the development’s design as well as adequately provide for the safe and encouraging use of active modes in lieu of the pedestrian bridges being removed from the plans.
Civic Thread makes the following recommendations:
909 12th Street, Suite 125, Sacramento, CA 95814
916-446-9255 • www.civicthread.org
• The planned off-street multi-use path along the south property line of the HDR-12 and park parcels should connect to the pedestrian crossing of Delta Shores Circle South;
• Traffic calming in the form of both vertical and horizontal deflections along residential collector streets such as 24th Street, Capital Delta Street, and the corridor Delta Shores Circle South;
• The improved crossing in place of the pedestrian bridge at Cosumnes River Blvd.
And Tidal Street and Cosumnes River Boulevard and 24th Street should include dedicated bike traffic signals, leading pedestrian intervals, and conflict striping along immediate bikeway facilities, and high visibility crosswalk markings and/or paint;
The following recommendations apply to the proposed crossing of Delta Shors Circle South as conveyed in Pedestrian+Crossings+Exibit document:
• Detail A
o The crossing would ideally be located on the south side of the intersection so as to avoid potential conflicts with south bound drivers turning into the commercial parking lot. Additionally, traffic volumes will be much higher for vehicles entering and exiting to arrive at/from Cosumnes River Boulevard. o Ensure that the 40’ marked distances indicate the stop line for vehicles once street signal are activated;
o In an overall effort to reduce speed and encourage active travel modes, crossings should incorporate raised crosswalks and/or additional traffic calming measures.
Civic Thread is working to support increased physical activity such as walking and bicycling in local neighborhoods as well as helping to create community environments that support walking and bicycling. The benefits include improved public health and physical fitness, better air quality, a stronger sense of cohesion and safety in neighborhoods, and more sustainable communities and local economies.
Please notify Civic Thread of future routings or notices for this project.
